In addition to requiring countries to be ready to join the European Union, the EU has also set new conditions in an effort to become the prime international organization involved in stabilizing the Western Balkans after the wars of the 1990s. Its record has been mixed: the conditions of the EU have often been haphazard and were frequently not followed through. In addition, enlargement towards the Western Balkans has been slow and marred by open questions over the stability of some countries in the region. This volume assesses the EU's struggle to transform the societies through conditionality and whether the offer of EU membership is enough to build stable democracies. This book analyses the European Union's policies towards, and the impact they have, upon the states of the Western Balkans, and assesses how these affect the nature of EU foreign policy. To this end, it focuses on the tools and mechanisms that the EU employs in its enlargement policy and examines the new instruments of direct intervention (in Bosnia and Kosovo), political coercion (in the case of Croatia and Serbia in relation to the International Criminal Tribunal for the former Yugoslavia), and stricter conditionality in the Western Balkan countries. The book discusses the key aim of this special form of statebuilding, which is to establish functional liberal-democratic states in Albania, Bosnia and Herzegovina, Croatia, Kosovo, Macedonia, Montenegro, and Serbia in order for them to join the EU and to cope with the responsibilities and pressures of membership in the future. However, the authors argue that while the EU sees itself as an international actor that promotes and protects liberal-democratic values, norms and principles, its experiences in the Western Balkans demonstrate how the EU ́s actions in the region have undermined the basic principles of democratic decision-making (such as the European support for impositions in Bosnia) and international law (Kosovo), and have consequently contributed to new tensions (see police reform in Bosnia, and the tensions between Kosovo and Serbia) and dependencies. This book will be of much interest to students of statebuilding, EU politics, global governance and IR/Security Studies in general.

Where, in the 1990s, the EU stood by and watched the Balkans burn, it was the US, within NATO, that acted decisively to stop the wars. In the aftermath of the Kosovo crisis, the Union finally found its voice to say no to new armed conflict in the heart of Europe. As part of the international presence in the region, the EU adopted sanctions, brokered political agreements, launched its first-ever police and military missions and directed economic, legal and administrative reforms to eradicate the roots of instability. Yet, despite the comprehensive nature of the Union’s actions, its strategies have been marked by confusion, its actions by concurrent or competing mandates of other international organisations. As the Western Balkans still contain the possibility of a genuine security threat, there is a real imperative to move the region as a whole from the stage of international protectorates and weak states to the stage of accession to the euro-Atlantic organisations to which they aspire. The author argues that, under the leadership of the European Union, only a ‘tough love’ strategy, based on a firm but fair application of the conditionality principle, can lead to the integration of the Western Balkans into the European mainstream. Book excerpt: This paper examines the EU's external power through the prism of perceptions by non-EU countries, as shown in the case of this paper in the Western Balkans. The paper argues that the EU's policy in the Western Balkans lacks a strong normative justification, which affects the degree of compliance with the EU's demands in areas related to state sovereignty. The perceived lack of legitimacy opens up political space for domestic actors to contest the positions taken by the EU on normative grounds. The Western Balkan countries have responded by giving preference to internal sources of legitimacy and asserting domestic reasons for fake compliance, partial compliance or non-compliance with the EU's conditions, with the latter provoking imposed compliance. The EU's transformative leverage in the region has been much weaker to date in comparison with that in Central and Eastern Europe prior to EU accession. The paper also makes the case for widening the debate about EU foreign policy to include contributions that focus on the external impact of the EU's actions. It links the study of EU foreign policy to the literature on Europeanisation that developed in the context of the EU's enlargement to Central and Eastern Europe.

During the compliance monitoring process related to the effective rule of law and democracy the EU Commission tests and criticizes the effectiveness of the judiciary and strengthens the rule of law in preparation for accession. In the Western Balkans this was a process fraught with difficulties. Despite the fact that academic scholarship and democratic politics agree on rule of law as a legitimizing principle for the exercise of state authority, there is no uniform European standard for institution-building or monitoring activities by the EU in this area. With focus on the reform of the judiciary in five case study countries of Bosnia and Herzegovina, Kosovo, Macedonia, Montenegro, and Serbia, this empirical research investigates the EU's transformative power with regard to the effectiveness of rule of law and judicial sector reform in its infancy. It analyses the depth and limitations of EU rule of law promotion in the Western Balkans and presents policy recommendations intended to address the shortcomings in judiciary reform. This book aims to fill the gap in the existing academic scholarship of EU politics, law and Western Balkans literature.
