Book excerpt: Since the Czech Republic joined the European Union, most of its environmental legislation is adopted through the EU policy process. However, environmental protection in the Czech Republic is undermined by the relatively high implementation deficit of EU environmental legislation. This publication aims to identify the reasons for this deficit, i.e. barriers to effective implementation of environmental directives adopted by the EU after 1 May 2004. Through qualitative interviews with officials from Prague and Brussels, including two former Czech Ministers of Environment, the author identifies two narratives of non-compliance specific for the Czech Republic and two narratives embedded in the EU system of administration. The publication concludes with recommendations on how to dismantle these barriers. The findings are relevant not only for decision-makers in Brussels and in Prague, but also for civil servants and politicians in other EU countries, especially from the 'new member states' from Central and Eastern Europe. It might prove useful also to scholars dealing with implementation deficit in other countries and other policy areas.

Book excerpt: EU environmental legislation in the Czech Republic suffers from a relatively high post-accession non-compliance. This implementation deficit poses a serious threat to the environment, because ca 80 % of all environmental legislation applicable in the Czech Republic is now adopted through the EU policy process. Hence this thesis aims to identify horizontal barriers to effective implementation of environmental directives adopted by the European Union after 1 May 2004, relevant for the Czech Republic. The term effective implementation refers to the degree to which both legal and practical implementation correspond with the objectives defined in the directives. Through 16 qualitative interviews with officials from Prague and Brussels, including two former Czech Ministers of Environment, I identify two narratives of non-compliance specific for the Czech Republic and two narratives embedded in the EU system of administration. The former cover resistance of many Czech politicians to environmental legislation as well as to any EU initiatives, and poor quality of the Czech civil service. The latter are poor quality of some directives and limited impact of infringement procedures. None of the narratives alone can explain non-compliance, but the combination of the four seems to cover all the major barriers. Based on the analysis, I offer recommendations to decision-makers who want to reduce these barriers. In particular, I advise the Commission to make better use of interim measures and linkages with structural funding, and Czech decision-makers to finally allow the civil service act to become effective and to use more performance-based remuneration in public administration.

Book excerpt: A study of the effect of EU membership on Central and Eastern European environmental policy and the interplay of political incentives and industry behavior that determines policy In Transnational Politics of the Environment, Liliana Andonova examines the effect of the Europen Union (EU) on the environmental policies of Bulgaria, the Czech Republic, and Poland. Compliance with EU environmental regulations is especially onerous for Central and Eastern European countries because of the costs involved and the legacy of pollution from communist-era industries. But Andonova argues that EU integration has a positive impact on environmental policies in these countries by exerting a strong influence on the environmental interests of regulated industries. With her empirical study of chemical safety and air pollution policies from 1990 to 2000, she shows that export-competitive industries such as the chemical industry that would benefit from economic integration have an incentive to adopt EU norms. By contrast, industries such as electric utilities that primarily serve the domestic market remain opposed to EU environmental standards and must be prodded by their own governments to implement environmental-protection measures. These differences in domestic interests greatly influence the course of reforms and the adoption of EU standards. Transnational Politics of the Environment challenges the current focus on intergovernmental cooperation between East and West by highlighting the roles of industries, transnational norms, and domestic institutions in promoting change in environmental regulation. It offers a generalizable framework for understanding the politics of environmental regulation in emerging market economies, and helps bridge the divide between the study of domestic and international environmental politics.

Book excerpt: This report examines the implications for Poland of complying with the European Union's environmental directives. It starts by discussing the importance of establishing efficient institutions to set policies, enforce legislation and monitor results. Improving institutional capacity will not be financially costly, but will require significant investments of effort and time. The report then assesses the likely effect of EU directives on the private sector, concluding that, with certain exceptions, the directives should not affect the competitiveness of Polish industry. The third section discusses the costs of the public investment program mandated by EU rules. It estimates that public investment of between US$ 22 billion and US$ 43 billion will be required, depending on how directives are interpreted in Poland. If operations and maintenance costs are included and the investment costs spread over the life of the investments, the total annualized costs come to US$ 120 to US$ 270 per person per year for twenty years. The report highlights the substantial cost implications of different interpretations of the directives and also outlines ways in which Poland might phase the investments for greatest local benefit. The fourth chapter addresses options for financing this investment, including making best use of EU grant financing for environment. The report finds that price rises should be manageable for households if the investments are phased in over a long compliance period and if investments are interpreted flexibly.

In many cases these regions contain habitats and landscapes of international importance; they have also often escaped some of the environmental damage caused by industrialization. But, as the papers' reveal, attempts by the EU to safeguard these environmental benefits are often contradicted by the EU’s own development policies, bringing air pollution from new roads, contamination from new industries, and leading to habitat destruction from modern agricultural practices and increases in tourism. As the Union pushes for the deepening of the integration process, including completing the internal market, the pressures on the periphery's environment are increasing. Furthermore, the efforts of the periphery to catch-up economically with the developed core can often heighten the tension between economic considerations on the one hand and the need for environmental protection on the other. The studies in this book examine the ambivalent responses to EU environmental policy among policy-makers and environmentalists in the periphery.
