El carácter cerrado del mundo castrense ha permitido, durante los dos últimos siglos, el desarrollo de una justicia penal propia que ha contado con una jurisdicción especial, una Ley procesal específica, un Código penal definido por el mantenimiento de los llamados “bienes jurídicos castrenses” e, incluso, un sistema de ejecución de penas material y normativamente independiente del común. La obligada transformación del llamado mundo castrense, tras la aprobación de nuestra Constitución, no se llevó a cabo en todos sus términos, trasmutando dicho proceso por el inicio de una lenta transformación de las Fuerzas Armadas, y el conjunto normativo que las regula, que ha culminado en un conjunto de reformas legislativas en los últimos años y que han afectado a todas las vertientes de la Justicia Penal militar. En este sentido, el Código Penal de 2015 ha supuesto un importante paso hacia la conformación de una Ley especial, sometida al principio de complementariedad del Código Penal, pero sin renunciar a mantener la idiosincrasia del mundo castrense. En este contexto en el que, en ocasiones, se difuminan los límites entre la costumbre y la legalidad, entre los bienes jurídicos y los valores castrenses, el objeto de este pequeño opúsculo es aportar una serie de parámetros y poner de manifiesto los aspectos más importantes que debemos tomar en consideración, de forma crítica, a la hora de contextualizar y explicar el mantenimiento de esta singularidad.
