The export control system (ECS) is intended to balance multiple U.S. interests. The ECS is managed by the State Dept., which regulates arms exports, and the Commerce Dept., which regulates dual-use exports that have military and civilian applications. Arms exports require licenses, while dual-use exports do not require licenses. This testimony focuses on export licensing inefficiencies, poor interagency coordination, and limits in State¿s and Commerce's ability to provide a sound basis for changes to the system. GAO assessed (1) how the government's export control processes apply to the protection of export-controlled information, and (2) steps the government has taken to identify and help mitigate the risks in protecting export-controlled information. To do this, GAO analyzed agency regulations and practices and interviewed officials from 46 companies with a wide range of exporting experiences.

Civil and commercial space actors that engage in international endeavors must comply with space technology export controls. In the general discourse, members of the civil and commercial space community have an understanding of their domestic export control regime. However, a careful reading of the literature on space technology export controls reveals that certain questions relevant to international engagements have not been identified or answered. What is the legal-political origin of space technology export controls? How do they relate to the current international legal structure? What steps can be taken to evolve our current unilateral paradigm of space technology within the context of peaceful exploration and use of outer space? In this book, these and other relevant questions on space technology export controls are identified and assessed through an insightful case-study of the U.S. commercial communication export control regime. The findings of this case-study are used in an international legal-political analysis of international space law, public international law, and international cooperation. Breaking new ground in international legal theory, a self-justified security dilemma that is manifest in international law is identified and explained as the origin for the current paradigm of space technology export controls.

The Department of State regulates U.S. defense exports and the Department of Commerce regulates dual-use exports that have commercial and military applications. Each agency uses a separate control list of items that may require a license to export. Agencies use compliance activities to prevent the diversion or misuse of exported items against U.S. interests or allies. Misuse can occur through illicit transshipment, the diversion of items from their origin through an intermediary country to an unauthorized destination. In 2010, the President announced reforms to the export control system. This review examines (1) agencies' compliance activities to address transshipment risk and (2) the extent to which U.S. agencies assessed the impact of export control reforms on the resource needs for compliance activities. GAO analyzed U.S. licensing data for 13 transshipment countries and visited Hong Kong, Singapore, and the United Arab Emirates. "

Book excerpt: The U.S. government's control over the export of defense and dual-use items is intended to ensure that U.S. interests are protected in accordance with the Arms Export Control Act (AECA) and the Export Administration Act (EAA). Defense items can include tanks, fighter aircraft, submarines, firearms, satellites, missiles, and training; while dual- use items can include computers, radars, and telecommunication equipment. Jurisdiction over the export of defense and dual-use items is primarily divided between State and Commerce. Generally, unless an exemption applies, exporters submit a license application to State if their items are controlled on the U.S. Munitions List or to Commerce if their items are controlled on the Commerce Control List pursuant to the Export Administration Regulations to receive export approval. As part of the application review process, State and Commerce consult with other departments, including DOD and with Treasury in the case of sanctioned countries. Offices within Commerce, DHS, Justice, and State conduct enforcement activities. Treasury and Commerce administer the current sanctions program for designated countries.
