Book excerpt: Subsidies are pervasive throughout OECD countries and worldwide. Every year, OECD countries transfer at least USD 400 billion to different economic sectors. Much of this support is potentially environmentally harmful. Reforming environmentally harmful subsidies is a significant policy challenge facing OECD countries. However, untangling and assessing the effects of subsidies on the environment is a complex task. A systematic approach is required to ensure that appropriate policies are developed and the benefits of reform fully realised. This report presents sectoral analyses on agriculture, fisheries, water, energy and transport. It proposes a checklist approach to identifying and assessing environmentally harmful subsidies. It also identifies the key tensions and conflicts that are likely to influence subsidy policy making. Can the political and economic impediments to subsidy reform be overcome? At the same time, the country is facing rising pension, healthcare, long-term care, and defense expenditures. If Germany were eventually to ease moderately its national fiscal rules, as recommended by IMF staff, this would create some fiscal room but would not be sufficient on its own. This paper therefore explores options for Germany to generate additional fiscal room by reducing its public spending and increasing its revenues, while minimizing the associated costs to the economy. To aid this exploration, this paper also examines areas where Germany’s spending and revenue levels stand out in international comparison. The options for generating fiscal room include: (i) finding efficiencies in healthcare spending; (ii) stabilizing the finances of the social security system; (iii) eliminating environmentally harmful subsidies; (iv) raising revenues from goods and services taxes; (v) raising property taxes and closing loopholes in inheritance taxes; and (vi) earning higher returns on the government’s financial assets.

Law has a clear role to play in that solution. What is not so clear is the role that law has played to date as a constraining factor on state conduct. International Climate Change Law and State Compliance is an unprecedented treatment of the nature of climate change law and the compliance of states with that law. The book argues that the international climate change regime, in the twenty or so years it has been in existence, has developed certain normative rules of law, binding on states. State conduct under these rules is characterized by generally high compliance in areas where equity is not a major concern. There is, by contrast, low compliance in matters requiring a burden-sharing agreement among states to reduce global greenhouse gas emissions to a ‘safe’ level. The book argues that the substantive climate law presently in place must be further developed, through normative rules that bind states individually to top-down mitigation commitments. While a solution to the problem of climate change must take this form, the law’s development in this direction is likely to be hesitant and slow. The book is aimed at scholars and graduate students in environmental law, international law, and international relations.
