Book excerpt: The European Union adopted a Roaming Regulation (717/2007) in 2007, then extended its duration and widened its scope (544/2009) in 2009. In 2006, the European Commission held two consultations on a possible regulation. It made a formal legislative proposal in July 2006, to implement wholesale and retail price caps, plus price transparency measures. This was debated and then adopted, with changes, by the European Parliament and Council of Ministers. After a long debate, retail price caps were accepted. The price controls began from autumn 2007. In 2008, the European Commission began a review of the Regulation. It concluded it required to be extended until 2012. It also proposed adding retail and wholesale price caps on SMS prices and a wholesale cap on data prices. To stop future bill shocks, it imposed a spending limit, requiring customers to be warned and to be asked to confirm they wished to continue spending. The European Parliament and Council of Ministers adopted this measure, with new prices cap taking effect in July 2009. The EC is currently reviewing the effectiveness of the amended Regulation.

Book excerpt: This paper reviews the regulation of intra-EU international roaming services, based on available empirical evidence from the comprehensive BEREC reports on roaming, as well as other data sources such as the European Commission, the OECD, and European NRAs. The intra-EU international roaming market is rather large (4% of total mobile revenues) when compared to roaming markets in other regions (1-2% of mobile revenues), and it is dominated in terms of revenues by voice roaming services (around 70% of total roaming revenues). EU initiatives to regulate international roaming have evolved toward increasingly regulatory activity applied through a system based on maximum price caps. Today, intra-EU price caps are applied to retail and wholesale roaming voice; retail and wholesale roaming SMS; and wholesale data roaming. Intra-EU voice and SMS roaming prices have suffered a steep decline from 2007 to 2010, following the glidepath set by regulation. There has been little evidence of genuine market-based competition, and prices have stayed close to the caps, despite the generous retail margins. Intra-EU data roaming services have experience a relevant decrease in both wholesale charges and retail prices, in line with the natural dynamics of an emergent market segment, but prices, especially at retail level, are still high compared to the underlying costs and to the equivalent domestic tariffs. The dynamics of retail international roaming prices are largely explained by lack of competitive pressure in retail roaming markets, and inelastic demand. Wholesale roaming markets are more complex to analyze, due to internalization of traffic by large groups, and reciprocal agreements with a relevant share of balanced traffic. The analysis of intra-EU wholesale and retail roaming data shows that in international roaming markets wholesale charge reductions are not necessary passed to retail prices. Thus a consistent combination of wholesale and retail international roaming regulation is necessary to ensure that benefits are passed to end users. Some of the international roaming measures enforced within the EU could be also applied in other countries or regions, such as for instance the data roaming cut-off limit to prevent bill shock. Further regulatory action is possible through reciprocal agreements between countries to regulate wholesale and retail roaming prices. Such agreements are especially encouraged between countries that have similar retail and wholesale structures in the international roaming market, and a shared political view to strengthen economic, social, and cultural ties.

It is a key foundation of the EU's Digital Single Market, and a major step in building an accessible, sustainable digital society for all citizens. After many years of work, on 15 June 2017, the EU achieved the objective that mobile roaming charges for calling, sending text messages and mobile internet no longer applied when citizens use their mobile phone in another EU country and the EEA (European Economic Area - Iceland, Liechtenstein and Norway). Since that date, citizens are able to make use of these mobile services for the same price that they would pay if they were at home. On 1 July 2022, the new improved roaming regulation entered into force, extending 'roam-like-at-home' until 2032. The new rules also improve transparency on access to emergency services as well as services that may be subject to extra charges. Finally, the new rules will bring about significant benefits for EU citizens, who will enjoy a better roaming experience, with the same quality of mobile service abroad as they have at home. This Flash Eurobarometer was commissioned by the European Commission, Directorate-General for Communications Networks, Content and Technology to measure, several years after the abolition of roaming charges, EU citizens' perception of roaming rules as well as EU citizens' mobile use when travelling within the EU or EEA. In each of the 27 EU Member States, Ipsos European Public Affairs interviewed a representative sample of residents, aged 16 and over, who had travelled to another country in the EU or EEA (Iceland, Liechtenstein or Norway) in the past two years and who are able to call, text and/or use mobile internet on their mobile phone when travelling in the EU. Between 27 February and 3 March 2023, 5 271 interviews were conducted via mobile phone telephones. Survey data are weighted to known population proportions. The EU27 averages are weighted according to the estimated size of the 16+ target population of each EU Member State. A technical note on the methods applied to conduct the survey is appended as an annex to this report.

