Book excerpt: Chapter 3 develops a statistical procedure to select the appropriate nonparametric efficiency model in terms of its dimensionality. The change of dimensionality is categorized into three cases: nested variable changes (expansion or contraction of a variable set), additive variable changes (aggregation or disaggregation of a variable set) and other non-nested model changes. A bootstrapping method is proposed to measure the size of the dimensionality effect. Potential bias in raw efficiency scores owing to the dimensionality effect is corrected to reflect true efficient levels. An empirical illustration is presented with the Hughes and Yaisawarng (2004) (hereafter HY) data set.

Book excerpt: "My dissertation is motivated by the question, "In an era of ever-increasing global economic integration, why do some developing countries continually struggle to attract foreign direct investment (FDI)?" I explain this phenomenon by highlighting the interaction between international law and domestic institutions, and illustrating how this dynamic affects FDI in developing countries. My methods involve large-N quantitative analyses of developing countries, supported by case studies. The first chapter, "The Effects of Federalism and decentralization on the Business Environment for Foreign Direct Investment," shows that while developing countries often sign bilateral investment treaties (BITs) to commit to a stable policy environment, the effectiveness of these treaties in improving policy stability is reduced by federalism and decentralization. According to international law, national governments are legally responsible for any BIT violations that occur within their territories, even when the violation was committed by a subnational-level government. One implication of this is that when foreign investors initiate international arbitration claims over alleged BIT violations, the respondents are always national governments. This gives subnational governments weaker incentives than national governments to comply with BITs, which decreases the effectiveness of BITs in promoting policy stability in countries where subnational governments are relatively powerful. The second chapter, "Can Rational Choice Explain Bilateral Investment Treaties? How Lack of Legal Capacity Affects BIT Signing," argues that a country's legal capacity affects its ability to fully evaluate the consequences of BITs. I show that countries with federal and decentralized governments are more likely to be embroiled in international investment disputes over alleged violations of BITs, but that only countries with higher legal capacity are likely to adjust for this increased risk by signing fewer BITs. This demonstrates that a country's ability to behave in a "rational" manner when signing international treaties is dependent on its level of legal expertise. The third chapter, "The Effects of Judicial Independence on Foreign Direct Investment and International Arbitration Laws," studies how developing countries with institutional disadvantages use international alternatives to promote FDI, and how this differs by regime type. I show that in democratic countries, a decrease in judicial independence is associated with lower FDI inflows. Countries facing this problem respond by being more likely to adopt laws that provide investors with the option of international arbitration. These patterns are, however, not observed in autocratic countries. This is because in autocratic countries, the government can provide foreign investors with opportunities to collude with the government and extract rents at the expense of the public, making them less dependent on judicial independence to attract FDI"--Pages vii-ix.

Book excerpt: Both policy makers and policy analysts are interested in the extent to which host country policies influences foreign direct investment (FDI). While much work has focused on the impact of government policies on aggregate FDI, little attention has been paid to the possibility that different types of FDI may respond differently to changes in policies. In this dissertation, I investigate whether local policies affect distinct types of FDI in different ways. In addition, I also study whether the FDI undertaken by multinational enterprises (MNEs) generates spillovers to their home countries. In the first chapter, I test the effect of environmental policies in host countries on horizontal, vertical and export-platform FDI. In a simple model I show how different types of FDI respond to a stricter environmental policy. Using U.S. outward FDI in 50 host countries and a survey measure of local environmental regulations, I find a significant deterrent effect of environmental regulations on horizontal and export-platform FDI. Furthermore, I find that in host countries with stricter environmental regulations than U.S. regulations, export-platform FDI exhibits a greater sensitivity to local environmental regulations than horizontal FDI. I extend the analysis in the first chapter to the effect of local corporate tax rates in the second chapter. The empirical evidence suggests that the effect of statutory corporate income tax rates is negative and significant on vertical and export-platform FDI but insignificant on horizontal FDI. The tax effect is found to have grown stronger over time. More importantly, I find that different types of FDI respond in distinct ways to variation in tax rates across "third" countries.

Critically FDI is a key business indicator as it demonstrates that Multi-National Companies (MNC’s) have set out strategies to exercise their control in foreign countries and overseas markets. Over the last thirty years China’s FDI inflows have grown at a staggering rate. In order to understand the reasons why this pattern has occurred both the micro and macro environment need to be considered. Therefore, it is evident that a number of factors need to explored, this is what the first part of essay discuses. The second part of the question is inevitably based upon opinion and prediction. In order to judge if the trend of FDI is to continue, it has to be constructed upon the past trends but also the external environment. For example, The Economist has built a case for why India’s annual GDP growth will outpace China. Fundamentally, this kind of speculation amongst the business world is likely to raise questions on the location of where MNC’s will do business and where FDI will follow. This will be further explored in the second part of the essay.
