Book ENTRE L ORDRE ET LA LIBERT LA D TENTION PROVISOIRE

Download or read book ENTRE L ORDRE ET LA LIBERT LA D TENTION PROVISOIRE written by Philippe Robert and published by Editions L'Harmattan. This book was released on 1985-01-01 with total page 289 pages. Available in PDF, EPUB and Kindle.

Download or read book De la libert la prison written by Catherine Minet-Letalle and published by Editions L'Harmattan. This book was released on 2016 with total page 244 pages. Available in PDF, EPUB and Kindle.

Book French Criminal Justice

    Book Details:
  • Author : Jacqueline Hodgson
  • Publisher : Bloomsbury Publishing
  • Release : 2005-11-08
  • ISBN : 1847310699
  • Pages : 300 pages

Download or read book French Criminal Justice written by Jacqueline Hodgson and published by Bloomsbury Publishing. This book was released on 2005-11-08 with total page 300 pages. Available in PDF, EPUB and Kindle. Book excerpt: Basing much of its analysis upon the first systematic empirical study of the French pre-trial process, this monograph breaks new ground in the field of comparative criminal justice. Moving away from idealised accounts of judicially supervised investigations, it provides a better understanding of the ways in which an inquisitorially rooted criminal process operates in practice and the factors that influence and constrain its development and functioning. The structure and operation of French criminal justice is set within a broad range of contexts of political, occupational and legal cultures from the French Republican tradition of state-centred models of authority, across the growing influence of the ECHR, to the local conditions which determine the ways in which individual discretion is exercised. The French model of investigative supervision and accountability is contrasted with more adversarial procedures and in particular, the different ways in which the reliability of evidence is guaranteed and the interests of the accused protected. Systematic observation of the daily working practices of police, gendarmes, prosecutors and juges dinstruction across a number of sites and time periods, provides a unique and detailed account of the ways in which the French criminal process operates in practice. The understandings and insights generated from this data are then set within a wider legal and political analysis, which considers issues such as the influence and interference of the State within matters of justice; a comparative analysis of the judicial and defence functions; and the extent to which ECHR fair trial guarantees are able to produce legal and ideological change within a process which depends upon a central and judicially supervised investigating authority. An informed knowledge of other European criminal procedures is increasingly essential for those working within UK (as well as comparative) criminal justice, if there is to be a proper engagement with, and evaluation of, measures such as the EUs proposed Council Framework Decision on Certain Procedural Rights in Criminal Proceedings throughout the European Union, as well as recent legislative reform in England and Wales that seeks to adjust the pre-trial roles of police and prosecutor in significant ways. This book will be essential reading for teachers, researchers, students and policy-makers working in the areas of criminal justice in the UK and across Europe, in comparative criminal justice/criminology, as well as in French and European studies.

Book Documenting Individual Identity

Download or read book Documenting Individual Identity written by Jane Caplan and published by Princeton University Press. This book was released on 2018-06-05 with total page 426 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book addresses one of the least studied yet most pervasive aspects of modern life--the techniques and mechanisms by which official agencies certify individual identity. From passports and identity cards to labor registration and alien documentation, from fingerprinting to much-debated contemporary issues such as DNA-typing, body surveillance, and the catastrophic results of colonial-era identity documentation in postcolonial Rwanda, Documenting Individual Identity offers the most comprehensive historical overview of this fascinating topic ever published. The nineteen essays in this volume represent the collaborative effort of historians, sociologists, historians of science, political scientists, economists, and specialists in international relations. Together they cover a period from the emergence of systematic practices of written identification in early modern Europe through to the present day, and a geographic range that includes Europe, the Soviet Union, North and South America, and Africa. While the book is attuned to the nefarious possibilities of states' increasing capacity to identify individuals, it recognizes that these same techniques also certify citizens' eligibility for significant positive rights, such as welfare benefits and voting. Unprecedented in subject and scope, Documenting Individual Identity promises to shape a whole new field of research that crosses disciplinary boundaries and is of broad public and academic significance. In addition to the editors, the contributors are Valentin Groebner, Gérard Noiriel, Charles Steinwedel, Marc Garcelon, Jon Agar, Martine Kaluszynski, Peter Becker, Anne Joseph, Kristin Ruggiero, Andrea Geselle, Andreas Fahrmeier, Leo Lucassen, Pamela Sankar, David Lyon, Gary Marx, Dita Vogel, and Timothy Longman.

