These labourers work difficult and dangerous jobs with limited legal protections and are effectively barred from permanent settlement in Canada. In Harvesting Labour Edward Dunsworth examines the history of farm work in one of Canada’s underrecognized but most important crop sectors – Ontario tobacco. Dunsworth takes aim at the idea that temporary foreign worker programs emerged in response to labour shortages or the unwillingness of Canadians to work in agriculture. To the contrary, Ontario’s tobacco sector was extremely popular with workers for much of the twentieth century, with high wages attracting a diverse workforce and enabling thousands to establish themselves as small farm owners. By the end of the century, however, the sector had become something entirely different: a handful of mega-farms relying on foreign guest workers to produce their crops. Taking readers from the leafy fields of Ontario’s tobacco belt to rural Jamaica, Barbados, and North Carolina and on to the halls of government, Dunsworth demonstrates how the ultimate transformation of tobacco – and Canadian agriculture writ large – was fundamentally a function of the capitalist restructuring of farming. Harvesting Labour brings together the fields of labour, migration, and business history to reinterpret the historical origins of contemporary Canadian agriculture and its workforce.

Book excerpt: On 29 April 2011, the Supreme Court of Canada released its much-anticipated decision in Attorney General of Ontario v Fraser, which dealt with the scope of constitutional protection of collective bargaining. The case involved a constitutional challenge to an Ontario statute on the grounds that it violated agricultural workers' freedom of association and right to equality by excluding them from the statutory protection that is available to virtually all other private sector workers and by failing to provide them with alternative legislative support for meaningful and effective collective bargaining rights. Although the Court upheld the constitutionality of the legislation by an eight to one majority, it provided four different, and incommensurable, sets of reasons. For the union that instigated the litigation, Fraser is a defeat. For the labour movement and their advocates, Fraser is ambiguous. What is clear, however, is that the Supreme Court of Canada was badly divided over the scope of protection that freedom of association provides to the right to bargain collectively. This collection of original essays untangles the two stories that are intertwined in the Fraser decision--the story of the farm workers and their union's attempt to obtain rights at work available to other working people in Ontario, and the tale of judicial discord over the meaning of freedom of association in the context of work. The contributors include trade unionists, lawyers, and academics (several of whom were involved in Fraser as witnesses, parties, lawyers, and interveners). The collection provides the social context out of which the decision emerged, including a photo essay on migrant workers, while at the same time illuminating Fraser's broader jurisprudential and institutional implications.

In contrast,Producing and Negotiating Non-Citizenship considers a range of people whose pathway to citizenship is uncertain or non-existent. This includes migrant workers, students, refugee claimants, and people with expired permits, all of whom have limited formal rights to employment, housing, education, and health services. The contributors to this volume present theoretically informed empirical studies of the regulatory, institutional, discursive, and practical terms under which precarious-status non-citizens – those without permanent residence – enter and remain in Canada. They consider the historical and contemporary production of non-citizen precarious status and migrant illegality in Canada, as well as everyday experiences of precarious status among various social groups including youth, denied refugee claimants, and agricultural workers. This timely volume contributes to conceptualizing multiple forms of precarious status non-citizenship as connected through policy and the practices of migrants and the institutional actors they encounter.
