Au nom de la biodiversité, protéger est désormais devenu le maître mot. Dans ce nouveau paradigme, les dispositions juridiques relatives à la louveterie et à la destruction des nuisibles sont contestées. Elles témoignent pourtant d'une réalité des rapports entre l'homme et la faune sauvage que l'histoire du droit permet d'appréhender et de comprendre. La présente étude participe à décrire cette réalité dans le cadre historique et géographique de la Lorraine et du Barrois au XVIIIe siècle. Pour saisir la marche progressive et le développement organique de la louveterie et de la destruction des animaux nuisibles en Lorraine et Barrois au XVIIIe siècle, l'étude définit ce que sont les nuisibles et détermine la nature juridique de leur destruction. Elle montre que ces animaux sont une sorte de gibier et qu'à ce titre, ils relèvent du droit commun de la chasse. Les mesures administratives dirigées contre ces animaux ne constituent dès lors qu'un pan spécial du droit de la chasse. Ces mesures se classent en deux catégories : les mesures confiant la destruction des nuisibles à des agents spécialisés tels que les louvetiers dont l'une des principales prérogatives est d'effectuer des battues publiques ; les mesures délégant à l'initiative individuelle le soin de tuer ces animaux, notamment les loups avec la mise en place d'un système de primes. L'analyse des gratifications rend d'ailleurs compte d'une véritable destruction populaire de ces prédateurs à la fin du XVIIIe siècle.

Questions about the origins and inherent motivations of warfare have long engaged philosophers, ethicists, and anthropologists as they speculate on the nature of human existence. In How War Began, author Keith F. Otterbein draws on primate behavior research, archaeological research, and data gathered from the Human Relations Area Files to argue for two separate origins. He identifies two types of military organization: one that developed two million years ago at the dawn of humankind, wherever groups of hunters met, and a second that developed some five thousand years ago, in four identifiable regions, when the first states arose and proceeded to embark upon military conquests. Ecological changes made these landscapes especially suitable for the vector mosquitoes of yellow fever and malaria, and these diseases wrought systematic havoc among armies and would-be settlers. Because yellow fever confers immunity on survivors of the disease, and because malaria confers resistance, these diseases played partisan roles in the struggles for empire and revolution, attacking some populations more severely than others. In particular, yellow fever and malaria attacked newcomers to the region, which helped keep the Spanish Empire Spanish in the face of predatory rivals in the seventeenth and early eighteenth centuries. In the late eighteenth and through the nineteenth century, these diseases helped revolutions to succeed by decimating forces sent out from Europe to prevent them.
