As the three countries transitioned from democratic to authoritarian forms of government (and back), they confronted challenges posed by the rise of the feminist movement, social changes, and the power of the Catholic Church. The results were often surprising: women's rights were expanded under military dictatorships, divorce was legalized in authoritarian Brazil but not in democratic Chile, and no Latin American country changed its laws on abortion. Sex and the State explores these patterns of gender-related policy reform and shows how they mattered for the peoples of Latin America and for a broader understanding of the logic behind the state's role in shaping private lives and gender relations everywhere.

Chapter 1 describes the evolution of the protection of reproductive rights and how the prohibition constituted to violations on health-related and other human rights. Chapter 2 discusses Chilean health policy and abortion as the cause of public health problem. Chapter 3 provides analysis of domestic legislation and court records of women who were prosecuted for abortion, with discussions of actual individuals prosecuted for abortion. Chapter 4 summarizes the social and economic data on the women prosecuted for abortion, as well as on the abortion providers, which includes all women who had abortions, even those who were not prosecuted because they were minors or victims of abortion. Lastly, chapter 5 presents several recommendations at the national and international levels in the cessation of prosecution of women who have undergone abortion, with emphasis on the roles of international donors and the universal and regional human rights systems.

Richard John Neuhaus (1936-2009) was one of the most influential figures in American public life from the Civil Rights era to the War on Terror. Buckley, Jr. and John Kenneth Galbraith are comparable -- willing controversialists and prodigious writers adept at cultivating or castigating the powerful, while advancing lively arguments for the virtues and vices of the ongoing American experiment.
