Book Expedited Procedures in International Commercial Arbitration

Download or read book Expedited Procedures in International Commercial Arbitration written by Andreas Wehowsky and published by sui generis Verlag. This book was released on 2023-07-24 with total page 358 pages. Available in PDF, EPUB and Kindle. Book excerpt: International arbitration has enjoyed remarkable success. However, in recent years repeated concerns relating to the efficiency of the proceedings have emerged. These concerns have led to the introduction of provisions for expedited arbitral procedures. Through analysing various arbitration rules, this book will examine the require-ments under which expedited procedures are admissible, what the central char-acteristics of such procedures are, and how such procedures can be classified and described in comparison to a conventional arbitral procedure. A significant part will examine the tension between procedural efficiency on the one hand and on quality of the procedure and award on the other. In an excursus, early determination procedures will be examined to complete the tool box to increase procedural efficiency.

Book excerpt: "The book does an outstanding job in covering all the necessary details on congressional rules and procedures, most of which are not easy to understand. [...] It has been and will remain to be a must-read for all the congressional politics students and Washington insiders." – Hong Min Park, University of Wisconsin - Milwaukee Congressional Procedures and the Policy Process examines the entire arc of the legislative process—from a bill’s introduction, to its signature into law, to congressional review of the law’s administrative implementation—and the many procedural pitfalls that exist along the way. Through an array of interesting examples, case studies, and the authors’ personal anecdotes, this definitive work delivers timely explanation and analysis of the nation’s premier lawmaking institution.

Book Procedure and Evidence in International Arbitration

Download or read book Procedure and Evidence in International Arbitration written by Jeffrey Waincymer and published by Kluwer Law International B.V.. This book was released on 2012-05-23 with total page 1363 pages. Available in PDF, EPUB and Kindle. Book excerpt: Central to the book’s purpose is the procedural challenge facing arbitrators at each and every stage of the arbitral process when fairness arguments conflict with efficiency concerns and trade-offs must be determined. Some key themes include how can a tribunal be fair, and in particular be neutral, if parties are so diverse? How can arbitration be made efficient and cost-effective without undue inroads into fairness and accuracy? How does a tribunal do what is best if the parties are choosing a suboptimal process? When can or must an arbitrator ignore procedural choices made by the parties? The author thoroughly evaluates competing arguments and adds his own practical tips, expertly synthesizing and engaging with the conference literature and differing authors’ views. He identifies criteria that offer a harmonized approach to each stage of the arbitral process, with particular attention to such aspects of international arbitration as: appropriate trade-offs between flexibility and certainty; the rights, duties and powers of arbitrators; appointment and challenge of arbitrators; responses to ‘guerilla’ tactics; drafting of arbitration agreements, including specialty clauses; drafting of required commencement notices and response documents; set-off; fast track arbitration and other efficiency options; strategic use of preliminary conferences and timetabling; online arbitration; multi-party, multi-contract, class arbitration; amicus and third party funders; pre-arbitral referees and interim relief; witness evidence, both factual and expert; documentary evidence, production obligations, and challenges to production; identifying applicable law; and remedies and costs.

Book Legislative Drafting Step by step

Download or read book Legislative Drafting Step by step written by Arthur J. Rynearson and published by . This book was released on 2013 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: Legislative Drafting Step-by-Step is a practical, step-by-step guide to drafting legislation. This "how to" book untangles the web of confusion and technical detail that surrounds legislative drafting and presents drafting in an easy-to-understand way. In so doing, legislative drafting is shown to be a fun, intellectually engaging endeavor and not an intimidating prospect to be dreaded. In short, this concise, user-friendly guide seeks to de-mystify legislative drafting. Legislative Drafting Step-by-Step includes the following: * A five-step framework for analysis to guide the drafter in converting any legislative proposal into an actual bill, resolution, or amendment. * Easy-to-learn rules to carry out each step of drafting. * More than 150 examples of draft legislative language. * 19 charts and tables illustrating the text. * 9 drafting exercises, together with the answers, to test drafting skills. * A description of the United States legislative process, as viewed by a legislative drafter. * 16 House and Senate bill, resolution, and amendment forms. Legislative Drafting Step-by-Step is designed to assist legislators, their staffs, and all who read or write legislation to better understand the basics of legislative drafting and the important role that well written legislation plays in promoting the rule of law. To this end, this guide may be used either as an essential reference tool for any office drafting legislation or as an introduction to legislative drafting for anyone seeking to learn the craft. Legislative Drafting Step-by-Step is copublished by the International Law Institute. "The people who are best at doing things are not always equally adept at explaining what they do and how they do it. That is why I am so pleased that we have Arthur Rynearson''s Legislative Drafting Step-by-Step to explain, carefully and lucidly, how bills and other legislative documents are drafted for consideration by Congress in Washington. This book should be required reading for every Representative and Senator, every congressional staffer involved in the legislative process, every lobbyist, and every lawyer and law student who is interested in public policy and how it is made. ...[A] careful reader will come to appreciate Mr. Rynearson''s enthusiasm for and pride in his chosen profession. ...What they also will come to appreciate is that there are so many serious and dedicated people like Mr. Rynearson who devote their professional lives to enabling our government to do what we want it to do." -- Dr. Stanley Bach (Amazon.com review) "Mr. Rynearson has produced a guide for the legislative drafter that is both concise and complete. It is very well organized and presents a very complicated subject as clearly and directly as possible. Throughout the book, Mr. Rynearson has included drafting problems that are perfectly conceived to test the reader''s understanding of each of the teaching points presented. And he very thoughtfully provides answers for the exercises at the end of the book. The book concludes with a series of appendices that should be very helpful to the aspiring drafter. All-in-all, Legislative Drafting Step-by-Step is a highly readable and useful introduction to the art of legislative drafting, but it would also serve well as an excellent refresher course for the experienced drafter." -- Francis L. ("Frank") Burk, Jr., Legislative Counsel of the United States Senate, 1991-1999, and currently self-employed as a legislative drafting consultant "Arthur Rynearson''s quarter century career as legislative draftsman, ultimately as Deputy Legislative Counsel of the United States Senate, enables him to draw on the experience of drafting literally thousands of legislative instruments for the US Senate. [...] There is a very detailed table of contents, a useful index and more than 50 pages of exercises (and answers!). To conclude: it has been an almost unadulterated pleasure to read this book. I heartily recommend it." -- Don Wallace, Jr., Professor of Law, Georgetown University Law Center, and Chairman, International law Institute

