Book excerpt: Beginning with the Grand Rapids Dam in the 1960s, hydroelectric development has dramatically altered the social, political, and physical landscape of northern Manitoba. The Nelson River has been cut up into segments and fractured by a string of dams, for which the Churchill River had to be diverted and new inflow points from Lake Winnipeg created to manage their capacity. Historic mighty rapids have shrivelled into dry river beds. Manitoba Hydro's Keeyask dam and generating station will expand the existing network of 15 dams and 13,800 km of transmission lines. In Our Backyard tells the story of the Keeyask dam and accompanying development on the Nelson River from the perspective of Indigenous peoples, academics, scientists, and regulators. It builds on the rich environmental and economic evaluations documented in the Clean Environment Commission’s public hearings on Keeyask in 2012. It amplifies Indigenous voices that environmental assessment and regulatory processes have often failed to incorporate and provides a basis for ongoing decision-making and scholarship relating to Keeyask and resource development more generally. It considers cumulative, regional, and strategic impact assessments; Indigenous worldviews and laws within the regulatory and decision-making process; the economics of development; models for monitoring and management; consideration of affected species; and cultural and social impacts. With a provincial and federal regulatory regime that is struggling with important questions around the balance between development and sustainability, and in light of the inherent rights of Indigenous people to land, livelihoods, and self-determination, In Our Backyard offers critical reflections that highlight the need for purposeful dialogue, principled decision making, and a better legacy of northern development in the future.

Although investor-state arbitration (ISA) has been included in investment agreements between developed and developing countries since the 1960s, and provided foreign investors with a kind of private justice against developing world host states, it became increasingly controversial in developed countries when it was included in NAFTA in 1993, creating the possibility of ISA claims between and against two developed countries (the United States or Canada), as well as claims against and by a developing state (Mexico). A few years later, the OECD’s attempt to finalize the Multilateral Agreement on Investment was stymied by concerted civil society protest and opposition to ISA, and in recent years each new proposed agreement has sparked fresh rounds of protest. What engenders the controversy about ISA? While ISA’s advantage is that it prevents escalation of international conflict by relieving states from feeling obliged to espouse claims of injured investors against foreign governments, it is criticized for creating regulatory chill whereby states are reluctant to make necessary public policy reforms for fear that changes to the investment environment will lead to expensive investor claims. Are fears of litigation and expensive payouts well founded? Can key modifications to the ISA system, such as those added to the Comprehensive Economic and Trade Agreement satisfy critics and redeem this system of private justice? Is ISA really necessary between developed democracies where an independent and professional judiciary can generally be trusted to decide without fear or favour? Book excerpt: The Political Economy of Investment Arbitration asks how political institutions and actors in the host state of an investment contribute to the emergence of investor-state disputes. Combining insights from international relations and political economy, it considers two opposing explanations for investor-state disputes: shifting state preferences toward FDI, or the lack of state capacity to maintain an investment-friendly environment. This book's overarching conclusion is that democratic institutions in host states contribute to the emergence of investor-state disputes. Phillips Williams argues that at the heart of many investor-state disputes are highly politicized distributional conflicts involving a range of domestic interest groups. Indeed, it is often pressure from these groups, whether through voting, protests or lobbying, which motivates states to take the policy decisions that are subsequently subject to investors' legal challenges. Thus, this monograph demonstrates that in the face of the potentially high costs posed by investment arbitration, governments continue to take measures which may harm investors in order to pursue specific policy goals. More importantly, these disputes are not only the result of corruption or weak rule of law, but of measures which are taken at the behest of broader interest groups and relate to clear public policy concerns. This has important implications of our normative assessment of the regime and is highly relevant to current debates in both international law and international political economy about the relationship between investment treaties and domestic politics.
