Book Aspects of Extradition Law

Download or read book Aspects of Extradition Law written by Geoff Gilbert and published by BRILL. This book was released on 2022-07-04 with total page 297 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines those aspects of the law of extradition which reveal conflicts between different legal systems and where there is a need for an improvement in procedures, either in the interest of mutual legal assistance or for the better protection of the fugitive. The book starts from the assumption that, unless otherwise stated, the principles applied by domestic courts are of universal applicability. Such a broad generalisation is not guaranteed to be right in every circumstance, but it concentrates the study on extradition law itself, rather than on the various national interpretations of domestic extradition laws. The law is stated in accordance with the materials available at 1 December 1990. Most extradition agreements tend to focus on those matters which form the basis for this book. Throughout the discussion of these matters it will be noticed that there is a tension between extradition law as part of a process of mutual assistance by states in the area of criminal justice, and extradition law as a means of protecting the fugitives' rights and freedoms. Dr Geoff Gilbert is a Senior Lecturer in the Department of Law and a member of the Human Rights Centre at the University of Essex. Within the H.C.R., he teaches International Criminal Law on the LL.M. in International Human Rights.

Book excerpt: For almost two hundred years the United States has been a safe haven for Irish political prisoners seeking refuge. More recently however the US government has sought deportation, extradition and prosecution to exclude Irish republicans from the country. In the first book to focus on the relationship between these tools of exclusion and US foreign policy, Karen McElrath examines why this change has come about and the extent to which the granting of political asylum in the US is influenced by relations with Britain and other countries.Karen McElrath questions US government attempts to portray an impartial role in the Irish conflict, arguing that historical and contemporary evidence reveals otherwise. She shows that, far from being a neutral process, the success of bids for political asylum often depends on the relationship between the US and the government of the applicant's country of origin. Drawing on exclusive interviews with Irish Republicans who have faced deportation or extradition from the United States, or who have been prosecuted in the US for politically-motivated offences, McElrath explores the links between deportation and extradition outcomes and foreign policy issues. The tools of exclusion are defined in their historical context, and the history of US extradition law is described, with particular focus on the treaties with Britain. McElrath also examines the offences for which Irish and Irish-American Republicans have been charged, discusses the various levels of support for Irish political prisoners in the US, and summarises the findings by international human rights organisations.

Book Commonwealth Caribbean Criminal Practice and Procedure

Download or read book Commonwealth Caribbean Criminal Practice and Procedure written by Dana S. Seetahal and published by Routledge. This book was released on 2014-06-05 with total page 495 pages. Available in PDF, EPUB and Kindle. Book excerpt: The fourth edition of this best-selling book has been thoroughly revised to take into account recent developments in the law in criminal practice and procedure across the region. The only textbook that explores criminal practice and procedure as it relates to the Commonwealth Caribbean, the book clarifies the state law in each of 11 jurisdictions, at the same time making it clear when laws are the same or similar and highlighting where differences among jurisdictions occur. Both statute law and common law are examined in the relevant jurisdictions, which include Trinidad and Tobago, Guyana, Barbados, Jamaica and Grenada amongst others. The impact of statutory changes in the laws are analysed, as well as recent developments in the common law. Throughout the text the statutory law in the Commonwealth Caribbean is compared to similar English legislation, in the light of the analysis of such legislation in English case law. Commonwealth Caribbean Criminal Practice and Procedure is the recommended textbook for all profes- sional law schools in the Commonwealth Caribbean and is used at regional universities as a reference book for criminal justice students. In addition, as the only book that deals specifically with criminal practice and procedure in the regions, it has proved a valuable reference tool for legal practitioners, judicial officers and police officers.
