In recent years, several requests have been made by citizens and associations to political decision-makers regarding the need for a significant improvement in waste management methods. Particularly considering the significant increase in awareness of social and environmental impacts and the economic consequences of non-virtuous waste management. There is growing attention on legislation and regulation's role in the waste sector. Regulation can help companies and citizens achieve a faster, more effective, and more efficient transition from a linear economy, based on the take-make-dispose paradigm, to a circular economy, in which the potential of waste as resources and secondary raw materials is exploited. This book is set in the wake of economic literature that tackles the transition from the linear to the circular economy. It focuses on the downstream stages of the waste management process (i.e. the waste treatment phase). In this regard, it is proposed a journey through the history of European waste legislation to study the waste sector's transition dynamics from a selfish and no longer sustainable economic model based on rampant consumerism to a far-sighted sustainable model addressing the well-being of future generations. Studying the changes in European waste regulations leads us to ask ourselves the following questions: how has waste collection changed in recent years? What are the new regulatory challenges that must be addressed to achieve the objectives of a circular economy? How successful has the EU legislation been in fostering the transition from a linear to a circular economy? Finally, has the European environmental legislation sprung a convergence process among European countries towards the circular economy, or has the definition of targets fuelled the already marked differences between EU countries?

The question of which treatment technique to adopt is essentially a downstream problem. In our view the issue needed to be tackled further upstream. Waste management is not only a technical problem, it is also an area which involves various actors throughout society. In this book, as in the previous volume (Buclet, Godard, 2000), the organisation of waste management is seen in terms of regimes. A regime is an entire form ofinstitutional, technical, economic and social organisation relating to a specific field, no matter how complex that field is. Regime formation is generally a long-drawn-out process, rooted in the multiple interactions of the actors involved. Legislation plays a crucial role but would not, of itself, lead to the formation of a regime. There is always the old question of causality and which element occurs first: the behaviour of actors who constitute the reality, or the legislation that models their behaviour? Besides legislation, other formal or informal conventions influence the behaviour of actors approaching a common path, making co ordination easier between them. In this book we have insisted on conventional principles. They are the real guides for actors within each national regime.

Book excerpt: The European Commission's Strategy on the Prevention and Recycling of Waste outlines why life cycle thinking is essential in the move towards more sustainable consumption and production. The importance of life cycle thinking is further highlighted in the Commission's complimentary Strategy on the Sustainable Use of Natural Resources, in its Integrated Product Policy, as well as in the proposed revisions to the European Waste Framework Directive and the up-coming Sustainable Consumption and Production Action Plan. In 2004, following its international workshop and conference on life cycle assessment and waste management, the Institute for Environment and Sustainability (IES) of the European Commission's Joint Research Centre (JRC) launched a series of regional pilot case studies in collaboration with representatives of the European Union's new member states, acceding countries, and associated countries. The representatives selected, and provided, statistical data for nine waste management regions. The life cycle assessments took into account the situation around 2003 in each region and example management scenarios that achieve Directive compliance and beyond (ref. Koneczny K., Dragusanu V., Bersani R., Pennington D.W. Environmental Assessment of Municipal Waste Management Scenarios: Part I - Data collection and preliminary environmental assessments for life cycle thinking pilot studies, European Commission, JRC-IES, 2007). This report, based on a study carried out on behalf of the JRC by 2.-0 LCA Consultants, considers in further detail the waste management options for the island nation of Malta and the central European city of Krakow, Poland. The life cycle assessments use more robust data, apply cutting edge methodologies, and take into account the waste management costs. The resultant life cycle impact indicators provide a basis to compare the emissions and resources consumed attributable to each waste management option in terms of their contributions to e.g. different environment and human health burdens. One of the methods furthermore highlights how some of the trade-offs between environment, health, and the waste management costs might be partially considered in a single life cycle based cost-benefit framework, as a support to other decision-making information.
