Book excerpt: Despite broad international recognition of the criminalization of illicit enrichment, it has not been universally accepted as an anti-corruption measure. Instead, criminalization of illicit enrichment continues to generate extensive debate and controversy. Against this background, this volume aims to provide an analysis of how illicit enrichment works, and attempts to shed light on any contributions that it has made to the fight against corruption and the recovery of stolen assets. Rather than delving into the theoretical and academic debates around illicit enrichment, this study focuses primarily on the analysis of current practice, case law, and existing literature to offer a new perspective to the on-going discussions. More specifically, the volume addresses the legal framework upon which the concept of illicit enrichment rests, and the resulting policy implications of that legal framework. It also focuses on illicit enrichment as an anti-corruption mechanism, from its roots as a response to the problems inherent to prosecutions involving corruption, to an examination of elements and inchoate offenses relating to illicit enrichment under international conventions. It examines illicit enrichment jurisprudence in the global context. An extensive survey was carried out to determine the countries where the offense exists, what form it takes, how often it is used, and for countries where it doesn't, what other measures are used in its place. The authors neither recommend nor oppose the adoption of illicit enrichment provisions, but rather aim to assist jurisdictions considering such steps by highlighting key questions that might arise during implementation, including how the offense is defined and enforced domestically by States. Similarly, the authors do not endorse nor criticize any practice carried out by States in the implementation of the criminalization of illicit enrichment. Ultimately, it is also hoped that this study provides a basis for further discussion amongst policy makers and practitioners, and fuels upcoming discussions by the Conference of State parties of the UNCAC and its Working Groups

Ainsi la théorie générale des effets de l’infraction impose-t-elle de partir d’une acception globale de l’effet en tant que phénomène concret, afin de dégager à terme une notion pénale précise. L’effet, pris en son sens général, est une suite. Il appartient à l’ensemble des réalités postérieures et extérieures à l’infraction, ensemble par essence infini, en ce que l’extériorité et la postériorité sont marquées par la contingence. Isoler l’effet au sein de suites indénombrables serait une vaine entreprise. Aussi convient-il de recourir à des critères rationnels, facteurs de certitude, afin de mettre en lumière non pas les effets concrets de l’infraction, mais la notion unique d’effet pénal de l’infraction. Pour cela, deux critères s’imposent, en ce qu’ils répondent à cette exigence de rigueur scientifique : la légalité et la causalité. L’effet, suite légale et causale, ressort comme une conséquence particulière, consubstantielle à l’incrimination de l’infraction. Est ainsi mise en lumière la nature unique de l’effet de l’infraction : c’est le résultat redouté des infractions formelles. Ainsi apporte-t-il un éclairage nouveau sur cette catégorie d’infractions, et sur le droit pénal général en son entier, qui ne peut s’arrêter aux portes de la définition des éléments constitutifs de l’infraction.

The fundamental burden of a theory of inductive inference is to determine which are the good inductive inferences or relations of inductive support and why it is that they are so. The traditional approach is modeled on that taken in accounts of deductive inference. It seeks universally applicable schemas or rules or a single formal device, such as the probability calculus. After millennia of halting efforts, none of these approaches has been unequivocally successful and debates between approaches persist. The Material Theory of Induction identifies the source of these enduring problems in the assumption taken at the outset: that inductive inference can be accommodated by a single formal account with universal applicability. Instead, it argues that that there is no single, universally applicable formal account. Rather, each domain has an inductive logic native to it. Which that is, and its extent, is determined by the facts prevailing in that domain. Book excerpt: The problem of finding minimal surfaces, i. e. of finding the surface of least area among those bounded by a given curve, was one of the first considered after the foundation of the calculus of variations, and is one which received a satis factory solution only in recent years. Called the problem of Plateau, after the blind physicist who did beautiful experiments with soap films and bubbles, it has resisted the efforts of many mathematicians for more than a century. It was only in the thirties that a solution was given to the problem of Plateau in 3-dimensional Euclidean space, with the papers of Douglas [DJ] and Rado [R T1, 2]. The methods of Douglas and Rado were developed and extended in 3-dimensions by several authors, but none of the results was shown to hold even for minimal hypersurfaces in higher dimension, let alone surfaces of higher dimension and codimension. It was not until thirty years later that the problem of Plateau was successfully attacked in its full generality, by several authors using measure-theoretic methods; in particular see De Giorgi [DG1, 2, 4, 5], Reifenberg [RE], Federer and Fleming [FF] and Almgren [AF1, 2]. Federer and Fleming defined a k-dimensional surface in IR" as a k-current, i. e. a continuous linear functional on k-forms. Their method is treated in full detail in the splendid book of Federer [FH 1].
