The individual authors' perspectives on this practice differ with respect to certain issues. One is a former Legal Services lawyer, and the other has a private practice which focuses on Medicaid estate planning.

Book excerpt: In anticipation of the escalating costs of long term care, consumers and the federal and state governments are engaging in a variety of strategies intended to preserve the financial solvency of the respective party. For the consumer, this may mean planning in a way designed to maximize one's potential future eligibility for government support, while the federal government tries to limit those planning activities inspired by public benefits considerations and the states attempt to recover their long term care expenses from the estates of deceased consumers whose long term care needs the state had earlier supported. All of these strategies have important and controversial public policy implications. The public policy debate surrounding these strategies ought to be ethically informed. This article sets out to identify and outline some of the main ethical questions engendered by individual Medicaid planning, on one hand, and state estate recovery efforts, on the other. It concludes that neither of these approaches to the challenge of long term care financing are very ethically palatable.

Book excerpt: This paper discusses moral, ethical, and public-policy issues regarding Medicaid planning -- transferring or converting assets of a long-term care consumer to create Medicaid eligibility. The author argues that it is not unethical to qualify a nursing-home resident for Medicaid by means of asset transfers where the resident will receive the same service under Medicaid as he or she would receive as a private-pay patient. The author further contends that an applicant's lawyer would have an ethical and moral obligation to the client and the client's family to maximize Medicaid payments for nursing care where it is clear that the client would want Medicaid to cover the cost of care. Finally, the author urges that the state's or commonwealth's fiscal concerns should not be given priority by a court above a Medicaid candidate's legitimate desire to preserve his or her wealth in the face of ruinously expensive nursing home costs.
