Book excerpt: Nul n'est plus exposé que le médecin à tomber sous le coup des articles 319 et 320 du Code pénal, puisque, dans le cadre de son activité professionnelle, nécessairement, toute « maladresse, imprudence, inattention, négligence ou inobservation des règlements » est de nature à entraîner un dommage corporel. Or, on sait que depuis un arrêt de la Chambre civile en date du 18 décembre 1912, la jurisprudence affirme d'une manière constante l'identité de la faute civile et de la faute pénale. A l'époque contemporaine où, en matière civile, la faute n'apparaît plus, souvent, que comme un simple prétexte à assurer une réparation civile, pratiquement toujours supportée par l'assurance, la conséquence pratique de cette identité est le risque de voir s'installer une paradoxale, mais combien redoutable, autorité de fait du civil sur le criminel, préjudiciable à une bonne administration de la justice pénale. C'est pourquoi une partie importante de la doctrine contemporaine conteste le principe de l'identité des fautes. Mais, mené sur le terrain strict de la faute, le combat n'est pas mené sur un terrain propice. En effet, la logique impose qu'un même fait non intentionnel, nécessairement apprécié d'une manière objective — par référence à un standard — s'il est déclaré fautif en matière civile le soit aussi en matière pénale. En revanche, cette même logique impose d'exiger, pour retenir la responsabilité pénale l'existence d'un élément d'imputabilité dont la présence n'est pas nécessaire pour retenir la responsabilité civile. C'est donc au plan de la responsabilité que la dissociation doit se faire, et non au plan de la faute.
