Book excerpt: This dissertation consists of three essays on the effect of changes in family law in the United States since the divorce revolution in the 1970's on household outcomes. "When Homemakers are Compensated: A Study of the Effects of Homemaking Provision in Property Division Following Divorce on Time Allocation of Married Couples" In the first essay I examine the effects of the homemaking provision in family law that gives recognition to the contribution of homemakers in marriage in the division of properties accumulated during marriage. I develop a non-cooperative bargaining framework to analyze the effects of the provision on the time allocation in household public goods of spouses. The model suggests that the law would enhance gender specialization within the family in states under the unilateral divorce regime. The empirical findings are consistent with this hypothesis. Wives are found to increase the amount of housework they performed by more than 150 hours annually at least within the first 10 years under the unilateral divorce regime when the homemaking provision has been introduced. This effect amounts to 10 percent of the sample mean for wives married prior to the reform. "An Assessment of the Impact of Homemaking Provision in Property Division at Divorce on Investment in Household Public Goods, Marital Formation and Dissolution" This chapter goes on to investigate whether the homemaking provision would enhance the marriage institution by assessing the extent to which the law affects marital formation and dissolution as well as households' investment in public goods such as child-rearing and housing. I find evidence that the homemaking provision stimulates marriage but alters the composition of the pool of individuals that marry. This selection effect tends to induce more divorce. On the net, marriage rates have been raised by at least 5.9 percent in states that have implemented the provision for over 26 year. There is also some evidence that the provision stimulates birth rates and home investment. "The Effect of Child Custody Laws on Marriage" Under the tender years doctrine child custody was virtually always awarded to the mother upon divorce. Gender-neutral custody laws introduced beginning in the 1970's provided married fathers, in principle, equal rights to custody. Subsequent marriage-neutral laws extended the rights to unmarried fathers. We develop a theoretical model of the effect of custody regimes on marriage and test the model's predictions using a unique data set that merges custody law data with data from the Current Population Survey and Vital Statistics. We find that, under marriage-and gender non-neutrality, the introduction of gender-neutral laws reduced marriage by at least 7.5 percent. There is no evidence that moving from marriage non-neutrality to marriage- neutrality affected marriage.

Book Law in Society Reflections on Children Family Culture and Philosophy

Download or read book Law in Society Reflections on Children Family Culture and Philosophy written by Alison Diduck and published by BRILL. This book was released on 2015-08-24 with total page 685 pages. Available in PDF, EPUB and Kindle. Book excerpt: This collection, written by legal scholars from around the world, offers insights into a variety of topics from children’s rights to criminal law, jurisprudence, medical ethics and more. Its breadth reflects the fact that these are all elements of what can broadly be called ‘law and society’, that enterprise that is interested in law’s place or influence in diffferent aspects of real lives and understands law to be simultaneously symbol, philosophy and action. It is also testament to the broad range of vision of Professor Michael Freeman, in whose honour the volume was conceived. The contributions are divided into categories which reflect his distinguished career and publications, over 85 books and countless articles, including pioneering work on children’s rights, domestic violence, religious law, jurisprudence, law and culture, family law and medicine, ethics and the law, as well as his enduring commitment to interdisciplinarity. The volume begins with work on law in its philosophical, cultural or symbolic realm (Part I: Law and Stories: Culture, Religion and Philosophy), including its commitment to the normative ideal of ‘rights’ (Part II: Law and Rights), and then offfers work on law as coercive state action (Part III: Law and the Coercive State) and as regulator of personal relationships (Part IV: Law and Personal Living). It continues with reflections on the importance of globalisation, both of law and of ‘doing family’ in personal and public life (Part V: Law and International Living) before closing with two reflections on Michael Freeman’s body of work generally, including one from Michael himself (Part VI: Law and Michael Freeman).

Book Redefining Family Law in India

Download or read book Redefining Family Law in India written by Archana Parashar and published by Routledge India. This book was released on 2008 with total page 424 pages. Available in PDF, EPUB and Kindle. Book excerpt: 'Family Law' refers to the set of legal rules which are in practice in India with regards to 'family' issues - marriage, divorce, inheritance, etc. This volume is a collection of articles by different scholars across disciplines to generate a discourse on just Family Law. Main features: it is an inter-disciplinary collection of articles on family law - not just by lawyers or legal specialists but includes political scientists, sociologists, economists, anthropologists, religion specialists, etc. it is concerned with a just family law that moves beyond a uniform civil code. Has a strong but not exclusive focus on women and women's issues. The authors demonstrate that substantive rules such as a just family law, in addition to being inclusive, would make connections between the structure of the family and in the wider economic, political and social institutions. Secondly, they challenge the myths about the private sphere as the sphere of non-regulation by law in order to demonstrate that just a family law can be compatible with freedom of conscience. The authors here are seeking to create a discourse on family law that accommodates diversity and is context-sensitive. However, most of the contemporary legal theory questions the role of law in achieving justice, and there is a pervasive view that cultural diversity is more valuable than a state-imposed family law. This argument is addressed from various standpoints to show that cultural plurality can be pursued in many other ways and a just family law is the minimum condition for a fair resolution of disputes, if and when they do rise. This book does not just document the pathologies of power within the family but also makes proposals for remedying these inequities. It is not confined to considering what changes need to be inducted into existing family law to make it more just, but also strategises on the means and methods of effecting the change. It seeks to break the silences prevailing in relation to some excluded groups, whose existence is not even acknowledged by contemporary family law.
