Book excerpt: From an early age, Roma in Slovenia and Slovakia face widespread discrimination in various areas of their lives, including housing, education, employment, health care and policing, driven by persistent negative attitudes among the majority population towards Roma. Roma women often face multiple and intersectional discrimination based on their ethnicity and gender in both countries. The Covid-19 pandemic also amplified ongoing shortcomings in the protection of Roma rights. As members of the European Union (EU), both countries have anti-discrimination legislation in place and an established equality body in compliance with the EU Racial Equality Directive. In practice, however, implementation remains poor: the number of cases of discrimination against Roma resolved by courts is still very low in both countries. Even among legal personnel, knowledge of anti-discrimination law is limited, and Roma themselves are often reluctant themselves to report incidents due to lack of awareness, mistrust of the judicial system or a generalized disbelief that their situation will change. This publication, Equality and justice on the sidelines: Comparative report on discrimination against Roma and their access to justice in Slovakia and Slovenia, provides an overview of the current scope of discrimination against Roma, especially women, their lived experience and access to justice in Slovakia and Slovenia. Based on a combination of desk research and empirical study, namely a series of semi-structured interviews conducted with different stakeholders in both countries, it also includes a series of recommendations to achieve greater inclusion and equality in line with the stated commitment of both countries to protect their Roma populations.

Book excerpt: This comparative report summarizes and analyzes the findings of two studies conducted by two partner organizations: Information Legal Center in Croatia and Center for Interethnic Dialogue and Tolerance “Amalipe” in Bulgaria. The aim of the research was to map different areas of discrimination against Roma and to identify the obstacles they face. Drawing on focus group interviews and first-hand testimonies with community members, the findings highlighted that for many Roma in both countries, discrimination is still a daily reality in almost every area of their lives, from work and housing to education and access to services. The COVID-19 pandemic also had a disproportionately negative effect on the Roma community. Underlining these issues is a broader lack of access to justice, enabled in part by fear and a lack of faith among many Roma in the judicial system. This comparative study identifies some of the key findings from the research projects and confirms that the patterns of exclusion against Roma are very similar in both contexts. Access to justice for Roma can only be improved if international organizations, the state, local self-government, civil society and the media work with Roma communities to advocate for an inclusive, tolerant society where Roma have the same life chances as everybody else.

A central feature of the rule of law is the equality of all before the law. As part of this equality, all persons have the right to the protection of their rights by the state, particularly the judiciary. Therefore equal access to the courts and other organs of the state concerned with the enforcement of the law is central. These studies – undertaken by internationally renowned scholars and practitioners – examine the role of courts and similar bodies in administering the laws that pertain to the entitlements of marginalized communities, and address individuals' and organisations' access to institutions of justice: primarily, but not exclusively, courts. They raise broad questions about the commitment of the state to law and human rights as the principal framework for policy and executive authority, as well as the impetus to law reform through litigation. Offering insights into the difficulties of enforcing, and indeed of the will to enforce, the law, this book thus engages fundamental questions about value of engagement with the formal legal system for marginalized communities.

Book excerpt: The thesis aims to contribute to the scholarly effort that scrutinizes national minority rights standards in Central and Eastern Europe from an ethnocultural justice perspective. I approach this task through a case study of the Roma in Slovakia. By interrogating what ethnocultural justice for this minority means, I critique both, the current practices in the accommodation of national minorities, and Western theories of minority rights.In its final part, the thesis offers a variant of the personal cultural autonomy, combined with aspects of a model of joint governance called 'transformative accommodation', as an institutional expression of my normative proposal. While sanctioning the existence of some minority specific spaces, the model promises to facilitate the transformation of mainstream institutions in a way that promotes Roma inclusion in these critical in advancing both the socio-economic and the cultural structures, which is in turn critical in advancing both the socio-economic and the cultural empowerment of this group.Drawing on several fields of study, including international law, Slovak constitutional law, political theories of liberal pluralism, feminism, and Romani studies, the thesis frames the question of Roma rights within the larger discourse on accommodation of national minorities. I advance an account of ethnocultural justice based on the concept of equality that takes into consideration the issues of context. Rather than applying a uniform framework to each group, the thesis proposes a method of devising minority protection based on reliance of the three core 'objectives' or 'justifications' of existing national minority rights; namely peace and security, human dignity, and culture. Guided by the three justifications, I put forward an interpretation of ethnocultural justice for the Roma. It is founded on a substantive equality dimension in relation to the dominant majority and to other national minorities. Equal treatment acknowledges the specific circumstances of the Roma, including socio-economic disparities, distinct culture, and territorial dispersion. Ethnocultural justice is equally sensitive to gender and other forms of inequalities within the group. In contrast to existing policies, fair treatment of the Roma reaches beyond their mere 'integration' into dominant societal institutions, but equally falls short of promoting parallel minority institutions across the whole range of political, social, and economic spaces.

