Book excerpt: This book identifies and analyzes the legal nature of the network codes and framework guidelines concerning the European electricity market and assesses characteristics possibly impacting the status quo of the German electricity market design. At the core of this book stands a literature based discussion about possible impacts on the market design. On the evidence presented, it is concluded that the framework guidelines seem to have a genuine binding effect when setting the objectives and principles of the network codes. The network codes themselves draw their legally binding nature from their formal adoption by comitology and are applicable for matters of cross-border electricity grids and market integration. It is derived that if the network code regulations proved to be disadvantageous from Germany's perspective, the German government could to a certain extent influence the comitology procedure. The results of this study ought to be treated as tentative until the codes are further developed and refined. On the evidence presented, it is hypothesized that the impacts of the network codes and framework guidelines on the German electricity market design are limited.

Book excerpt: The technical and economic issues posed by the EU network codes (NCs) and guidelines (GLs) for electricity are manifold. In addition, NCs and GLs raise important and challenging legal issues. To gain a more comprehensive perspective on these regulations, it is important to understand not only their technicalities, but also the legal framework that has been created for their development, adoption, implementation, and amendment. This legal framework was first established in the Third Energy Package (hereafter 'third package') legislation, but has recently been amended under the Clean Energy Package (CEP). New measures affecting the creation and implementation of NCs and GLs, as well as the ever more important terms, conditions and methodologies (TCMs) entered into force in January 2020. Four guidelines and four network codes for electricity have already been adopted under the third package. We refer to these measures throughout this paper as the first generation of NCs and GLs. These codes are categorised into three types - network connection rules, system operation rules and market rules. The market rules which deal with capacity allocation, congestion management, and balancing have been adopted as guidelines, whereas the emergency and restoration protocols, provisions for demand connection, as well as the requirements for generators, are comprised within network codes.2 The goal of this text is to help a reader without detailed legal knowledge to understand some of the legal terms of the NCs and GLs, to consider: - The legal nature of NCs and GLs; - How various market players (stakeholders), as well as regulatory and governing authorities at national and European level are involved in the development and adoption processes of NCs and GLs; - Who can raise legal challenges during this process and on the content of the final text and on what grounds, and; - Who is involved in the implementation phase at both regional and national level.

More precisely, this text is intended to guide the reader through the sequence of electricity markets in place in the EU: forward markets, the day-ahead market, the intraday market and finally the balancing markets. First, the establishment of these different markets in a national context is discussed, then their integration. In each section basic market design concepts are explained, we highlight what is in the codes, and we also refer to some of the relevant academic literature.

Finally, the report also points out where provisions in the Recast of the Electricity Regulation, which is part of the Clean Energy Package, impact the existing network codes and guidelines.

Book excerpt: This paper aims at contributing to the further development of the governance structure of the internal energy market by evaluating the process of the development of network codes, that is, the technical rules governing access to - and functioning of the cross border electricity grid, against principles of good governance. It finds that the governance structure does not sufficiently ensure responsiveness to stakeholder input. This is due to a lack of legal accountability mechanisms, which are only insufficiently complemented by means of political- , social-, vertical administrative- and peer-accountability. Legal accountability mechanisms are insufficient to guarantee adequate responsiveness to stakeholder input, due to rigid standing criteria for direct actions at the European Court of Justice against network codes adopted as delegated acts by the Commission. Moreover, there is insufficient possibility of judicial review as regards the roles of various network members in the development of network codes, in particular regarding soft law instruments used by ACER and ENTSO-E. Hence, their factual influence on the technical rules adopted as network codes is not appropriately met by legal accountability mechanisms that would ensure their stakeholder responsiveness. While current means of political-, social-, vertical administrative- and peer-accountability may improve responsiveness to stakeholder input, a thorough analysis of the network code development process shows that they are too weak to meet a level as required by principles of good governance. This lack of accountability also leads to a lack of participation and openness. The paper argues that alternative accountability mechanisms need to be strengthened in a way that adapts the present system of accountability mechanisms to the flexible means of exercising authority through network governance. In particular, it advocates a greater role for stakeholder committees as well as ACER in the development of network codes.

Book excerpt: In May 2018, two years after the European Network Code Requirements for Generators (RfG NC) had been published, European Member States (MS) have been obliged to conclude the respective national implementations of their individual grid codes. Next to a set of binding grid connection requirements as so-called exhaustive requirements, fixed to all European member states, the RfG NC also introduced ranges on non-exhaustive requirements that had to be shaped by the member states in terms of their national implementations. Hence, in all over Europe, a full range of new grid codes is on stage, providing some challenges to all parties involved in the installation and operation of Power Generation Modules (PGMs), to manufacturers in terms of technology development and design of their equipment, to project developers in terms of electrical planning and grid code compliant commissioning processes and to system operators with respect to their newly defined obligations on ensuring grid code conformity. In addition to the national definition of non-exhaustive requirements, European MS also had to define three thresholds in terms of installed capacity of PGMs to be connected to the power grid in order to distinguish between four different type of PGMs (A, B, C and D). For each type, additional and different grid connection requirements will apply. Finally, in April 2019, the RfG NC entered into force - principally together with all national grid code implementations. However, delayed publication had to be encountered in some MS.

This paper aims to assess the availability of judicial review in the multi-stage procedure established by the Electricity and Gas Regulations. In this respect, it first provides a brief overview of the establishment of the European Networks of TSOs (ENTSOs), whose expertise serves as the basis for the elaboration of the network codes. Subsequently, it critically assesses the three-stage adoption procedure set in the Regulations. The analysis then shifts to a more normative dimension through the examination of the legal characterization of the basic acts involved in the adoption procedure, namely, the framework guidelines and network codes, and of the availability of judicial review.
