Book excerpt: Pursuant to a congressional request, GAO reviewed the Environmental Protection Agency's (EPA) Underground Injection Control Program, focusing on: (1) EPA efforts to ban underground hazardous waste injections; (2) whether EPA inspection and enforcement data are adequate to ensure proper program oversight; and (3) the status of prior recommendations to improve the program. GAO found that: (1) EPA has made progress in implementing federal regulations banning underground injection of hazardous wastes; (2) between 1988 and 1993, the number of underground hazardous waste injections declined from 189 to 118; (3) although 103 of the 118 well owners were able to demonstrate that untreated hazardous wastes would not migrate from the injection zones, EPA allowed 15 owners to continue injecting untreated hazardous wastes because these wells could not treat the types of wastes being injected or EPA had not developed treatment standards for these wastes; (4) although key oversight data in the Underground Injection Control Program are not accurate, EPA does not believe these data errors compromise its oversight ability; (5) EPA plans to resolve most of the program data problems by December 1994 and determine whether these and other reporting data are necessary for adequate program oversight; (6) EPA has implemented or is in the process of implementing most of the prior recommendations; and (7) EPA has strengthened its oversight of the underground injection control program and required all well operators to search for and plug any improperly plugged wells in the immediate vicinity of their wells, as recommended.

Updated as of May 29, 2018 This action finalizes minimum Federal requirements under the Safe Drinking Water Act (SDWA) for underground injection of carbon dioxide (CO 2) for the purpose of geologic sequestration (GS). GS is one of a portfolio of options that could be deployed to reduce CO 2 emissions to the atmosphere and help to mitigate climate change. This final rule applies to owners or operators of wells that will be used to inject CO 2 into the subsurface for the purpose of long-term storage. It establishes a new class of well, Class VI, and sets minimum technical criteria for the permitting, geologic site characterization, area of review (AoR) and corrective action, financial responsibility, well construction, operation, mechanical integrity testing (MIT), monitoring, well plugging, post-injection site care (PISC), and site closure of Class VI wells for the purposes of protecting underground sources of drinking water (USDWs). The elements of this rulemaking are based on the existing Underground Injection Control (UIC) regulatory framework, with modifications to address the unique nature of CO 2 injection for GS. This rule will help ensure consistency in permitting underground injection of CO 2 at GS operations across the United States and provide requirements to prevent endangerment of USDWs in anticipation of the eventual use of GS to reduce CO 2 emissions to the atmosphere and to mitigate climate change. Although only a very small fraction of injection and extraction activities among the hundreds of thousands of energy development sites in the United States have induced seismicity at levels noticeable to the public, understanding the potential for inducing felt seismic events and for limiting their occurrence and impacts is desirable for state and federal agencies, industry, and the public at large. To better understand, limit, and respond to induced seismic events, work is needed to build robust prediction models, to assess potential hazards, and to help relevant agencies coordinate to address them. Induced Seismicity Potential in Energy Technologies identifies gaps in knowledge and research needed to advance the understanding of induced seismicity; identify gaps in induced seismic hazard assessment methodologies and the research to close those gaps; and assess options for steps toward best practices with regard to energy development and induced seismicity potential.

GAO found that: (1) although there are few confirmed cases of drinking-water contamination, because the contamination is hard to detect, there could be more; (2) monitoring wells have a limited usefulness for large underground areas; (3) neither EPA nor the states require sampling or testing of groundwater immediately above injected waste; (4) EPA did not perform periodic well inspections to ensure compliance with regulations in two states for which it had direct responsibility; (5) 1984 legislation mandated the banning of injection well disposal of hazardous wastes as of August 1988, unless operators could demonstrate that the hazardous waste would not migrate; and (6) EPA believes that most wells currently in operation should pass a demonstration of no migration, meet the more stringent controls, and continue to operate.
