This book was released on 2000-09-14 with total page 270 pages. Available in PDF, EPUB and Kindle. Book excerpt: This major addition to Ideas in Context examines the development of natural law theories in the early stages of the Enlightenment in Germany and France. T. J. Hochstrasser investigates the influence exercised by theories of natural law from Grotius to Kant, with a comparative analysis of the important intellectual innovations in ethics and political philosophy of the time. Hochstrasser includes the writings of Samuel Pufendorf and his followers who evolved a natural law theory based on human sociability and reason, fostering a new methodology in German philosophy. This book assesses the first histories of political thought since ancient times, giving insights into the nature and influence of debate within eighteenth-century natural jurisprudence. Ambitious in range and conceptually sophisticated, Natural Law Theories in the Early Enlightenment will be of great interest to scholars in history, political thought, law and philosophy.

Download or read book Natural Law and the Origin of Political Economy written by Arild Saether and published by Routledge. This book was released on 2017-06-26 with total page 308 pages. Available in PDF, EPUB and Kindle. Book excerpt: Samuel Pufendorf’s work on natural law and political economy was extensive and has been cited by several important figures in the history of economic thought. Yet his name is rarely mentioned in textbooks on the history of economic thought, the history of political science or the history of philosophy. In this unprecedented study, Arild Sæther sheds new light both on Pufendorf’s own life and work, as well as his influence on his contemporaries and on later scholars. This book explores Pufendorf ’s doctrines of political economy and his work on natural law, which was translated into several major European languages. Natural Law and the Origin of Political Economy considers the influence he had on the writings on political economy of John Locke, Charles Montesquieu, Jean-Jacques Rousseau, Francis Hutcheson and Adam Smith, amongst others. If Smith can be called the father of modern economics, this book claims that Pufendorf can be called the grandfather. This volume is of great importance to those who study Pufendorf ’s extensive works, as well as those interested in history of economic thought, political economy and political philosophy.
Download or read book Richard Cumberland and Natural Law written by Linda Kirk and published by BoD – Books on Demand. This book was released on 2022-01-01 with total page 190 pages. Available in PDF, EPUB and Kindle. Book excerpt: Richard Cumberland and Natural Law represents the first major biographical sketch of Cumberland to appear in English. A critic and antagonist of Thomas Hobbes, a proto-Utilitarian and a man of the cloth, Richard Cumberland may be England’s least recognised seventeenth century polymath, often overshadowed by the likes of John Bramhall and John Wallis. His magnum opus, De Legibus Naturae (On Natural Laws) stands in quality amongst the greatest works of natural philosophy and ethics of his time period. Here Kirk outlines Cumberland’s significant philosophical contributions as well as situating him in his intellectual and historical context. She describes his life, his work as Bishop of Peterborough, and his pioneering contributions to natural law theory. Kirk also includes a chapter on the various editions of Cumberland’s masterwork and the praise it received from his contemporaries. Richard Cumberland and Natural Law remains the foremost collection of biographical information of Richard Cumberland, as well as offering a comprehensive discussion of his theories.

Available in PDF, EPUB and Kindle. Book excerpt: Adam Smith’s contribution to economics is well recognised, yet scholars have recently been exploring anew the multidisciplinary nature of his works. The Adam Smith Review is a rigorously refereed annual review that provides a unique forum for interdisciplinary debate on all aspects of Adam Smith’s works, his place in history, and the significance of his writings to the modern world. It is aimed at facilitating debate among scholars working across the humanities and social sciences, thus emulating the reach of the Enlightenment world which Smith helped to shape. This twelfth volume brings together leading scholars from across several disciplines and contributes to two particular themes. First, there is a focus on Adam Smith’s moral and political philosophy, exploring how Smith’s approach finds expression in both abstract philosophy and practical judgment. Second, there is a focus on epistemology, economics, and law, with innovative interpretations of Smithian theories.

Download or read book Neutrality in Contemporary International Law written by James Upcher and published by Oxford University Press. This book was released on 2020-04-30 with total page 324 pages. Available in PDF, EPUB and Kindle. Book excerpt: The law of neutrality - the corpus of legal rules regulating the relationship between belligerents and States taking no part in hostilities - assumed its modern form in a world in which the waging of war was unconstrained. The neutral State enjoyed territorial inviolability to the extent that it adhered to the obligations attaching to its neutral status and thus the law of neutrality provided spatial parameters for the conduct of hostilities. Yet the basis on which the law of neutrality developed - the extra-legal character of war - no longer exists. Does the law of neutrality continue to survive in the modern era? If so, how has it been modified by the profound changes in the law on the use of force and the law of armed conflict? This book argues that neutrality endures as a key concept of the law of armed conflict. The interaction between belligerent and nonbelligerent States continues to require legal regulation, as demonstrated by a number of recent conflicts, including the Iraq War of 2003 and the Mavi Marmara incident of 2010. By detailing the rights and duties of neutral states and demonstrating how the rules of neutrality continue to apply in modern day conflicts, this restatement of law of neutrality will be a useful guide to legal academics working on the law of armed conflict, the law on the use of force, and the history of international law, as well as for government and military lawyers seeking comprehensive guidance in this difficult area of the law.
