The codification project takes up a transnational legal trend that has already led to the passing of similar legislation in a number of countries such as the Netherlands, Switzerland and the United Kingdom or the preparation of corresponding drafts, as in France, Sweden, Poland and Hungary. The European Union is also looking into the codification of environmental law. The Commission's draft applies the principle of sustainable environmentally sound development and establishes an integrated cross-media approach in all areas of environmental legislation. One of its principal features is the unified project authorisation model (Vorhabengenehmigung) for environmental legislation, which the Federal Government intends to use as a basis for the planned implementation of the IPPC Directive in a first volume of an Environmental Code. Other aims pursued by the Commission were to strengthen the responsibility of enterprises and of society, develop incentive instruments and expand transboundary environmental protection. The draft was prepared between autumn 1992 and summer 1997. The Commission consisted of eight experts with practical experience in the field of environmental law as judges, university teaching staff, lawyers, administrative officials and an environmental officer in a large industrial company. This volume contains the English translation of the draft. It seeks to make a contribution to international and European discussions about the harmonisation and codification of environmental law. For this reason the introduction to the English version also contains observations about the German legal system and existing environmental legislation which should make it easier for the reader to understand the proposals.

Regions where coal was readily available, such as the Ruhr Valley in Germany and western Pennsylvania in the United States, witnessed exponential growth-yet also suffered the greatest damage from coal pollution. These conditions prompted civic activism in the form of "anti-smoke" campaigns to attack the unsightly physical manifestations of coal burning. This early period witnessed significant cooperation between industrialists, government, and citizens to combat the smoke problem. Their performance to date has, however, also led to considerable criticism, with several parties arguing that they are methods for avoiding real action that goes beyond "business-as-usual". Is either of these positions justified? The aim of this book is to highlight and learn the lessons from existing experience, looking not just at results but also at specific elements of agreements and also at the process of the agreement itself. Lessons are drawn from experience from across the world, covering the full range of environmental challenges, and from the perspective of key stakeholder groups. Importantly, the book also presents tools for assessing and improving existing agreements and includes recommendations and guidelines for future agreements in key areas such as climate change. It also deals at length with the problem of how such agreements might be used in developing and transitional economies. The overall view of the book is that there is a real potential for the future use of VEAs as part of the policy mix and as a tool for sharing the responsibility for meeting environmental objectives. For the agreements to play this role, however, significant steps are needed to ensure that they are effective, efficient, equitable and appropriately linked to a portfolio of other instruments. The book is divided into four sections. First, existing agreements, their development and efficacy are considered; second, the prospects for voluntary agreements in developing and transitional economies are discussed; third, a range of authors examine the role of VEAs as part of the policy mix to combat climate change; and, finally, the book concludes with an examination of how new tools for evaluating and improving VEAs could be utilized in the future. German administrative law, which focuses on individuals' complaints against the state for violating their rights, does not deal adequately with the broad issues of democratic legitimacy and accountable procedures raised in American courts. Susan Rose-Ackerman compares regulatory law and policy in the United States and Germany and argues that the American system can provide lessons for those seeking to reform environmental policymaking in Germany and the newly democratic states of eastern Europe. Democratic governments, says Rose-Ackerman, face the problem of balancing the desires and expertise of conflicting interest groups, such as those that concern themselves with environmental protection. Under German law, however, environmental associations with policy agendas have no enforceable legal right to participate in federal policymaking, and regulation writing is much less open and accountable than in the United States. The U.S. Supreme Court is moving in the direction of the German system - away from review of the rulemaking process and toward a focus on individual rights. Those who support this trend should look critically at the German solution.