Book A World View of Criminal Justice

Download or read book A World View of Criminal Justice written by Richard Vogler and published by Routledge. This book was released on 2017-03-02 with total page 347 pages. Available in PDF, EPUB and Kindle. Book excerpt: Criminal justice procedure is the bedrock of human rights. Surprisingly, however, in an era of unprecedented change in criminal justice around the world, it is often dismissed as technical and unimportant. This failure to take procedure seriously has a terrible cost, allowing reform to be driven by purely pragmatic considerations, cost-cutting or foreign influence. Current US political domination, for example, has produced a historic and global shift towards more adversarial procedure, which is widely misunderstood and inconsistently implemented. This book addresses such issues by bringing together a huge range of historical and contemporary research on criminal justice in Europe, Asia, Africa, Australasia and the Americas. It proposes a theory of procedure derived from the three great international trial modes of 'inquisitorial justice', 'adversarial justice' and 'popular justice'. This approach opens up the possibility of assessing criminal justice from a more objective standpoint, as well as providing a sourcebook for comparative study and practical reform around the world.

Book excerpt: ′Cavadino and Dignan′s Penal Systems: A Comparative Approach looks across national boundaries to see how penal systems differ and why. It is hands-down the most comprehensive and up-to-date book on the subject and should become a staple textbook for use in law and social science courses on comparative penal policy and practice′ - Michael H. Tonry, University of Minnesota ′This book is an important addition to the literature on punishment. It is a highly readable and very well researched overview of some of the major differences in punitiveness between neo-liberal, corporatist and social democratic countries... This is a major contribution to comparative penology by two of the leading authors in this field′ - Alison Liebling, Director of the Prisons Research Centre, UK ′A major and seminal work′ - David Downes, Professor Emeritus at the London School of Economics Penal Systems: A Comparative Approach is a comprehensive and original introduction to the comparative study of punishment. Analysing twelve countries, Cavadino and Dignan offer an integrated and theoretically rigorous approach to comparative penology. They draw upon material provided by a team of eminent penologists to produce an important and highly readable contribution to scholarship in this area. Early chapters introduce the reader to comparative penology, set out the theoretical framework and consider whether there is currently a ′global penal crisis′. Each country is then discussed in turn. Chapters on comparative youth justice and the privatization of prisons follow. Comparisons between countries are drawn within each chapter, giving the reader a synoptic and truly comparative vision of penality in different jurisdictions.

Book Minorities Migrants and Crime

Download or read book Minorities Migrants and Crime written by Ineke Haen Marshall and published by SAGE. This book was released on 1997-07-22 with total page 265 pages. Available in PDF, EPUB and Kindle. Book excerpt: What relationship exists between minority status and crime? Is this relationship generalizable across different societies? Many western nations are becoming concerned with the problem of crime in general and, in particular, the role of minority groups, be they political refugees, guest workers, immigrants, or native ethnic and racial minorities. A unique cross-cultural exploration. Minorities, Migrants, and Crime highlights the empirical realities of crime and these under-studied populations. Each international expert from the United States or Europe surveys national statistical facts and research as well as political and theoretical debates critical to the issues. Revealing a number of surprising similarities and differences, original chapters examine law enforcement priorities, punishment philosophy and practices, and media coverage against the backdrop of contemporary thought and facts about race, ethnicity, migrants, crime, and criminal justice in the United States. Offering an in-depth examination of international perspectives, Minorities, Migrants, and Crime adds a viewpoint crucial to the law and policy making currently taking place in the United States. Minorities, Migrants, and Crime features state-of-the-art research in the international arena of criminal justice. A thought-provoking read, this book will prove to be an ideal resource for researchers, academics, and students in criminology, criminal justice, corrections, policing, sociology, ethnic studies, policy studies, international studies, immigration studies, and public administration.

Available in PDF, EPUB and Kindle. Book excerpt: The title of this work illustrates the two difficulties which the chosen theme poses, difficulties which arise from the confrontation between collective & individual interests. On the one hand, the criminal process is based on the protection of society; on the other hand, human rights implies respect for all individuals implicated in that process, be they victim, witness or accused. A third difficulty arises in relation to the new influence of European law. While the right to judge has long appeared to be the most obvious indication of national sovereignty, it is now subject to supranational control & a State can be censured by the European Court of Human Rights. Part One of this volume analyses the period of reform in various Eastern & Western European countries; Part Two explores the debate among jurists, historians, sociologists & philosophers on the subject of the criminal trial in a democratic society. Finally, Part Three reflects on the issue within the context of the European Community & the European Council & explores the question of a future model for the European criminal trial. Professor Mireille Delmas-Marty teaches at l'Universite de Paris I Pantheon Sorbonne & is a member of l'Institut Universitaire de France. She is the editor of The European Convention for the Protection of Human Rights, International Protection versus National Restrictions (Martinus Nijhoff Publishers, 1992.)

Book Extraits cl s de jurisprudence cour europ enne des Droits de l Homme

Download or read book Extraits cl s de jurisprudence cour europ enne des Droits de l Homme written by Gilles Dutertre and published by Council of Europe. This book was released on 2003-01-01 with total page 412 pages. Available in PDF, EPUB and Kindle.