Book excerpt: In recent years, the European Convention on Human Rights (ECHR) gained unexpected relevance in the European constitutional culture. On the one hand, its increasing importance is closely linked to institutional reforms that strengthened the European Court of Human Rights' reputation vis-a-vis the Member States. On the other hand, and even more importantly, the ECHR's significance arises from a changing perception of its constitutional potential. Starting with the assumption that the ECHR is transforming the European constitutional landscape, this book shows that the European Convention raises unprecedented problems that involve, first of all, its own theoretical status as constitutional instrument that ensures the protection of human rights in Europe. Changing paradigms concerning its incorporation in domestic law, as well as the growing conflicts about the protection of some rights and liberties that are deeply rooted in national legal contexts (such as teaching of religion, bio law, and rights of political minorities), are jointly examined in order to offer a unified methodology for the study of European constitutional law centered upon human rights. For a detailed analysis of these issues, the book examines the different facets of the ECHR's constitutional relevance by separating the ECHR's role as a 'factor of Europeanization' for national constitutional systems (Part I) from its role as a veritable European transnational constitution in the field of human rights (Part II). Book excerpt: In Central Europe, limited success in revisiting the role of science in the segregation of Roma reverberates with the yet-unmet call for contextualizing the impact of ideas on everyday racism. This book attempts to interpret such a gap as a case of epistemic injustice. It underscores the historical role of ideas in race-making and provides analytical lenses for exploring cross-border transfers of whiteness in Central Europe. In the case of Roma, the scientific argument in favor of segregation continues to play an outstanding role due to a long-term focus on the limited educability of Roma. The authors trace the long-term interrelation between racializing Roma and the adaptation by Central European scholars of theories legitimizing segregation against those considered non-white, conceived as unable to become educated or "civilized." Along with legitimizing segregation, sterilization and even extermination, theorizing ineducability has laid the groundwork for negating the capacity of Roma as subjects of knowledge. Such negation has hindered practices of identity and quite literally prevented Roma in Central Europe from becoming who they are. This systematic epistemic injustice still echoes in contemporary attempts to historicize Roma in Central Europe. The authors critically investigate contemporary approaches to historicize Roma as reproducing whiteness and inevitably leading to various forms of epistemic injustice. The methodological approach herein conceptualizes critical whiteness as a practice of epistemic justice targeted at providing a sustainable platform for reflecting upon the impact of the past on the contemporary situation of Roma.

When minority groups in one country are targeted for killings or ethnic cleansing based on their group identity, whose responsibility is it to protect them? In particular, are they owed any protective responsibility by their kin state? How can cross-border kinship ties strengthen greater pan-national identity across borders without challenging territorially defined national security? As shown by the Russia-Georgia conflict over South Ossetia, unilateral intervention by a kin state can lead to conflict within and between states. The protection of national minorities should not be used as an excuse to violate state sovereignty and generate inter-state conflict. This book suggests that an answer to the kin state dilemma might come from the formula "neither intervention nor indifference" that recognizes the special bonds but proscribes armed intervention based on the ties of kinship.--Publisher's description.

The subsequent independence of Montenegro and Kosovo brought the total number to seven. Balkan scholar and diplomat to the region Mieczyslaw P. Boduszynski examines four of those states—Croatia, Slovenia, Macedonia, and the Federal Republic of Yugoslavia—and traces their divergent paths toward democracy and Euro-Atlantic integration over the past two decades. Boduszynski argues that regime change in the Yugoslav successor states was powerfully shaped by both internal and external forces: the economic conditions on the eve of independence and transition and the incentives offered by the European Union and other Western actors to encourage economic and political liberalization. He shows how these factors contributed to differing formulations of democracy in each state. The author engages with the vexing problems of creating and sustaining democracy when circumstances are not entirely supportive of the effort. He employs innovative concepts to measure the quality of and prospects for democracy in the Balkan region, arguing that procedural indicators of democratization do not adequately describe the stability of liberalism in post-communist states. This unique perspective on developments in the region provides relevant lessons for regime change in the larger post-communist world. Scholars, practitioners, and policymakers will find the book to be a compelling contribution to the study of comparative politics, democratization, and European integration.
