The Committee also states that the establishment of such a body requires a good management structure along with adequate funding. The Committee further states that the Government should take a clear and consistent line on the correct legal base for this and similar proposals.

Book excerpt: The main objective of this book is to present the on-going process of European integration via a comprehensive analysis of the institutional dynamics of, and politics linked with, the emerging migration law and policy of the European Union. More specifically, it presents the historical evolution, the main institutional legislative and policy steps, the position of, and interactions among, the different actors, and the factors impeding the formation of a common policy at EU level. On this basis a critical analysis is provided of the main institutional problems, the current policy framework, the overarching rationale as well as of the content and quality of the nascent EU migration law. The book is divided into three parts. The first two parts provide a comprehensive study of the institutional framework and the substantive EC/EU law respectively. The third and final part provides a more general analysis of the policy-making process. Since the major achievements in the field of migration are recent, the book focuses to a great extent on the post-Amsterdam era. However, for reasons of coherence and in order to better evaluate recent developments, a concise overview of the origins of this policy is provided. Moreover, special emphasis is placed on the Schengen acquis, since its mark on European affairs has been and remains pronounced. Overall the attempt has been to provide an account, which is up to date with extensive historical references and combines both an academic and practical perspective to the legal and political issues involved. The approach based on the above elements will contribute to a new understanding of the main aspects of EU migration law and its policy ramifications andwill be of use to both academics and practitioners alike.

The ESCP would provide a procedure available in the courts of all Member States to deal with cross-border cases and simple enforcement across national boundaries. In its examination of the Regulation the Committee identifies three main difficulties: differences between the Commission and Member States, most importantly on costs; the need for the practicalities of the scheme to be given more attention; lack of clarity in some parts of the text of the Regulation.

Book excerpt: The draft Audiovisual Media Services (AMS) Directive, published in December 2005, was met with some alarm. It sought to extend the existing 'Television without Frontiers' Directive to new services which were seen to be competing for audience and revenue. In doing so it would have introduced inappropriate regulation on the new media sector. There have now been some changes to the original draft and a tightening of the definition of "television like" services. Although an improvement, the Committee is concerned that there is still not enough legal certainty. They are also worried about the need to defend the 'Country of Origin' approach to single market legislation and reject the idea that regulators should act to preserve the market dominance of existing players from new entrants. They are also unconvinced of the need for any quantitative restriction on advertising.

The Committee's report examines the European Commission's proposal to introduce a Regulation (the Clinical Trials Directive) on medicinal products for paediatric use which aims to stimulate the development of medicines for children and lay down rules for testing and approval. Issues discussed include: the need for better regulation of paediatric medicines; the ethical considerations involved in clinical trials on children, including the issue of consent; mechanisms for implementing the Regulation; access to the database of information on clinical trials; the rewards and incentives proposed to stimulate the research and development of medicines; and the legal basis for the regulation under the EC Treaty. The Committee's report recognises the urgent need for effective action at the European level to authorise medicines for paediatric use and gives broad support to the proposed Directive. However, a number of key issues are highlighted, including: the need for improved labelling of medicines; that the guidelines underpinning the Directive should take account of ethical considerations involved to ensure the rights and capacity of children to give informed consent to trials; and concerns are raised about the adequacy of proposed incentive mechanisms.
