Book excerpt: Because environmental problems do not respect borders, their solutions often require international cooperation and agreements. The contributors to this book examine how international environmental agreements are put into practice. Their main concern is effectiveness -- the degree to which such agreements lead to changes in behavior that help to solve environmental problems. Their focus is on implementation -- the process that turns commitments into action, at both domestic and international levels. Implementation is the key to effectiveness because these agreements aim to constrain not just governments but a wide array of actors, including individuals, firms, and agencies whose behavior does not change simply because governments have made international commitments. The book is divided into two parts. Part I looks at international systems for implementation review, through which parties share information, review performance, handle noncompliance, and adjust commitments. Part II looks at implementation at the national level, with particular attention to participation by governmental and nongovernmental actors and to problems in states with economies in transition. The book includes fourteen case studies that cover eight major areas of international environmental regulation: conservation and preservation of fauna and flora, stratospheric ozone depletion, pollution in the Baltic Sea, pollution in the North Sea, trade in hazardous chemicals and pesticides, air pollution in Europe, whaling, and marine dumping of nuclear waste. The aviation industry has been in the spotlight of politicians, environmentalists and the Media for its detrimental impacts on the natural environment and the question rises as whether the increased publication of the problem leads to the more environmental conscious consumer purchasing behaviour in terms of booking flights? The study aimed to answer this question. On the one hand the topic was chosen as it represents a current issue; on the other the topic of environmental conscious consumer buying behaviour appears to be under researched. The study intended to work through following objectives in order to find an answer to the main study aim: - How important is the climate change issue to consumers? - Can green marketing and environmental policy making bring a commercial benefit? - To analyse environmentally conscious consumer behaviour. - To analyse whether potential air travellers consider environmental attributes prior to booking a flight by looking at airlines environmental commitment. First of all existing literature surrounding the topic of green marketing and environmental consumer behaviour was reviewed prior to conducting primary research. Primary research was conducted by means of a questionnaire which was distributed to 100 people at Bournemouth, Southampton and Heathrow Airport. The results were subsequently analysed with the aid of SPSS and related to the literature reviewed. Research results exemplified that environmental concern among the population does not exist to an extent that environmental conscious purchasing is likely to take place. In terms of the booking of flights the majority of consumers do not consider airlines environmental attributes in their purchase decision making. Other factors such as travel costs and travel comfort still play a far more decisive role in most individual s decision making. However, the study could reveal that one of the main reasons for this being the case was that most respondents were not aware that airlines can be environmentally responsible. Hence, the findings of the study recommend that airlines should show more evidence of environmental responsibility to potential customers. Book excerpt: Environmental Interests in Investment Arbitration Challenges and Directions Flavia Marisi Economic growth, social inclusion, and environmental protection stand at the core of sustainable development, which aims to deliver long-term growth for current and future generations. Foreign Direct Investment (FDI) can play a key role in sustainable development. Host states’ benefits descending from FDI inflows include tax revenues, technology transfer, specialised training of local human resources, network with satellite activities, better availability of quality products and customer-centric services. These downstream effects jointly stimulate economic growth and social inclusion. This thoroughly researched book explores the relationship between environmental protection – the third component of sustainable development – and FDI. In practice, the intersection between environmental protection and foreign investment not only has generated remarkable success stories such as cross-sectoral green investment but has also in some instances led to severe cases of environmental degradation. Certain foreign investments resulted in open-pit mines leaking harmful substances into the soil, excessive deforestation, improper treatment of water, pollution of groundwater and contamination of mud pits following oil exploitation, leaving the host state with significant environmental damage. Some other cases have witnessed the host state withdrawing or infringing its own environmental policies, which could, in principle, lead to a decrease in the value of the foreign investment as a result of natural resources deterioration. In recent years, an increasing number of investment arbitration cases have seen a clash between the states’ commitments towards their citizens, which include the duty to protect the environment, their health and well-being, and the commitment towards foreign investors to protect their investments. In this book, the author focuses on investor-state cases in which environmental protection measures have been contested and discusses substantive mechanisms in treaty drafting, rules of Customary International Law, and interpretation doctrines, which are aimed at taking environmental concerns into consideration. The topics covered include the following: statistical analysis of investor-state cases where environmental protection measures have been contested; the role of environmental principles in investor-state arbitration; treaty mechanisms addressing environmental concerns; legal tools available under Customary International Law to address environmental interests; the application of the doctrines of proportionality, police powers, and margin of appreciation; and environmental counterclaims as an instrument to claim compensation for environmental damage. The author provides a detailed framework on the normative architecture, offers an extensive analysis of the relevant case law, and proposes concrete solutions to the identified clashes, aimed at refining the balance between environmental and investment protection. With its in-depth analysis and careful documentation, this book aptly captures the inherent fragmentation of international law and undoubtedly represents an invaluable resource for both international law practitioners and scholars. This study examined community characteristics to provide insight why people commit themselves to community organisations focusing on environmental protection. Employees and volunteers of natural conservation organisations in Germany completed a survey containing instruments measuring organisational Sense of Community (COSOC), Pychological Empowerment (PE) and Community Participation (CP). Results indicated that COSOC predicted participatory behaviour of the organisation members, mediated by PE and that these community strengths are interrelated. The examination of potential effects of demographics found age, education, type of employment and working hours per week influencing COSOC. Regression analysis indicated gender, size of the place of residence and working hours per week effecting CP. Methodological limitations and further implications are discussed.
