Book excerpt: Actualmente es posible advertir cierto desequilibrio historiográfico en orden a la cantidad de investigaciones que se refieren a la codificación procesal y, en particular, a la del enjuiciamiento criminal. En tal sentido, pareciera que existe una suerte de hechizo, que mistifica la codificación del Derecho sustantivo en desmedro del Derecho procesal; la cual, según los autores de este trabajo, por varios factores, ya no resulta justificada. En tal marco se inserta este libro que se propone analizar algunas de las aristas que ofrece el proceso de codificación procesal penal en Argentina, entre 1935 a 1939, tomando como ámbito de análisis lo ocurrido en las Provincia de Buenos Aires y Córdoba; período en el cual se visualizó un movimiento renovador de la legislación procesal, bajo la idea de la instauración de las formas orales. La obra intenta conjugar diversas miradas, poniendo de relieve la importancia de las intersecciones entre distintas perspectivas historiográficas - jurídica, social, intelectual -, valiéndose para su cometido de las categorías conceptuales e instrumentos metodológicos de cada una de ellas.María Angélica Corva es Profesora y Licenciada en Historia por la Universidad Nacional de Plata y Doctora en Historia por la misma Universidad. Book excerpt: This volume addresses an important historiographical gap by assessing the respective contributions of tradition and foreign influences to the 19th century codification of criminal law. More specifically, it focuses on the extent of French influence – among others – in European and American civil law jurisdictions. In this regard, the book seeks to dispel a number of myths concerning the French model’s actual influence on European and Latin American criminal codes. The impact of the Napoleonic criminal code on other jurisdictions was real, but the scope and extent of its influence were significantly less than has sometimes been claimed. The overemphasis on French influence on other civil law jurisdictions is partly due to a fundamental assumption that modern criminal codes constituted a break with the past. The question as to whether they truly broke with the past or were merely a degree of reform touches on a difficult issue, namely, the dichotomy between tradition and foreign influences in the codification of criminal law. Scholarship has unfairly ignored this important subject, an oversight that this book remedies.

Book excerpt: Contributing to the literature on comparative criminal procedure and Latin American law, this book examines the effects of adversarial criminal justice reforms on victim’s rights by specifically analyzing the Colombian criminal justice reform of the early 2000s. This research focuses on the production, interpretation, and implementation of rules and institutions by exploring how different actors have employed the concept of victims and victims’ rights to promote their agendas in the context of criminal justice reforms. It also analyzes how the goals of these agendas have interplayed in practice. By the early 2000s, it seemed that the Colombian criminal justice system was headed towards a process characterized by broader victim participation, primarily because of the doctrine of the Constitutional Court on victims’ rights. But in 2002, the Colombian Attorney General promoted a more adversarial criminal justice reform. This book argues that this reform represented a sudden and unpredicted reversal of the Constitutional Court’s doctrine on victim participation, even though one of the central justifications for the reform was the need to satisfy human rights standards and adhere to the jurisprudence of the Constitutional Court on victims’ rights. In the criminal justice reform of the early 2000s and its subsequent modifications, the promotion of a dichotomous interpretation of the adversarial model—which conceived the criminal process as a competition between prosecution and defense—served to limit victim participation. This study examines how conceptions of victims’ rights emerged out of the struggles between different and at times competing agendas. In the Colombian process of reform, victims’ rights have been invoked both as a justification for criminal sanctions and as an explanation for crime prevention and restorative justice. After assessing quantitative and qualitative data, this book concludes that punitive approaches to victims’ rights have prevailed over restorative justice perspectives. Furthermore, it argues that punitiveness in the criminal justice system has not resulted in more protection for victims. Ultimately, this research reveals that the adversarial criminal justice reform of the early 2000s has not substantially improved the protection of victims’ rights in Colombia.
