On calcule, à l’aide des informations descriptives contenues dans le rapport d’expertise et en fonction de la situation de la victime ainsi que des éléments de preuve chiffrés qu’elle fournira, le préjudice futur subi par capitalisation des pertes de gains annuelles. Ces pertes annuelles résultent de la comparaison des revenus professionnels perçus par la victime avant et après son accident. Après avoir calculé la perte de revenus annuelle, on applique le prix d’euro de rente à l’âge de la victime (à la consolidation ou au moment du règlement). À noter que la capitalisation de la perte annuelle est soit temporaire, soit viagère, suivant la possibilité de connaître ou non l’incidence d’un départ anticipé sur le calcul de la retraite. À PROPOS DES AUTEURS Francis Noël est est diplômé en droit, ancien cadre gérant les sinistres IARD matériels, corporels et contentieux d’un grand groupe, puis agent général. Désormais professeur en BTS d’assurance au lycée St Remy et chargé de travaux dirigés en licence professionnelle à l’IUT de Laon. Bruno Mellaré est diplômé en droit et titulaire du DIU « Traumatismes Crânio-Cérébraux ». Il évolue dans l’univers de l’indemnisation depuis plus de vingt ans. Actuellement inspecteur corporel au service d’un grand groupe d’assurance mutualiste, il intervient dans l’instruction et le règlement de dossiers sinistres corporels à enjeux très importants (techniques et financiers).
