It is called "The Singer" for the eerie tone it emits. An artificial intelligence built eons ago, it may ultimately solve the mystery of the vanished alien races responsible for the birth and development of humanity. But after decades of war, the hostile nations of Earth care more for power than for knowledge. And now all that stands between the coveted Al and an all-out Chinese assault is a vastly outnumbered contingent of U.S. marines, dug in beneath the baleful red eye of Jupiter. As terrifying events light years distant begin to converge---with confrontation imminent and annihilation inevitable---a secret history of creation and doom must at long last be contended with...if humankind is to finally claim its glorious heritage among the stars.2040: Ruins of ancient civilization uncovered on Mars reveal startling truths about the creation of humankind. 2042: In the gray dust of the Earth's Moon, an extinct enslaving race left behind more answers, more questions...and a grim warning. 2067: As Earth's warring factions clash in space for scraps of alien technology, a strange artifact lies trapped beneath the ice-locked oceans of Europa: a machine that holds the key to the final human destiny. Book The Right to Strike in International Law

Download or read book The Right to Strike in International Law written by Jeffrey Vogt and published by Bloomsbury Publishing. This book was released on 2020-03-19 with total page 219 pages. Available in PDF, EPUB and Kindle. Book excerpt: This monograph was originally developed as a direct response to the claim made by members of the 'Employers Group' at the 2012 International Labour Conference, namely that the right to strike is not protected in international law, and in particular by ILO Convention 87 on the right to freedom of association. The group's apparent aim was to sow sufficient doubt as to the existence of an internationally protected right so that governments might seek to limit or prohibit the right to strike at the national level while still claiming compliance with their international obligations. In consequence, some governments have seized on the employers' arguments to justify new limitations on that right. The Right to Strike in International Law not merely refutes this claim but is the only complete and exhaustive analysis on this subject. Based on deep legal research, it finds that there is simply no credible basis for the claim that the right to strike does not enjoy the protection of international law; indeed, the authors demonstrate that it has attained the status of customary international law.

Book Judicial Authority in EU Internal Market Law

Download or read book Judicial Authority in EU Internal Market Law written by Vilija Velyvyte and published by Bloomsbury Publishing. This book was released on 2022-11-17 with total page 309 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines the role of the European Court of Justice in the regulation of the internal market from a competence perspective. However, rather than focusing on the Court's role in enforcing the limits of EU competence in the EU's political decision making, it explores a related, albeit understudied, question: to what extent does the Court observe the constitutional limits of EU competence and its own institutional powers in the interpretation of EU internal market law laid down in the Treaties? The book provides an answer to this question through the analysis of EU free movement case law in light of the constitutional principles that govern the allocation of competences and powers in the EU: conferral, subsidiarity and proportionality, on the vertical level, and institutional balance, on the horizontal level. Why should the Court be bound by these principles? What do they mean when applied to judicial practice? To what extent are they observed in the free movement case law? The book argues that the Court's observance of the four principles has been inconsistent, thereby creating substantive and constitutional tensions in the EU's relationship with the Member States and upsetting the institutional balance of powers between the EU legislature and judiciary. Available in PDF, EPUB and Kindle. Book excerpt: EU Law in the Member States is a new series dedicated to exploring the impact of landmark CJEU judgments and secondary legislation in legal systems across the European Union. Each book will be written by a team of generalist EU lawyers and experts in the relevant field, bringing together perspectives from a wide range of different Member States in order to compare and analyse the effect of EU law on domestic legal systems and practice. The first volume focuses on the uneasy relationship between the economic freedoms enshrined in Articles 49 and 56 TFEU and the right of workers to take collective action. This conflict has been at the forefront of EU labour law since the CJEU's much-discussed decisions in C-438/05 Viking and C-341/05 Laval, as well as the Commission's more recent attempts at legislative reforms in the failed Monti II Regulation. Viking, Laval and Beyond explores judicial and legislative responses to these measures in 10 Member States, and finds that the impact on domestic legal systems has been much more varied than traditional accounts of EU law would suggest.

Book Cambridge Yearbook of European Legal Studies Vol 10 2007 2008

Download or read book Cambridge Yearbook of European Legal Studies Vol 10 2007 2008 written by Catherine Barnard and published by Bloomsbury Publishing. This book was released on 2008-12-18 with total page 698 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Cambridge Yearbook of European Legal Studies provides a forum for the scrutiny of significant issues in European Union Law, the Law of the Council of Europe, and Comparative Law with a 'European' dimension, particularly those issues which have come to the fore during the year preceding publication. The chapters presented are all at the cutting edge of the fields which they address, and reflect the views of recognised experts drawn from the University world, legal practice, and the civil services of both the EU and its Member States. Inclusion of the comparative dimension brings a fresh perspective to the study of European law, and highlights the effects of globalisation of the law more generally, and the resulting cross fertilisation of norms and ideas that has occurred among previously sovereign and separate legal orders. The Cambridge Yearbook of European Legal Studies is an invaluable resource for those wishing to keep pace with legal developments in the fast moving world of European integration. Book The Lisbon Treaty and Social Europe

Download or read book The Lisbon Treaty and Social Europe written by Niklas Bruun and published by Bloomsbury Publishing. This book was released on 2012-05-08 with total page 348 pages. Available in PDF, EPUB and Kindle. Book excerpt: On 1 December 2009 the Treaty of Lisbon entered into force. Although often described as primarily technical, it significantly amended the Treaty on the European Union (TEU) and the old EC Treaty (now the Treaty on the Functioning of the European Union, TFEU). The authors' aim in this book is to explore what the Treaty means for social law and social policy at the European level. The first part of the book on the general framework looks - at a time of financial crisis - for new foundations for Europe's Social market economy, questions the balance between fundamental social rights and economic freedoms, analyses the role of the now binding Charter of Fundamental Rights, maps the potential impact of the horizontal clauses on social policy and addresses the possibilities for social partners to enlarge their role in labour law and industrial relations. The second part, on the social framework of the Treaty, focuses on the development of the Union's competences. In it the authors evaluate the consequences of the new general framework on social competences, analyse the evolution of the principle of subsidiarity and its impact in the new Treaty, look at the coordination of economic policies in the light of fundamental rights, and analyse the adoption in the Treaty of a new architecture for services of general interest.
