Book excerpt: D'intérêt majeur pour la pratique et pour le juge en particulier, d'intérêt mineur pour la doctrine et la recherche juridique tant le sujet semble épuisé en droit interne, l'interprétation des contrats est plus que tout au centre de l'office du juge ; elle est même son quotidien tant aujourd'hui les figures contractuelles sont devenues complexes. Il était dès lors, procédant d'une analyse des textes érigeant les axes de l'interprétation des contrats, et des découpages traditionnels entre interprétation subjective et objective, ambiguïté et comblements des lacunes, particulièrement opportun d'envisager l'interprétation sous le prisme du juge qui en est l'acteur. L'étude comparative conduit tout d'abord à analyser les règles d'interprétation des différents modèles de Civil Law d'un côté, de Common Law de l'autre, en procédant à une étude critique des règles et découpages traditionnels de l'interprétation, qu'il s'agisse des directives ou de ce qu'il convient d'appeler l'interprétation " créatrice ", pour promouvoir une méthode globale et contextuelle, révélant un premier rôle constructif du juge dans l'interprétation, et abandonner les standards de bonne foi et d'équité, concepts complétifs mais non interprétatifs. Puis, il s'est agi au-delà des schémas existants, de dresser des parallèles quant à l'attitude des juges dans l'interprétation et de révéler, aux confins de celle-ci et de la détermination du contenu du contrat, les véritables outils émergents de la comparaison tels l'obligation fondamentale, l'économie du contrat ou le raisonnable dans la recherche commune de l'efficacité et de l'équilibre contractuels. Un second rôle constitutif du juge dans l'interprétation est alors observé. Sur la base de ces éléments, l'auteur ne pouvait manquer de s'interroger, toujours en comparant, sur le rôle des cours suprêmes et sur l'intérêt de ce renouveau pour la qualification et le contrôle classique de l'interprétation en montrant que l'objectivation des outils de détermination des contrats a pour effet, au-delà de la distinction du fait et du droit propre à certains systèmes, un contrôle plus poussé des juridictions suprêmes sur l'interprétation des contrats conférant plus de sécurité et d'efficacité juridique en la matière. Ce travail comparatiste permet donc, en contemplation du rôle constructif et constitutif du juge, de faire émerger des principes directeurs de l'interprétation des contrats sources de réflexion en vue des réformes de droit interne et de la construction du droit européen, voire du droit international des contrats.

Le juge est chargé non seulement d’analyser et de déterminer les éléments factuels, mais il a aussi, pour objectif, d’exercer la qualification du fait et d’appliquer les règles de droit. C’est la raison pour laquelle l’interprétation juridique est en générale divisée en deux aspects : l’interprétation du fait et celle du droit (ou de la loi). L’interprétation du contrat participe, en principe, au premier aspect. Précisément, la loi, en tant que règle générale et abstraite, est l’expression de la volonté générale, alors que le contrat n’est que la traduction de plusieurs volontés particulières. Le projet de cette thèse cherche à analyser les problématiques provoquées par la théorie et la pratique de l’interprétation du contrat : dans quelle condition le juge peut-il exercer son pouvoir d’interprétation du contrat ? Interpréter un contrat, c’est interpréter la commune intention des parties ou plutôt interpréter un rapport contractuel intégré dans la vie sociale et économique ? L’interprétation du contrat peut-elle combler les lacunes du contrat ? Les règles d’ordre public peuvent-elles devenir le fondement de l’interprétation du contrat ? La correction du contenu du contrat a-t-elle besoin de participation de l’interprétation du contrat ? La recherche des problématiques exposées ci-dessus détermine, en effet, l’intérêt du projet de cette thèse. Théoriquement, le travail de thèse défie la définition traditionnelle de l’interprétation du contrat, en glosant de nouveau sur le sens et l’esprit des règles classiques d’interprétation, et en analysant le rôle des règles d’ordre public dans l’interprétation du contrat. Pratiquement, le travail de thèse se fonde sur une recherche approfondie des fonctions de l’interprétation du contrat dans les activités judiciaires.

La jurisprudence s'inscrit dans cet ordre juridique qui gouverne le contrat. Étant donné que le contrat n'est pas toujours efficace et que les règles qui le régissent, une fois codifiées restent immuables, l'intervention du juge est nécessaire à cet effet afin de garantir l'efficacité de celui-ci. Cette garantie d'efficacité se mesure par rapport à l'effectivité des stipulations contractuelles ainsi qu'aux règles applicables au contrat. Ainsi, pour assurer l'efficacité du contrat, le juge va dans un temps reconstituer a posteriori le contenu contractuel lorsque celui-ci se révèle incomplet, bouleversé, ou lorsque le contrat contient des clauses abusives. Dans un second temps, il intervient dans le silence du législateur pour réadapter les règles applicables au contrat qui sont demeurées inadaptées, soit en les interprétant ou en les complétant, soit en créant de nouvelles règles dans les cas où la loi n'a rien prévu.

The results of this work were sent to the European Commission and have already been published in French. The English translation is now being published by sellier.elp. This work could contribute to the wider European project. The part on the guiding principles could be a component of the CFR, in the form of "black letter" model rules or recitals. The part on terminology is, in itself, useful for the elaboration of the final various linguistic versions of the CFR. It finds its place within the materials which will accompany the model rules. Last but by no means least, the revised version of the PECL should be considered by the European institutions as an alternative set of model rules on contract law.

In this classic of French cultural studies, Georges Didi-Huberman traces the intimate and reciprocal relationship between the disciplines of psychiatry and photography in the late nineteenth century. Focusing on the immense photographic output of the Salpetriere hospital, the notorious Parisian asylum for insane and incurable women, Didi-Huberman shows the crucial role played by photography in the invention of the category of hysteria. Under the direction of the medical teacher and clinician Jean-Martin Charcot, the inmates of Salpetriere identified as hysterics were methodically photographed, providing skeptical colleagues with visual proof of hysteria's specific form. These images, many of which appear in this book, provided the materials for the multivolume album Iconographie photographique de la Salpetriere. As Didi-Huberman shows, these photographs were far from simply objective documentation. The subjects were required to portray their hysterical "type"—they performed their own hysteria. Bribed by the special status they enjoyed in the purgatory of experimentation and threatened with transfer back to the inferno of the incurables, the women patiently posed for the photographs and submitted to presentations of hysterical attacks before the crowds that gathered for Charcot's "Tuesday Lectures." Charcot did not stop at voyeuristic observation. Through techniques such as hypnosis, electroshock therapy, and genital manipulation, he instigated the hysterical symptoms in his patients, eventually giving rise to hatred and resistance on their part. Didi-Huberman follows this path from complicity to antipathy in one of Charcot's favorite "cases," that of Augustine, whose image crops up again and again in the Iconographie. Augustine's virtuosic performance of hysteria ultimately became one of self-sacrifice, seen in pictures of ecstasy, crucifixion, and silent cries.
