Book excerpt: Key Findings Sweeping reductions and changes to the enforcement program in BC have had a serious and negative impact on the ability of workers to become aware of their rights in the workplace, to complain of violations of their rights, and to obtain fair treatment in the process of pursuing complaints and having their complaints adequately investigated. Book excerpt: The nature of employment is changing: low wage jobs are increasingly common, fewer workers belong to unions, and workplaces are being transformed through the growth of contracting-out, franchising, and extended supply chains. Closing the Enforcement Gap offers a comprehensive analysis of the enforcement of employment standards in Ontario. Adopting mixed methods, this work includes qualitative research involving in-depth interviews with workers, community advocates, and enforcement officials; extensive archival research excavating decades of ministerial records; and analysis of a previously untapped source of administrative data collected by Ontario’s Ministry of Labour. The authors reveal and trace the roots of a deepening "enforcement gap" that pervades nearly all aspects of the regime, demonstrating that the province’s Employment Standards Act (ESA) fails too many workers who rely on the floor of minimum conditions it was devised to provide. Arguably, there is nothing inevitable about the enforcement gap in Ontario or for that matter elsewhere. For the last eight years an international team from Germany, Sweden, Norway, the UK, the US and Canada have been searching for promising practices that treat residents, families and staff with dignity and respect in ways that can also bring joy. While we did find ideas worth sharing, we also saw a disturbing trend toward privatization. Privatization is the process of moving away not only from public delivery and public payment for health services but also from a commitment to shared responsibility, democratic decision-making, and the idea that the public sector operates according to a logic of service to all. This book documents moves toward privatization in the six countries and their consequences for families, staff, residents, and, eventually, us all. None of the countries has escaped pressure from powerful forces in and outside government pushing for privatization in all its forms. However, the wide variations in the extent and nature of privatization indicate privatization is not inevitable and our research shows there are alternatives.

But how are these immigrants faring in this new Canada? Employing the International Labour Organization’s concept of “basic security” and the voices of immigrants themselves, Asian Immigrants in “Two Canadas” demonstrates that their security – such as work, job, employment, and voice and representation – has been compromised in multi-dimensional ways. Changes to immigration policy and the neoliberal restructuring of the Employment Standards Act in British Columbia have led to further marginalization within the labour market and the creation of deregulated and hazardous workplaces – resulting in the emergence of “two Canadas” within the Canadian welfare state. Representing a diverse group of immigrants, this book demonstrates a shared experience of precariousness and insecurity – an experience that has led to a broad- based alliance of Asian immigrant workers aimed at addressing workplace security and rights.

Book excerpt: Context of the BC Law Institute review of employment standards The last independent review of BC's employment standards legislation - the laws that set out basic workplace rights and protections for workers in the province - was the Thompson Page 3 | Response to the BC Law Institute Consultation Paper on the Employment Standards Act [...] The study documented in detail the harmful impacts of precarious employment on the health and well-being of the affected workers and their families, and the costs that precarious work imposes on society more broadly.8 The researchers found that workers from racialized communities and, in particular racialized women, were disproportionately affected by precarious work. [...] The Review was unique in Canada in that it was mandated to specifically address the challenges of precarious and vulnerable workers and to examine both employment standards and the labour code. [...] The key enforcement bodies for provincial workplace rights, the Employment Standards Branch of the Ministry of Labour and the Labour Relations Board have been underfunded to a point where they cannot adequately administer and enforce the law.10 This tilts the playing field too far in favour of the employer and severely undermines access to justice for vulnerable workers. Book excerpt: The Employment Standards Act of British Columbia sets minimum standards for terms of employment and working conditions in most workplaces that fall under provincial legislative jurisdiction. This consultation paper is issued in connection with the British Columbia Law Institute's Employment Standards Act Reform Project, which is the first comprehensive, independent review of the Act to be carried out in more than 25 years. The consultation paper reviews the Act and advances tentative recommendations for its reform. The tentative recommendations are intended in part to address transformative change in the workplace brought about by digitalization, the growth of precarious work, and demands from employers and workers alike for greater “flexibility” in working arrangements. They also address issues relating to the enforcement of the Act. The consultation paper has been issued to seek public comment on the tentative recommendations, which is requested by 31 August 2018. A subsequent report will contain final recommendations on reform of the Act.
