Book excerpt: Almost ten years have elapsed since the revised edition of "PPSA a conceptual approach" was published. Both the first edition and the revised edition were published prior to the time the PPSA came into force in New Zealand in May 2002. As a result, the book does not include references to any New Zealand case law. Therefore, the primary purpose in writing a new edition is to include commentary and references to relevant New Zealand case law. In addition, the new edition will also include commentary and references to relevant Canadian case law that has arisen since 2002. A substantial body of case law has developed since 2002. Australia has also enacted a PPSA which is scheduled to come into force in early 2012. The new edition of the book will also include some reference to Australian legislation for comparative purposes and to the extent it contributes to the discussion on issues arising in New Zealand. In my view, an updated edition of the book will appeal to the New Zealand market as well as the Australian market (although please see the market research info at 11 below). This book's unique selling point is its conceptual approach rather than the section by section analysis and commentary which prevails in other publications dealing with the PPSA as a subject matter. The conceptual approach brings relevant issues together which is helpful. Several practitioners in Australia have commented that due to the conceptual approach, they recommend this book as the book to start with when learning about the changes brought by the PPSA. The structure of the current text is unlikely to change as the developments in the law will generally be accommodated within the existing chapters. However there are some emerging issues that might be dealt with better in separate chapters, so additional chapters may be included.

Book The Trials and Tribulations of Personal Property Security Law Reform in Australia

Download or read book The Trials and Tribulations of Personal Property Security Law Reform in Australia written by Anthony J. Duggan and published by . This book was released on 2015 with total page 41 pages. Available in PDF, EPUB and Kindle. Book excerpt: New Zealand enacted a Personal Property Securities Act in 1999, based substantially on the Saskatchewan Personal Property Security Act. After many years' debate, Australia enacted a Personal Property Securities Act in 2009 and the statute commenced operation on 30 January 2012. Like the New Zealanders, the Australian drafters used the Saskatchewan PPSA as their starting point but, unlike the New Zealanders, they ended up departing in numerous respects from the original text. The problem with reinventing the wheel, as the Australians did, is that it increases the risk of mistakes and this concern has been borne out by subsequent developments in Australia. Australian PPSA, s.343 provided for a mandatory review of the legislation after three years of operation. The review was recently completed; the reviewer's report is 530 pages long and it makes 349 recommendations for reform. Many of these recommendations are aimed at correcting mistakes in the statute and the register which could have been avoided if the Australian law makers had adhered more closely to the Saskatchewan PPSA (or some other tried and tested model). This paper discusses some of the Review's key findings, focusing in particular on registration issues. The paper also discusses some of the more important Australian PPSA cases to date.
