Care Without Coverage examines the real consequences for adults who lack health insurance. The study presents findings in the areas of prevention and screening, cancer, chronic illness, hospital-based care, and general health status. The committee looked at the consequences of being uninsured for people suffering from cancer, diabetes, HIV infection and AIDS, heart and kidney disease, mental illness, traumatic injuries, and heart attacks. It focused on the roughly 30 million-one in seven-working-age Americans without health insurance. This group does not include the population over 65 that is covered by Medicare or the nearly 10 million children who are uninsured in this country. The main findings of the report are that working-age Americans without health insurance are more likely to receive too little medical care and receive it too late; be sicker and die sooner; and receive poorer care when they are in the hospital, even for acute situations like a motor vehicle crash.

If the Legislature fails to give this matter priority at the end of the its current session, consumers' opportunity to have disputes over access to treatments resolved under the carefully crafted standards of New York law, by impartial decision-makers selected by the State, may be lost, and consumers may find themselves having to use an unfamiliar federal system which is yet to be developed.

Book excerpt: The Affordable Care Act requires that now, after an insurance company has denied a healthcare claim, the company must provide an opportunity for external review of the denial. Both the Department of Labor and the press have heralded this change as a boon to consumers that will ease the healthcare claims appeal process. But will the average consumer benefit from this new level of review? As a practical matter, is a further level of review -- usually available only after two internal levels of review -- the kind of reform that will make a difference to most consumers? Or is this new level of review just one more barrier, set up to thwart the consumer's efforts to be reimbursed for healthcare? This article posits that the new external review rules are an imperfect substitute for more extensive ERISA claims reform. The external review rules should be revised so that payors rather than consumers suffer the negative effects of incorrect claims decisions. That is, the rules should internalize the real costs of incorrect denials by imposing a penalty on payors when claims are reversed on external appeal. In addition, to be useful to the average consumer, external review should also be more available, understandable, and independent.

Book excerpt: Most states have laws that allow patients to appeal to an independent review organization when their health plan or insurer deems a service unnecessary or experimental and denies coverage. The Affordable Care Act requires the Department of Health and Human Services (HHS) to develop standards for these independent review organizations. The standards can help hold review organizations and health plans accountable for their decisions and also can facilitate the evaluation of emerging therapies and technologies as well as coverage policy. To this end, HHS should require health plans and independent review organizations to report basic information, including what medical issues and contested therapies were the subject of appeals, and the grounds for their decisions. What's more, to preclude conflicts of interest, the HHS standards should prohibit independent review organizations from participating in appeals involving health plans that have employed them for other work.
