This book was released on 2013-11-26 with total page 1821 pages. Available in PDF, EPUB and Kindle. Book excerpt: The major Commentary on the Treaty on European Union (TEU) is a European project that aims to contribute to the development of ever closer conceptual and dogmatic standpoints with regard to the creation of a “Europeanised research on Union law”. This publication in English contains detailed explanations, article by article, on all the provisions of the TEU as well as on several Protocols and Declarations, including the Protocols No 1, 2 and 30 and Declaration No 17, having steady regard to the application of Union law in the national legal orders and its interpretation by the Court of Justice of the EU. The authors of the Commentary are academics from ten European states and different legal fields, some from a constitutional law background, others experts in the field of international law and EU law professionals. This should lead to more unity in European law notwithstanding all the legitimate diversity. The different traditions of constitutional law are reflected and mentioned by name thus striving for a common framework for European constitutional law.

Book Nice Try

    Book Details:
  • Author : Richard E. Baldwin
  • Publisher : Centre for Economic Policy Research
  • Release : 2001
  • ISBN : 9781898128564
  • Pages : 166 pages

Download or read book Nice Try written by Richard E. Baldwin and published by Centre for Economic Policy Research. This book was released on 2001 with total page 166 pages. Available in PDF, EPUB and Kindle. Book excerpt: EU member nations must decide whether to ratify the Nice Treaty. This report, written to inform these decisions, is highly critical of the Treaty but argues that it should be passed since it is 'repairable' and rejecting it would delay Eastern enlargement. It proposes two 'emergency repairs' to the Treaty. The authors marshal the best available empirical evidence and analytic techniques to show that the Treaty fails to meet its goal of adjusting EU decision-making to the realities of a Union with 27& members. Far from maintaining the EU's ability to act after enlargement, the authors argue that the Nice reforms reduce EU27 decision-making efficiency below what it would have been with no reform. Unless the Treaty is mended, future integration will be guided by intergovernmental initiatives in which large members play a large role due to their economic dominance. The Treaty also fails to resolve the ECB's 'numbers problem' - enlargement without reform would also damage the ECB's decision-making capacity. The Treaty does include an 'enabling clause' to help solve this problem: the report analyses the possible solutions and proposes specific reforms.

Book European Governance After Nice

Download or read book European Governance After Nice written by Hiroyi Akiba and published by Routledge. This book was released on 2019-03-13 with total page 208 pages. Available in PDF, EPUB and Kindle. Book excerpt: What is the impact of institutional reform implemented by the Nice Treaty on European Governance? What should be done to enhance democratic legitimacy in the EU? This book provides an up-to-date guide to understanding the European Union as an institution. Globalisation has led to enormous changes in the international environment which, in turn, have demanded institutional reform of the European Union in the form of the Nice Treaty. European Governance After Nice scrutinises how, and to what extent, the treaty will contribute to the solution of existing problems, examining both its positive effects and its limitations and examines the reforms within the EU through political science, law and economics, in order to express the full extent of the different effects of the Nice Treaty on non-member as well as member countries. The contributors suggest that the threat of varying exchange rates in the future, when the Treaty has an expansionary effect on economic scale, will lead to a deepening interdependence between the excluded countries.

Book The Rise and Fall of the EU s Constitutional Treaty

Download or read book The Rise and Fall of the EU s Constitutional Treaty written by Finn Laursen and published by BRILL. This book was released on 2008-07-31 with total page 580 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book analyses the EU's Constitutional Treaty, which emerged in draft form from the European Convention in the summer of 2003 and which was finalised by an Intergovernmental Conference (IGC) in June 2004. It describes the main novelties of the treaty and looks at policies of important actors, Member States and Community actors (the Commission and European Parliament) and the roles played by the Convention and the Italian and Irish Presidencies during the process of deliberation and negotiation that produced the treaty. It further studies the failure of ratification in France and the Netherlands and the implications for the process of European integration of this failure. It finally touches on the question whether a constitutional equilibrium has been reached. Since the new Lisbon Treaty negotiated in 2007 contains much of what was in the Constitutional Treaty the analyses of the book remain pertinent for this latest EU treaty.
