Les rédacteurs de la Déclaration des Droits de l'Homme l'ont défini comme un des droits naturels et imprescriptibles de l'homme et comme un droit inviolable et sacré. De même le code civil place la propriété au cœur du droit civil, il a pour objectif de consacrer et défendre ce droit. Aujourd'hui, le droit de propriété connaît des limites, tant des limites à l'exercice du droit de propriété que des limites au droit de disposer. Depuis ces dernières années, les législations successives n'ont cessé de limiter les droits des propriétaires en vertu d'un principe indiscutable : la fonction sociale de la propriété. Le droit de propriété a, en effet, évolué. Produit du libéralisme économique, la propriété a du s'adapter à l'évolution de la société. L'histoire de la propriété est, en effet, intimement liée à l'histoire politique et idéologique d'une société. Au caractère absolutiste s'est substitué le caractère limité de la propriété. En outre, les propriétés spéciales telles l'indivision, la copropriété des immeubles bâtis, la mitoyenneté, altèrent l'autonomie de chacun des propriétaires. Il en résulte des atteintes particulièrement graves aux droits du propriétaire. Cependant, le droit de propriété, en tant que droit fondamental, a toujours été protégé. À la protection de la propriété par la loi s'est récemment développée une protection par le Conseil Constitutionnel et par la Cour Européenne des Droits de l'Homme. L'objet et l'ambition de cette thèse sont donc de dresser un bilan sur l'évolution contemporaine du régime juridique de droit de propriété en matière immobilière, et montrer comment le droit de propriété a évolué dans le sens d'une restriction toujours plus grande des droits des propriétaires.
