Book Law And Regulation Of Common Carriers In The Communications Industry

Download or read book Law And Regulation Of Common Carriers In The Communications Industry written by Daniel L Brenner and published by Routledge. This book was released on 2018-03-14 with total page 299 pages. Available in PDF, EPUB and Kindle. Book excerpt: This revised casebook-plus-commentary offers a basic introduction to the traditional regulation of telephone companies as well as the new lines of businesses they have entered. Drawing on historical and contemporary court decisions as well as on FCC and legislative materials, Brenner documents and evaluates the past twenty years of regulation of the telecommunications industry. In particular, he traces the major regulatory changes from the time of AT&T's single-firm dominance to the increasingly competitive marketplace of today. The law and literature necessary to understand the development and trends in telecommunications are voluminous and, up until now, have been difficult to locate in one place. This book presents the critical concepts and shifts in communications policy coherently and concisely. In this revised and expanded edition, Brenner provides excerpts and comments upon the key decisions in the field, ordering them in a readily accessible manner. He assumes no specialized background in technology, law, or economics. Brenner provides an ideal introduction to this increasingly important field for professionals as well as for scholars and students interested in communications and communications policy.

Book The Common Carrier Privacy Model

Download or read book The Common Carrier Privacy Model written by Adam Candeub and published by . This book was released on 2018 with total page 42 pages. Available in PDF, EPUB and Kindle. Book excerpt: "The Federal Communications Commission ("FCC"), in its landmark and controversial "network neutrality" 2015 Open Internet Order, prohibited internet service providers, such as Comcast and Verizon, from discriminating against non-affiliated content-providers. In doing so, the FCC relied upon the Communications Act of 1934's section 201's "common carrier" jurisdiction. Whle section 201 gives the FCC vast power to curb anti-competitive network practics, section 201 also permits the FCC to regulate common carriers' privacy policies. Specifically, section 201 allows imposition of the duty not to disclose the content of messages entrusted to carriers and gives individuals rights to recover upon breach. This Article is the first modern examination of section 201 privacy obligations - which have been largely forgotten since the late nineteenth century. Recent court decistions have ruled that the FCC's common carrier jurisdiction preempts the Federal Trade Commission's ("FTC's") jurisdiction over internet firms, giving common carrier privacy sudden policy prominence. Because common carrier privacy gives individuals the option to protect the confidentiality of messages and the right to recover damages upon breach, common carriage privacy contrasts with dominant top-down approaches to privacy, such as the Health Insurance Portability and Accountability Act ("HIPAA") and the Fair Credit Reporting Act ("FCRA"), in which regulators determine what information receives protection and on what terms. Studies consistently show that consumers typically neither nor appreciate their rights under these privacy regimes. In this way, forgotten common carrier privacy offers a new set of both practical and theoretical tools."
