Book excerpt: "This Environmental Assessment (EA) was prepared in accordance with National Environmental Policy Act of 1969 (42 U.S.C. §4321, et seq.), as implemented by the Council of Environmental Quality regulations (40 C.F.R. §1500-1508); and NOAA Administrative Order Series (NAO) 216-6, Environmental Review Procedures for Implementing the National Environmental Policy Act, of May 20, 1999. Executive Order (EO) 12114 furthers the purpose of NEPA with respect to the environment outside the United States, its territories and possessions; accordingly, this EA also analyzes potential impacts of the proposed action to foreign territorial seas in accordance with the EO as implemented by Department Administrative Order 216-12. The green, hawksbill, loggerhead, leatherback, and olive ridley sea turtles are all listed as threatened or endangered under section 4(c) of the Endangered Species Act of 1972 (16 U.S.C. §1531, et seq.). Under the proposed action, the Marine Turtle Management and Conservation Program (MTMCP) proposes to continue and expand funding of projects for monitoring, conservation, and management activities in the U.S. Insular Areas of the Pacific Islands Region (PIR) and internationally as relevant (i.e., of populations with documented linkages to the PIR). These projects would be funded to collect biological and ecological data on marine turtle populations, reduce or mitigate anthropogenic and environmental impacts (including projects working to reduce fishery interactions), support community-based educational outreach, and/or collaborate with marine turtle researchers and managers to build capacity for the protection, conservation, and management of Pacific sea turtles and their habitats. The potential impacts on the human environment of the proposed action, and a range of reasonable alternatives, are discussed and analyzed in this EA"--Summary.

Specifically, the proposed work includes six components: I) conducting a genetic mark -recapture study to evaluate the annual nesting population size, clutch frequency, site fidelity, remigrations rates and population structure for the Northern Recovery unit of loggerheads; 2) sequencing loggerhead mitochondrial DNA to further define and characterize the genetic structure of nesting and foraging popUlations; 3) monitoring sea turtle mortality through maintenance of the Sea Turtle Stranding and Salvage Network (STSSN); 4) monitoring bycatch of marine turtles in North Carolina and Georgia state waters; 5) characterizing pivotal temperatures to estimate sex ratios of loggerhead hatchlings; and 6) continuing a study to characterize and minimize the impacts of boat strikes on sea turtles. Results of this work would be used to assess popUlation status, characterize threats, and develop management strategies to recover the Northern Recovery Unit of loggerhead sea turtles. The proposed action analyzed in the EA would not have significant environmental effects on the target or non-target species; public health and safety would not affected; no unique geographic area would be affected; and the effects of this study would not be highly uncertain, nor would they involve unique or unknown risks. Issuance of this permit would not set a precedent for future actions with significant effects, nor would it represent a decision in principle about a future consideration. There would not be individually insignificant but cumulatively significant impacts associated with the proposed action, and there would not be adverse effects on historic resources. The analyses focused on potential impacts to the biological environment. The proposed modification would authorize standard tagging procedures on sea turtles, including mitigation measures associated with those activities. The timing and location of research would not change. This supplemental EA (SEA) evaluates the potential impacts to the human environment from issuance of the proposed permit modification by supplementing the 2008 EA's assessment of potential impacts on sea turtles, 2 specifically those that may result from the proposed changes in field procedures"--Abstract.

The proposed permit amendment would: (1) extend the action area to include all U.S. waters from Maine to Florida to the to the limit of the Exclusive Economic Zone; (2) authorize harassment during aerial surveys; (3) change the frequency of vessel-based surveys currently authorized from once per season to twice a month, year-round; (4) increase take numbers of currently authorized marine mammals and sea turtles; and (5) add six species [i.e., Blainville's beaked whale (Mesoplodon densirostris), false killer whales (Pseudorca crassidens), hawksbill (Eretmochelys imbricata), loggerhead (Caretta caretta), Kemp's ridley (Lepidochelys kempii), and green (Chelonia mydas) sea turtles]. The requested changes would allow Versar, Inc. (fonnerly GeoMarine, Inc.) to collect the necessary data for generating abundance/density estimates for sea turtles and marine mammals. The amended permit would expire on May 15, 2017.

The ITP would authorize the incidental capture, with some mortality, of five species of endangered and threatened sea turtles, including green (Chelonia mydas), hawksbill (Eretmochelys imbricata), Kemp's ridley (Lepidochelys kempii), leatherback (Dermochelys coriacea) and loggerhead (Caretta caretta) sea turtles, in the North Carolina inshore gillnet fishery and would be valid for ten years. Since 2000, NMFS has issued four separate incidental take permits to NCDMF for the incidental take of sea turtles in inshore gillnet fisheries occurring in Pamlico Sound. Since 2006, incidental take of sea turtles has been documented in areas outside Pamlico Sound, which are not covered under an existing ITP. In 2010, the Duke Environmental Law and Policy Clinic filed suit against NCDMF and the North Carolina Marine Fisheries Commission (NCMFC) on behalf of the Karen Beasley Sea Turtle Rescue and Rehabilitation Center (Beasley Center) for the illegal taking of sea turtles in state regulated inshore gillnet fisheries. As a result of the lawsuit and resulting settlement agreement, NCDMF has amended their commercial fishing regulations for their inshore gillnet fishery to minimize the incidental capture of sea turtles. NCDMF has also submitted a completed application to NMFS for an ESA Section 10(a)(1)(B) ITP, including a conservation plan, for the operation of the state-wide inshore gillnet fishery with measures intended to further monitor, minimize, and mitigate the impacts of incidental take in the fishery to the maximum extent practicable.

Book excerpt: "The National Marine Fisheries Service (NMFS) proposes to issue scientific research permit No. 16253 to NMFS Southeast Fisheries Science Center (Responsible Party: Bonnie Ponwith, Ph. D.). The purpose of this research is to evaluate modifications to commercial fishing gear to mitigate sea turtle interactions in Atlantic and Gulf of Mexico Trawl Fisheries and Longline Fisheries. The evaluations and subsequent gear modifications could help reduce incidental sea turtle bycatch. The research would also provide data to improve stock assessments, assess the impact of anthropogenic activities, and better manage and recover sea turtle species. Some sea turtle captures would be authorized by the proposed permit during trawl research in state fisheries; other sea turtles would be legally captured incidental to Federally managed fisheries. Turtles would be handled, measured, weighed, photographed, flipper tagged, passive integrated transponder tagged, skin biopsied, and released. Under NOAA Administrative Order 216-6, NMFS' issuance of scientific research permits is generally categorically excluded from the National Environmental Policy Act of 1969 requirements to prepare an environmental assessment (EA) or environmental impact statement. However, for this permit NMFS prepared an EA to facilitate a more thorough assessment of potential impacts on endangered and threatened sea turtles.
