The latest edition of the report by the European Commission for the Efficiency of Justice (CEPEJ), which evaluates the functioning of judicial systems of 44 Council of Europe member states as well as three observer states to the CEPEJ, Israel, Kazakhstan and Morocco , continues the process carried out since 2002, focusing the content of the report on the analysis of European trends. Book Efficiency and Bureaucratisation of Criminal Justice

Download or read book Efficiency and Bureaucratisation of Criminal Justice written by Ed Johnston and published by Taylor & Francis. This book was released on 2023-03-24 with total page 178 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book tackles the growing issues concerning the managerialism and bureacratisation of criminal justice systems across a number of jurisdictions. Here, managerialism means the move towards more standardised, bureaucratic and efficiency-driven systems, influenced by a desire to ensure predictability, control risks and, ultimately, economic savings via a more efficient process. The volume explores the phenomenon of managerialism in selected national criminal legal systems, covering all stages of criminal case processing from arrest to the imposition of sanction. The selected countries represent diverse socio-economic, political, cultural and legal traditions including common law, civil law, mixed common and civil law and post-Soviet tradition. The book engages with a variety of relevant theoretical concepts, such as fairness, rationality, efficiency and legitimacy. The authors critically examine whether and to what extent the trend towards managerialism is indeed discernible, and what are its likely effects in the given national criminal legal systems. The book will be of interest to students, researchers and practitioners working in the areas of comparative criminal justice and procedure.

Book The Faro Convention s role in a changing society

Download or read book The Faro Convention s role in a changing society written by Francesc Pla and published by Council of Europe. This book was released on 2022-01-05 with total page 96 pages. Available in PDF, EPUB and Kindle. Book excerpt: Council of Europe action in the field of cultural heritage targets promoting diversity and dialogue through access to heritage to foster a sense of identity, collective memory and mutual understanding within and between communities. The year 2021 marks the 10th anniversary of the entry into force of the Framework Convention on the Value of Cultural Heritage for Society, also known as the Faro Convention. The present publication shows that what emerged back in 2005 as a truly innovative approach is still relevant today and can also have an impact on issues beyond its traditional realm. This is illustrated through a set of articles that demonstrate the pertinence of the Faro Convention’s approach to cultural heritage in addressing different aspects, ranging from democratic participation to tourism rethinking. The wide range of topics addressed and the numerous possibilities described by the various contributors suggest that the next ten years of the Faro Convention will be as challenging and rewarding as the decade that has elapsed since its entry into force.

Book Goals of Civil Justice and Civil Procedure in Contemporary Judicial Systems

Download or read book Goals of Civil Justice and Civil Procedure in Contemporary Judicial Systems written by Alan Uzelac and published by Springer Science & Business Media. This book was released on 2014-01-11 with total page 262 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is a collection of papers that address a fundamental question: What is the role of civil justice and civil procedure in the various national traditions in the contemporary world? The book presents striking differences among a range of countries and legal traditions, but also points to common trends and open issues. It brings together prominent experts, professionals and scholars from both civil and common law jurisdictions. It represents all main legal traditions ranging from Europe (Germanic and Romanic countries, Scandinavia, ex-Socialist countries) and Russia to the Americas (North and South) and China (Mainland and Hong Kong). While addressing the main issue – the goals of civil justice – the book discusses the most topical concerns regarding the functioning and efficiency of national systems of civil justice. These include concerns such as finding the appropriate balance between accurate fact-finding and the right to a fair trial within a reasonable time, the processing of hard cases and the function of civil justice as a specific public service. In the mosaic of contrasts and oppositions special place is devoted to the continuing battle between the individualistic/liberal approach and the collectivist/paternalistic approach – the battle in which, seemingly, paternalistic tendencies regain momentum in a number of contemporary justice systems.

Book The Western Balkans and the EU

Download or read book The Western Balkans and the EU written by Morton Abramowitz and published by . This book was released on 2011 with total page 200 pages. Available in PDF, EPUB and Kindle. Book excerpt: Today, more than fifteen years after the end of the wars that accompanied Yugoslavia's dissolution, the "Balkan question" remains more than ever a "European question". In the eyes of many Europeans in the 1990s, Bosnia was the symbol of a collective failure, while Kosovo later became a catalyst for an emerging Common Foreign and Security Policy (CFSP). In the last decade, however, the overall thrust of the EU's Balkans policy has moved from an agenda dominated by security issues related to the war and its legacies to one focused on the perspective of the Western Balkan states' accession to the European Union. This Chaillot Paper, which features contributions from authors from various parts of the region, examines the current state of play in the countries of the Western Balkans with regard to EU accession. It brings together both views from the Balkans states themselves and overarching thematic perspectives. For the first time the European Union has become involved in the formation of new nation-states that also aspire to become members of the Union. The EU's transformative power has proved effective in integrating established states; now it is confronted with the challenge of integrating new and sometimes contested states. Against this background, this paper makes the case for a concerted regional approach to EU enlargement, and a renewed and sustained commitment to the European integration of the Western Balkans.