The European Commission's interim report on the second Roaming Regulation (544 2009) found widespread compliance by operators, but prices at or just under the mandatory ceilings. The EC's Digital Agenda sets a goal of finding a robust solution for roaming by 2012 and has performance indicators of bringing roaming prices down from their present level to national prices levels by 2015.

Book excerpt: The European Commission (EC) draft Regulation (2016)2 on wholesale roaming market proposes a massive decrease of the regulated roaming wholesale price caps for data with a drop from €5ct/MB to €0.85 ct/MB to enable the abolition of retail roaming surcharges in Europe by 15 June 2017. However, according to both the "TSM" Regulation text (2015/2120 25th November 2015) itself which imposes the implementation of Roaming Like At Home (RLAH) in Europe and to the decision of the European Court of Justice upholding the first European roaming regulation (ECJ C-58/08 8 June 2010), a wholesale roaming regulation can be justified in parallel of retail regulation only in case of market failure in the wholesale market and in order to prevent the existence of competitive distortions between mobile operators on the internal market. Therefore, wholesale roaming markets regulation should only address identified competitiveness issues. This paper deals with the question of the competitiveness of the wholesale roaming market regarding two angles: the existence of competitive mechanisms and incentives in wholesale roaming markets and the average level of wholesale roaming market prices in comparison with the corresponding level of full production costs. It shows that wholesale roaming markets exhibit competition mechanisms and incentives triggered by roaming volume growth resulting from the perspective of RLAH retail regulation. It also shows that in 2015, the average level of wholesale roaming market prices in Europe is equivalent to the average level of wholesale roaming production costs. Therefore the wholesale roaming market is competitive. Strong regulatory intervention such as large decrease of wholesale roaming caps is neither justified nor proportionate, generates serious risk of distortion of visited markets and jeopardises investments in mobile networks.

Book excerpt: European roaming rates are not set by market forces because when a competitive market did not evolve in Europe, European legislators stepped in to set rates by legislative fiat. This paper argues that legislators' tendency to set rates cautiously led to high wholesale prices that undermined smaller operators' ability to put roaming-free offers into the market. Operators with larger footprints are less constrained by wholesale pricing since more roaming traffic is kept on-net. In this context, the outright abolition of retail roaming charges without wholesale backstops bestows a competitive advantage on larger operators. The paper notes the experience of the US where roaming persists for all operators but retail customers can avoid roaming charges subject to significant cut off limits. The effective wholesale roaming rate in the US is estimated at just above 1 eurocent per minute for voice while rates are observable for national roaming in Europe of 1 eurocent for voice, and 0.2 eurocent for data and 0.2 eurocent for SMS events. It is proposed that such rates would be appropriate for wholesale roaming in Europe and that these rates would facilitate pan-EU retail offers such as those observable in the US. Unlike the US, European operators charge each other termination rates to carry calls from other networks. This creates another barrier to pan-EU retail offers and creates tensions (and transfers) from low cost termination markets to high cost termination markets. This inconsistency of approach must be addressed if the elimination of intra-EU roaming is to be possible. It is suggested that low but consistent termination rates would be required to go with the low wholesale roaming rates and that these rates would need the speed and consistency of application delivered through a Regulation. The extension of retail caps to international calls and SMS is unwarranted and may have adverse effects on network valuation. Such a major policy initiative would benefit from a public consultation.
