Among all sending countries of adoptees, S. Korea is actually the country where the practice of inter-country adoption had its genesis. The fundamental source of power which sustains inter-country adoption practices is, as Dr. Nigel Cantwell mentions in his endorsement, the pervasive “glowing image” of adoption. In other words, the dominant perception of adoption as salvation is a key obstacle which prevents a more accurate mapping of the reality of inter-country adoption. In her new book, Dr. Kyung-eun Lee wields international laws as her surgical blade in order to dissect the practice of inter-country adoption from S. Korea. She uncovers the fact that the S. Korean government and private adoption agencies as partners have made “orphans” systematically, widely, but ironically within legal boundaries. As a result, adoptees’ human rights have been violated on a massive scale. Dr. Lee points out the negligence of the international society which was aware of Korea’s failure in complying with the international legal system. She reminds the international community, especially those of the receiving countries, of their responsibility to demand that sending countries such as S. Korea enhance their legal systems in order to protect child rights. Growing requests from adult international adoptees to find their identities and information on their adoption reveals much evidence that adoptees’ rights were violated by the inter-country adoption system. Many countries have begun to investigate past abuses and malpractices within the adoption system, and are finding a way to recover adoptees’ rights from the unethical and illegal practices which have taken place in the past, and which are still inherent within the system. This book should serve as invaluable guidance to government officials, legal experts, researchers and adoption-related stakeholders who wish to transform the current global “orphan” adoption system into the alternative care system for the best interests of the child.

This FRA survey is the first of its kind on violence against women across the 28 Member States of the European Union (EU). Book excerpt: This book centres on Webcam Child Sex Tourism and the Sweetie Project initiated by the children’s rights organization Terre des Hommes in 2013 in response to the exponential increase of online child abuse. Webcam child sex tourism is a growing international problem, which not only encourages the abuse and sexual exploitation of children and provides easy access to child-abuse images, but which is also a crime involving a relatively low risk for offenders as live-streamed webcam performances leave few traces that law enforcement can use. Moreover, webcam child sex tourism often has a cross-border character, which leads to jurisdictional conflicts and makes it even harder to obtain evidence, launch investigations or prosecute suspects. Terre des Hommes set out to actively tackle webcam child sex tourism by employing a virtual 10-year old Philippine girl named Sweetie, a so-called chatbot, to identify offenders in chatrooms. Sweetie 1.0 could be deployed only if police officers participated in chats, and thus was limited in dealing with the large number of offenders. With this in mind, a more pro-active and preventive approach was adopted to tackle the issue. Sweetie 2.0 was developed with an automated chat function to track, identify and deter individuals using the internet to sexually abuse children. Using chatbots allows the monitoring of larger parts of the internet to locate and identify (potential) offenders, and to send them messages to warn of the legal consequences should they proceed further. But using artificial intelligence raises serious legal questions. For instance, is sexually interacting with a virtual child actually a criminal offence? How do rules of criminal procedure apply to Sweetie as investigative software? Does using Sweetie 2.0 constitute entrapment? This book, the outcome of a comparative law research initiative by Leiden University’s Center for Law and Digital Technologies (eLaw) and the Tilburg Institute for Law, Technology, and Society (TILT), addresses the application of substantive criminal law and criminal procedure to Sweetie 2.0 within various jurisdictions around the world. A stone when struck resists. If its resistance is greater than the force of the blow struck, it remains outwardly unchanged. Otherwise, it is shattered into smaller bits. Never does the stone attempt to react in such a way that it may maintain itself against the blow, much less so as to render the blow a contributing factor to its own continued action. While the living thing may easily be crushed by superior force, it none the less tries to turn the energies which act upon it into means of its own further existence. If it cannot do so, it does not just split into smaller pieces (at least in the higher forms of life), but loses its identity as a living thing. As long as it endures, it struggles to use surrounding energies in its own behalf. It uses light, air, moisture, and the material of soil. To say that it uses them is to say that it turns them into means of its own conservation. As long as it is growing, the energy it expends in thus turning the environment to account is more than compensated for by the return it gets: it grows. Understanding the word "control" in this sense, it may be said that a living being is one that subjugates and controls for its own continued activity the energies that would otherwise use it up. Life is a self-renewing process through action upon the environment.

Book excerpt: In the past decades, the European Union has made little progress with respect to disqualifications as a sanction mechanism for the violation of laws. The creation of some form of harmonization is necessary, but the complex nature of this specific sanction mechanism has caused policy initiatives to be postponed, time after time. In answer to a call from the European Commission, the contributors in this book have conducted a comparative legal analysis in the EU 27 and looked into the practical experiences with disqualifications from a domestic and a cross border perspective. To that end, academics, policy makers, and practitioners in the Member States have been consulted. Analysis reveals a wide variety in the typology of the disqualifications as a sanction measure, the typology of the persons to whom the disqualifications can be imposed, and the typology of the authorities involved. Furthermore, there are considerable differences with respect to the inclusion of disqualifications in the national criminal records databases. Linked thereto information on foreign disqualifications is scarce and rarely used in practice. To ensure a comprehensive and consistent policy approach, this book has come up with a so called disqualification triad, comprising: (1) unified EU-wide disqualifications, (2) mutual recognition of disqualifications, and (3) EU-wide equivalent effect of disqualifications. The functioning of the disqualification triad has been further elaborated on in three case studies, which are public procurement disqualifications, disqualifications from working with children, and driving disqualifications.
