Book excerpt: Denmark is a constitutional monarchy, consisting of Denmark, Greenland and the Faroe Islands. Greenland and the Faroe Islands are not members of the EU. The Danish judicial system is based on the traditions of civil law as in continental Europe and is more or less divided into private law and public law. In general, rules and legal principles are organised in a number of codes. The Danish labour market is to a very large extent covered by collective agreements. The collective agreements cover areas such as wages and parental leave rights. Collective agreements accordingly play a significant role in the legal landscape regarding work-related issues. The collective agreements must comply with the principle of non-discrimination. The system of courts has a unified structure. Thus, there are no special courts of law. Several specialised complaints boards are present under Danish law. In 2009 the Board of Equal Treatment was established. The board handles individual complaints on all grounds of discrimination. Decisions from the complaint board can be appealed to the courts. The administration of courts in Denmark is mainly regulated by the Administration of Justice Act. According to the Danish civil law tradition, written legislation is one important legal source. Court decisions are also considered important sources of law. In Denmark the Minister for Gender Equality is responsible for all activities in the field of gender equality and the ministry co-ordinates the equality work of other ministries.

The Danish judicial system is based on the traditions of civil law as in continental Europe. In general, rules and legal principles are organised in a number of codes. Approximately 80 % of the Danish labour market is covered by collective agreements. Collective agreements cover areas such as wages and parental leave rights. Thus, collective agreements play a significant role in the legal landscape regarding work-related issues. The agreements are concluded by the labour market parties themselves and the state is not party or in any other way involved in such agreements. A special arbitration panel as well as the Labour Court have been set up by the state in order to assist in solving conflicts in the labour market. Specific legislation concerning employees in general has mainly been passed as part of the process of implementing the European Union directives. The Danish welfare model is to a large extent funded by general taxes. Regulation and interpretation of social security benefits are tied to the Parliament; courts, in their interpretation of regulations, often follow the intent of the legislators. This suggests that judicial interpretations of the legislation are very closely linked to the preparatory work. In addition to the court system, there are several specialised administrative complaint boards in Denmark. The Board of Equal Treatment (the Equality Board) was established in 2009. The board handles individual complaints on all grounds of discrimination. Decisions of the Equality Board can be brought before the courts.

Advanced social and economic rights are often given as the explanation for the equality. In this volume, Nordic feminist legal scholars give a more contradictory image of gender equality. The gendered construction of the legal subject and the legal understanding of gender have a two-pronged potential, both to change and to reproduce gender relations. Nordic women have been considered responsible for upholding the gendered social system - as "responsible selves" rather than as individuals engaged in rights discourse. The authors claim, with examples, that the belief in equality has made certain discriminative practices difficult to recognize and conceptualize. Also a transformation of the social welfare system puts the collective equality policies to the test.