Book Parliament and Congress

Download or read book Parliament and Congress written by William McKay and published by Oxford University Press. This book was released on 2010-06-03 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: The constitutional background of both legislatures and their procedures are described and where possible compared. Currently unsolved problems often have much in common, in vexed areas such as ethics requirements or how procedural rules permit minorities fair access to legislative time before majorities prevail. British successes include the enhanced authority and effectiveness of select committees and the acquisition of more debating time by the creation of a parallel Chamber. Unsolved problems at Westminster begin with the powers and status of the Lords, and go on through the search for more effective review of EU activities, adapting parliamentary scrutiny to more sophisticated government financial information, and making better use of legislative time without diminishing back-bench rights. The accelerated pace and extent of procedural changes in Congress is problematic. Constant pursuit of campaign funds, increased party exploitation of Members' ethical shortcomings, and partisan reapportionments, have diminished collegiality and compromise. Business is conducted with greater predictability, with fewer quorum calls, postponement and clustering of votes, and by utilization of ad hoc special orders, often in derogation of openness and minority rights in the House. Minority complaints have been frequent and occasionally extreme. Conversely constant filibuster threats in the Senate have enhanced minority party power there. An 'inverse ratio' between the greater complexity, importance, and urgency of pending legislation on the one hand, and diminution of deliberative capacity, fairness. and transparency on the other, has been repeatedly demonstrated, especially at the stage of final compromises between the Houses.

This book was released on 2007-04-23 with total page 232 pages. Available in PDF, EPUB and Kindle. Book excerpt: Large cross-border mergers have to be cleared in advance by the EC Commission. If the Commission prohibits a merger, or a third party objects to the clearance, the decision can be challenged in the Court of First Instance (CFI). However the CFI procedure can take several months, thereby prolonging uncertainty and sometimes causing bids to be abandoned. This is unsatisfactory and the CBI has proposed a new Competition Court as the way forward. This report looks at this proposal and concludes that such a court would not be the best way forward. Instead there is scope for improving current procedures by firmer case management, reducing the work load of the CFI by transferring trade mark cases, and improving the Commission's handling of cases to reduce the number and scope of challenges.

Available in PDF, EPUB and Kindle. Book excerpt: India has a long-standing tradition of dispute resolution through arbitration, with arbitral-type regulations going back to the eighteenth century. Today, amendments to the 1996 Indian Arbitration Act, a steady evolution of case law and new arbitral institutions position India’s vibrant system once more at the forefront of international commercial dispute resolution. In this handbook, over forty members of the international arbitration community in India and beyond offer authoritative perspectives and insights into topics on arbitration that matter in India. International arbitration practitioners, Indian practitioners, and scholars have combined efforts to produce a practical and informative guide on the subject. Among numerous notable features, the contributors provide detailed analysis and description of such aspects of arbitration as the following, with a focus on the Indian context: Indian application of the 1958 New York Convention; law governing the merits of the dispute and awards; investor-state dispute settlement; drafting arbitration clauses for India-centric agreements; managing costs and time; rise of virtual arbitration and technology; effect of public policy in light of extensive Indian jurisprudence; and arbitration of claims relating to environmental damage. Practical features include checklists for drafting arbitration clauses and a comparative chart of major commercial arbitration rules applicable to India. Also included is a comparative analysis of arbitral regimes in India, Singapore and England; chapters on the India Model Bilateral Investment Treaty and ISDS reforms; a special section on the enforcement of foreign awards; a section on the drafting of the award guided by leading arbitrators and stakeholders and a review of the new 2021 ICC Rules. For foreign counsel and arbitrators with arbitrations in India, this complete and up-to-date analysis provides guidelines for practitioners, corporate counsel, and judges on considerations to be borne in mind with respect to arbitration with an Indian nexus and whilst seeking enforcement and execution of an arbitral award in India. It will prove an effective tool for students and others in understanding and navigating the particularities and peculiarities of India’s system of domestic and international commercial arbitration.
