As clued by the title, it was aimed to explore and describe the legal thought fl ourished in Indonesia in the era of 1945-1990-s. It was focused on the development of legal thought, conducted through collection, inquiry, and inventory of various sources. The inquiry and inventory were deliberately determined within the framework of historical approach, meaning to put the thoughts in the context of space and time. By this perspective, the sources of the theory of law was utilized, both the general and special ones, related to any particular theories or respective period to fi gure out taxonomically those thoughts. Yet, there has been little systematic study of how these two forces have interacted to provide powerful impetus for mobilization in Southeast Asia, a region where religious identities are as strong as nationalist impulses. At the heart of many religious conflicts in Southeast Asia lies competing conceptions of nation and nationhood, identity and belonging, and loyalty and legitimacy. In this accessible and timely study, Joseph Liow examines the ways in which religious identity nourishes collective consciousness of a people who see themselves as a nation, perhaps even as a constituent part of a nation, but anchored in shared faith. Drawing on case studies from across the region, Liow argues that this serves both as a vital element of identity and a means through which issues of rights and legitimacy are understood.

This book – comprising contributions from Muslim scholars, experts and activists - critically and constructively engages with the theological, historical and legal reasoning behind the most restrictive state laws around the world to open up new ways of thinking. The book focuses on the struggle within Muslim societies in Iran, Egypt, Pakistan and Indonesia where blasphemy and apostasy laws serve powerful groups to silence dissent and stifle critical thought. The first part of the book covers the development of the law in shifting historical circumstances and surveys the interpretations of Qur'anic verses that seem to affirm freedom of religion. Book excerpt: This book traces religion and secularity in eleven countries not shaped by Western Christianity (Japan, China, Indonesia, India, Pakistan, Iran, Russia, Turkey, Israel, Egypt, and Morocco), and how they parallel or diverge from Charles Taylor's grand narrative of the North Atlantic world, A Secular Age (2007). In all eleven cases, the state - enhanced by post-colonial and post-imperial legacies - highly determines religious experience, by variably regulating religious belief, practice, property, education and/or law. Taylor's core condition of secularity - namely, legal permissibility and social acceptance of open religious unbelief (Secularity III) - is largely absent in these societies. The areas affected by state regulation, however, differ greatly. In India, Israel and most Muslim countries, questions of religious law are central to state regulation. But it is religious education and organization in China, and church property and public practice in Russia that bear the brunt. This book explains these differences using the concept of 'differential burdening'.
