Book excerpt: La organizaci?n pol?tica y territorial y el esquema de distribuci?n de competencias en materia de sanidad y asistencia sanitaria que establecen la Constituci?n y los Estatutos de Autonom?a, provocan el nacimiento, en el a?o 1986 y mediante la Ley 14/1986, de 25 de abril, General de Sanidad, del Sistema Nacional de Salud, concebido como el conjunto de los servicios de salud con un funcionamiento arm?nico y coordinado. La Ley General de Sanidad establece que en los servicios de salud se integrar?n los diferentes servicios sanitarios p?blicos del respectivo ?mbito territorial. Tal integraci?n se realiza con las peculiaridades organizativas y funcionales de los correspondientes centros, entre ellas el r?gimen jur?dico de su personal, lo que motiva que en los servicios de salud y en sus centros sanitarios se encuentre prestando servicios personal con vinculaci?n funcionarial, laboral y estatutaria. Si bien el personal funcionario y laboral ha visto sus respectivos reg?menes jur?dicos actualizados tras la promulgaci?n de la Constituci?n Espa?ola, no ha sucedido as? respecto al personal estatutario que, sin perjuicio de determinadas modificaciones normativas puntuales, viene en gran parte regulado por estatutos preconstitucionales. Resulta, pues, necesario actualizar y adaptar el r?gimen jur?dico de este personal, tanto en lo que se refiere al modelo del Estado Auton?mico como en lo relativo al concepto y alcance actual de la asistencia sanitaria. Los profesionales sanitarios y dem?s colectivos de personal que prestan sus servicios en los centros e instituciones sanitarias de la Seguridad Social han tenido hist?ricamente en Espa?a una regulaci?n espec?fica. Esa regulaci?n propia se ha identificado con la expresi?n «personal estatutario» que deriva directamente de la denominaci?n de los tres estatutos de personal -el estatuto de personal m?dico, el estatuto de personal sanitario no facultativo y el estatuto de personal no sanitario de tales centros e instituciones. La necesidad de mantener una regulaci?n especial para el personal de los servicios sanitarios ha sido apreciada, y reiteradamente declarada, por las normas reguladoras del personal de los servicios p?blicos. As?, la Ley 30/1984, de 2 de agosto, de Medidas para la Reforma de la Funci?n P?blica, mantuvo vigente en su totalidad el r?gimen estatutario de este personal, determinando, en su disposici?n transitoria cuarta, que ser?a objeto de una legislaci?n especial. El contenido de la ley se estructura en 14 cap?tulos, a trav?s de los cuales se regulan los aspectos generales y b?sicos de las diferentes materias que componen el r?gimen jur?dico del personal estatutario. En el cap?tulo I se establece con nitidez el car?cter funcionarial de la relaci?n estatutaria, sin perjuicio de sus peculiaridades especiales, que se se?alan en la propia ley y que deber?n ser desarrolladas en cada una de las comunidades aut?nomas respecto de su propio personal. Los criterios para la clasificaci?n del personal estatutario, basados en las funciones a desarrollar y en los niveles de titulaci?n, figuran en su cap?tulo II, que tambi?n regula la figura del personal temporal, cuya importancia y necesidad en el sector sanitario deriva de la exigencia de mantener permanente y constantemente en funcionamiento los distintos centros e instituciones. El cap?tulo III enumera los mecanismos de ordenaci?n y planificaci?n del personal de cada uno de los servicios de salud, entre los que cabe destacar la existencia de registros de personal que se integrar?n en el Sistema de Informaci?n Sanitaria que establece la Ley de Cohesi?n y Calidad del Sistema Nacional de Salud. At the same time, however, the United States is facing the vexing challenge of a seemingly uncontrolled rise in the cost of health care. Total medical expenditures are rapidly approaching 20 percent of the gross domestic product and are crowding out other priorities of national importance. The use of increasingly expensive prescription drugs is a significant part of this problem, making the cost of biopharmaceuticals a serious national concern with broad political implications. Especially with the highly visible and very large price increases for prescription drugs that have occurred in recent years, finding a way to make prescription medicinesâ€"and health care at largeâ€"more affordable for everyone has become a socioeconomic imperative. Affordability is a complex function of factors, including not just the prices of the drugs themselves, but also the details of an individual's insurance coverage and the number of medical conditions that an individual or family confronts. Therefore, any solution to the affordability issue will require considering all of these factors together. The current high and increasing costs of prescription drugsâ€"coupled with the broader trends in overall health care costsâ€"is unsustainable to society as a whole. Making Medicines Affordable examines patient access to affordable and effective therapies, with emphasis on drug pricing, inflation in the cost of drugs, and insurance design. This report explores structural and policy factors influencing drug pricing, drug access programs, the emerging role of comparative effectiveness assessments in payment policies, changing finances of medical practice with regard to drug costs and reimbursement, and measures to prevent drug shortages and foster continued innovation in drug development. It makes recommendations for policy actions that could address drug price trends, improve patient access to affordable and effective treatments, and encourage innovations that address significant needs in health care.
