Book excerpt: L’ art. 32 Cost. stabilisce che la Repubblica tutela la salute sia come diritto dei singoli che come interesse della collettività, e, quindi, in primo luogo a farsene carico sono tutti i soggetti dell’ordinamento giuridico che ricoprono ruoli istituzionali, ciò non esclude che, nei cc.dd. ambiti di vita tipizzati quali sono appunto i luoghi del lavoro, si presentino, a differenti livelli, forme e modi di tutela configurati come obblighi e responsabilità, che disegnano un sistema diffuso di garanzia della persona umana. In questa prospettiva la tutela della salute (e sicurezza) nel lavoro incontra il disposto normativo di cui all’art. 35 Cost., “la tutela del lavoro in tutte le sue forme ed applicazioni”. In questo lavoro, per ovvie ragioni, ci limiteremo ad osservare solo taluni profili della materia, tralasciando gli aspetti ricostruttivi, muovendo dagli effetti prodotti dall’entrata in vigore del d.lgs n. 81 del 2008. In particolare lo faremo mediante l’analisi della giurisprudenza di legittimità in quanto riteniamo che il suo intervento di chiusura nell’applicazione delle norme porti a compimento il processo di sedimentazione delle responsabilità in tema di sicurezza del lavoro, se non altro in riferimento alle nozioni, alle figure fondamentali ed ai profili tecnologici osservati in casi concreti.

Di conseguenza, il datore di lavoro, titolare dei poteri di intervento più ampi, viene identificato come principale soggetto obbligato in materia di salute e sicurezza sul lavoro, tenuto a realizzare l’obiettivo di tutelare i lavoratori unitamente a tutti coloro (dirigenti e preposti su tutti) che hanno un ruolo in azienda. Questo volume si sofferma, quindi, sulla portata e sul significato delle cosiddette “posizioni di garanzia” per i soggetti del sistema di prevenzione aziendale, tenendo conto soprattutto della ampia e rigorosissima giurisprudenza in materia. Particolare attenzione sarà riservata alle ricostruzioni dei Magistrati relativamente alla applicazione in materia di salute e sicurezza dell’articolo 2087 del codice civile, tenendo conto delle moltissime e diverse fattispecie concrete in cui tale norma trova puntuale applicazione. Inoltre, si procederà a identificare – sempre con particolare riguardo alle più recenti sentenze ma anche a circolari e interpelli – le caratteristiche e le competenze delle figure dei dirigenti, dei preposti e dei lavoratori e quelle per la validità ed efficacia della delega, fondamentale strumento di corretta organizzazione della prevenzione in azienda. Il quadro della descrizione delle responsabilità sarà completato dalla illustrazione, sempre molto attenta agli aspetti più operativi, dei meccanismi della “responsabilità amministrativa delle persone giuridiche” di cui al D.Lgs. n. 231 del 2001, come noto applicabile ai reati infortunistici di lesioni gravi o omicidio colposo con violazione della normativa di salute e sicurezza.

La proposta dell’A. è argomentata distinguendo i piani di operatività delle tre aree al fine di valorizzare al massimo l’impostazione prevenzionistica di tipo organizzativo, oltre l’approccio tradizionale rimediale della tutela, come necessaria evoluzione dei principi costituzionali e della sostenibilità sociale dell’attività di impresa centrata sulla persona che lavora. Si delinea pertanto una visione della salute e della sicurezza sul lavoro al cui centro vi sono la certezza del diritto e l’equilibrio tra prevenzione, solidarietà sociale e intergenerazionale e libertà economica per uno sviluppo sostenibile nel contesto regolativo multilivello. Ciò a dispetto di quelle tensioni marcatamente afflittive che poco hanno contribuito all’effettivo innalzamento delle tutele.

But some changes provoke more attention than others, in part due to the vast uncertainty involved in making predictions about the future. The 2019 World Development Report will study how the nature of work is changing as a result of advances in technology today. Technological progress disrupts existing systems. A new social contract is needed to smooth the transition and guard against rising inequality. Significant investments in human capital throughout a person’s lifecycle are vital to this effort. If workers are to stay competitive against machines they need to train or retool existing skills. A social protection system that includes a minimum basic level of protection for workers and citizens can complement new forms of employment. Improved private sector policies to encourage startup activity and competition can help countries compete in the digital age. Governments also need to ensure that firms pay their fair share of taxes, in part to fund this new social contract. The 2019 World Development Report presents an analysis of these issues based upon the available evidence.
