And yet this pioneering experiment in 'ethnic federalism' has been largely ignored in the growing literature on democratization and ethnicity in Africa and on the accommodation of ethnic diversity in democratic states. Apart from giving close examination to aspects of the Ethiopian case, the book asks why the use of territorial decentralization to accommodate ethnic differences has been generally unpopular in Africa, while it is growing in popularity in the West. The book includes case studies of Nigerian and Indian federalism and suggests how Ethiopia might learn from both the failures and successes of these older federations. In the light of these broader issues and cases, it identifies the main challenges facing Ethiopia over the next few years, as it struggles to bring political practice into line with constitutional theory, and thereby achieve a genuinely federal division of powers. Book excerpt: Abstract The FDRE constitution has established ethnic federal arrangement in one hand and incorporates everyone’s right to freedom of movement and residence everywhere within Ethiopian territory on the other. Besides this, ethnic self determination has established as a cornerstone of the federal system. But, there is no any single study has conducted to look at the practical serene coexistence of Ethiopian federal system and the right to freedom of movement and residence. Thus, the main issue addressed in this paper is whether the federal system has implemented properly in congruent with the right to freedom of movement and residence of individuals in Ethiopia. The thesis has also tried to explore whether the institutions put in place to safeguard the right to freedom of movement and residence has worked efficiently and effectively by way of giving the required remedy in case of violation. In doing so the writer has analyzed cases with integrating interview responses as well as explores other countries experiences. After conducting serious analysis, the writer has, eventually, reached to the following findings: ethnic federal setup of Ethiopia has practically negative implication on the right to freedom of movement and residence; ethnic based political parties are also responsible for the violation due to their contribution to the increasing ethnic consciousness of the society. Governmental safeguard institutions are not properly safeguarding this right from the pitfall of Ethiopian ethnic federal system; Misuse of ethnicity for political game by the ruling EPRDF party has aggravated the impact of ethnic federal system on the violation of such freedom.

The absence of effective enforcement can be attributed to various factors, including the absence of a normative framework, insufficient political commitment, inadequate institutional capacity and resources, and limited awareness. Despite recent legal reform initiatives purportedly driven by human rights demands, it remains uncertain whether enforcement has undergone any significant changes. Effective enforcement of human rights necessitates the existence of robust multi-layered institutions at the national, sub-regional, regional, and international levels. However, in Ethiopia, concerns have been raised about the capability of numerous normative instruments and mechanisms of human rights. This volume comprises a collection of papers presented at a hybrid conference held at the Hilton Hotel Addis in April 2022. The conference, organized by the School of Law of Addis Ababa University in collaboration with Friedrich Ebert-Stiftung, Ethiopia, centered around the theme "Enforcement of Human Rights in Ethiopia: Old and New Challenges." Its primary objective was to identify and analyze both old and new challenges in human rights enforcement in Ethiopia and propose strategies to overcome them. The editors of this volume intend for it to address scholarly gaps in the implementation and enforcement of human rights in Ethiopia. Among the notable findings from the chapters included in this volume is a significant disparity between recently reformed laws passed by the parliament and their execution by the executive body. This disconnect demonstrates a failure to prioritize and enforce human rights in the country. As such, the volume suggests that the Ethiopian government must take the business of human rights enforcement seriously.

Ethiopia, as signatory of these international human right instruments, the FDRE constitution stipulates the right to political participation right of all Nation, Nationalities and People of the country without any discrimination. However, regional states, like Benishangul-Gumuz, had face serious criticism that ‘non-indigenous’ people are face serious problem in the enjoyment of their right to political participation. This research has aimed to assess the political participation of ‘non-indigenous’ people of Benishangul-Gumuz Regional State in a case study of Bambasi Woreda. It looks and measures the participation of ‘non-indigenous’ people in public decision making and assess the ‘indigenous’ vs. ‘non-indigenous’ composition of institutions of Bambasi Woreda’s administration and normative instruments for the accommodation and consideration of the right to political participation of ‘non-indigenous’ people. In investigating reliable data, the researcher utilizes the qualitative research approaches unstructured in-depth interview, key informant interview and field observation as data collection instruments, in combination with different documents and articles. As findings of the study reveal, the right to political participation has been shortened by normative and institutional constraints that range from the federal up to the Kebele administration level. Hence, it is highly recommended that there must be a structural change that helps to establish an inclusive normative and administrative institution which ranges from the reconsideration of ‘non-indigenous people up to a constitutional amendment and complete re-institutionalization of the administration.

Ethiopia is also a regional superpower with political influence across East Africa and the Horn. Furthermore, the African Union has its headquarters in the capital Addis Ababa, which further underscores the country’s growing international profile. On top of everything, since 1995 Ethiopia has a federal constitution explicitly committed to granting political autonomy to all ethnic groups within the country. Ethiopia’s federalism has also direct relevance to the country’s neighbours, Eritrea, Somalia, Kenya, South Sudan, and Djibouti who have ethnic kin across the borders with Ethiopia. Yet, despite the generous promises to the country’s ethnic groups stated in the constitution, not everything is well. As marked by the recent unrest throughout various regions of the country, the federal constitution’s promises and the reality do not always perfectly align. But there is a shortage of even-handed scholarly analyses of this complex country, and in particular, its unique federal system. This book assesses the Ethiopian ethnic federal system from the perspective of the principles of socialist federations and other Marxist oriented policies pursued by the ruling Ethiopian Peoples' Revolutionary Democratic Front (EPRDF). Exploring how the application of these ideological principles has impacted on the structure and function of the Ethiopian federal system, the research examines the ways in which these ideological policies of the ruling party affect national consensus, protection of human rights, the rights of minority groups, separation of power principles and the relationship between the federal and regional governments. It also explores the extent to which ideological principles have had an impact on the democratization process, rule of law and in building up institutions such as parliamentary democracy, the judiciary, the media and civil society organizations in the country.
