It attempts to untangle the debates on modes of liability in international criminal law (ICL) that have become truly complex over the last twenty years, and to provide a way to identify the most appropriate model for leadership liability. A unique comparative theory of ICL is offered, which clarifies the way in which ICL develops as a patchwork of different domestic criminal law notions. This theory forms the basis for the comparison of some influential domestic criminal law systems, with a view to understanding the policy and cultural reasons for their differences. There is a particular focus on the background of the German law which has influenced the International Criminal Court so much recently. This helps to understand, and seek a solution to, the current impasses in the debates on which model of liability should be applied. An entire chapter of the book is devoted to considering why leaders should be held responsible for crimes committed by their subordinates, from legal, moral and pragmatic perspectives. The moral responsibility of leaders is translated into criminal liability, and the different domestic models of liability are translated to the international context, in such a way as to appeal to advanced students of ICL, academics, and practitioners who want to understand the complexities of leadership liability in international criminal law today and identify the best way to approach it. A medida que el principio de confianza se ha ido extendiendo a otros ámbitos de actuación distintos del tráfico viario, la doctrina ha ido destacando la necesidad de limitar la aplicación de este principio en aquellos ámbitos en los que, en atención a la especial relación entre los distintos intervinientes, puede apreciarse la existencia de un deber de cuidado sobre la conducta de los terceros; así, fundamentalmente, en ámbitos en los que se produce una división vertical del trabajo y se imponen al superior jerárquico ciertos deberes de dirección y supervisión sobre la conducta de sus subordinados.

This process includes affiliation with circles and settings that include or sponsor offenses, followed by understanding and identification of the offenses as prohibited behavior by the transgressor. The process can be summarized as affinity, affiliation, and signification. The sequential process Matza describes allows for non-recurrent offending behavior, recidivism, and offending again. His perspective is motivated by the view that criminological theories do not explain a number of the fundamental empirical features and nuances known to be associated with delinquency. This includes the frequent termination of delinquent behavior at the onset of adulthood, the often conformist nature of delinquent behavior, and the large numbers of non-delinquents that are often found in otherwise high-delinquency areas. In Becoming Deviant Matza reasons that most, though not all, delinquent behavior constitutes relatively uniform phenomena that is developmental in character. Individuals proceed from trivial to more serious infractions. He argues that delinquent behavior represents youths searching for adventure and is accompanied by withdrawal from conventional values and associated behavior. Matza further claims that many delinquents are not fully committed to a delinquent lifestyle, and this explains why delinquent behavior often ends with adulthood. Matza's compelling and integrated theoretical explanation makes this a classic in the increasingly sophisticated criminological literature. Thomas Blomberg's new introduction shows why Becoming Deviant remains of central importance to the field.

Lying has been with us from time immemorial. Yet today is different-and in many respects worse. All over the world, people are circulating damaging lies, and these falsehoods are amplified as never before through powerful social media platforms that reach billions. Liars are saying that COVID-19 is a hoax. They are claiming that vaccines cause autism. They are lying about public officials and about people who aspire to high office. They are lying about their friends and neighbors. They are trying to sell products on the basis of untruths. Unfriendly governments, including Russia, are circulating lies in order to destabilize other nations, including the United Kingdom and the United States. In the face of those problems, the renowned legal scholar Cass Sunstein probes the fundamental question of how we can deter lies while also protecting freedom of speech. To be sure, we cannot eliminate lying, nor should we try to do so. Sunstein shows why free societies must generally allow falsehoods and lies, which cannot and should not be excised from democratic debate. A main reason is that we cannot trust governments to make unbiased judgments about what counts as "fake news." However, governments should have the power to regulate specific kinds of falsehoods: those that genuinely endanger health, safety, and the capacity of the public to govern itself. Sunstein also suggests that private institutions, such as Facebook and Twitter, have a great deal of room to stop the spread of falsehoods, and they should be exercising their authority far more than they are now doing. As Sunstein contends, we are allowing far too many lies, including those that both threaten public health and undermine the foundations of democracy itself.
