Book excerpt: Estate and tax planning attorneys face unique ethical challenges when representing non-traditional couples (i.e., elder couples who do not marry, homosexual couples, etc.). Currently, there are four recognized ethical theories concerning the legal representation of individuals: individual representation; joint representation; intermediary representation; and family representation. The position endorsed by this paper is that the first three ethical theories of legal representation reinforce the primacy of the individual. By contrast, family representation embraces and supports an entity theory of ethical behavior (similar to ethical theories for corporate representation). The conclusion is that family representation offers estate and tax planning attorneys the most appropriate standard for ethical behavior in their representation of non-traditional couples. The paper then explains how the theory of family representation must be expanded in order to provide a workable standard of ethical behavior for estate and tax planning attorneys who represent non-traditional couples. The paper is divided into the following sections: (1) an overview of the shift from "the family" to "the individual" as the fundamental organizing unit of western society and the development of non-traditional couples within this framework; (2) a discussion of the estate and tax planning issues faced by non-traditional couples; (3) a review of the ethical responsibilities of an attorney who represents traditional couples; and (4) an application of these ethical responsibilities to the representation of non-traditional couples, resulting in the foregoing conclusions.
