Available in PDF, EPUB and Kindle. Book excerpt: Since the early 1980s, the People's Republic of China has been building legal institutions where no meaningful ones had existed before. This collection of essays by leading international scholars of Chinese law analyses the accomplishments of Chinese law reform and the problems that confrontthe Chinese leadership and the Chinese people in their struggle to define the role of law in China. Chinese economic reforms have led to a dramatic rate of economic growth, and have also made China the world's leader in attracting foreign capital. A sound legal system is not only essential forcontinued economic growth and foreign investment, but its future development will express and reflect the evolution of China's post-totalitarian political institutions. These essays focus on the changing Chinese conceptions of the role of law in shaping family relationships; the effectiveness of the courts in civil litigation; the operation of the criminal process; judicial decision-making; the evolution of a legislative process; the growth of a legal profession;the legal framework of foreign direct investment in China; and China's record as a member of the international community. An overview by the editor identifies the emerging functions performed in Chinese society by the new legal institutions and tries to analyse likely major influences on them in thenear future, including, among other contradictory forces, increased consciousness of individual rights and a tenacious insistence by the Chinese Communist Party on maintaining its power.

Book Resource Misallocation Among Listed Firms in China The Evolving Role of State Owned Enterprises

Download or read book Resource Misallocation Among Listed Firms in China The Evolving Role of State Owned Enterprises written by Ms. Emilia M Jurzyk and published by International Monetary Fund. This book was released on 2021-03-12 with total page 45 pages. Available in PDF, EPUB and Kindle. Book excerpt: We document that publicly listed Chinese state-owned enterprises (SOEs) are less productive and profitable than publicly listed firms in which the state has no ownership stake. In particular, Chinese listed SOEs are more capital intensive and have a lower average product of capital than non-SOEs. These productivity differences increased between 2002 and 2009, and remain sizeable in 2019. Using a heterogeneous firm model of resource misallocation, we find that there are large potential productivity gains from reforms which could equalize the marginal products of listed SOEs and listed non-SOEs.

Book Trade and Investment Opportunities in China

Download or read book Trade and Investment Opportunities in China written by Shizhong Dong and published by Praeger. This book was released on 1992-07-22 with total page 296 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book provides a thorough and practical interdisciplinary foundation for analyzing and structuring business relationships with customers in China in a post-Tiananmen context. The authors present a carefully crafted and timely synthesis of the commercial, financial, and legal framework that has been adopted by China to encourage foreign trade and investment. It focuses on China's steadfast commitment to the support of market-oriented reforms throughout the period of economic isolation imposed by the international community of nations from June 1989 through mid-1991. Support is provided for the position that China has irrevocably embarked on its journey toward a market economy and that the climate for foreign trade and investment has become sufficiently stable to warrant serious consideration by foreign business with long-term expansion goals. The book begins with a historic overview of economic and legal developments in China since 1949. The impact of economic reforms implemented in response to the open door policy adopted by the Chinese leadership in 1979 on the state-planned, product-oriented command society is analyzed in the context of the decentralization of managerial responsibility. The structure and operations of domestic Chinese entities are examined in detail. Also emphasized is the importance of understanding the legal and practical aspects of these relationships prior to entering into serious negotiations with a potential partner. Care is taken to fully examine the Chinese Economic Contract Law and the Chinese Foreign Economic Contract Law. The role and function of China's major financial institutions are reviewed, and China's foreign exchange control system is also examined. The structure of China's foreign trade controls including tariff and non-tariff measures is analyzed for its impact on China's application for participation in GATT. Finally, the book focuses on integrating China's evolving commercial and legal framework for foreign trade and investment into actual business ventures with foreign partners. Foreign investment guidelines are reviewed, and the applicability of the Chinese Foreign Joint Venture Enterprise Law is comprehensively explained. The book is an indispensable tool for CEOs, strategic planners considering off-shore expansion, and academicians in the fields of international law, finance, and marketing.

Book China s Emerging Private Enterprises

Download or read book China s Emerging Private Enterprises written by Neil F. Gregory and published by World Bank Publications. This book was released on 2000-01-01 with total page 94 pages. Available in PDF, EPUB and Kindle. Book excerpt: This report aims to take stock of the domestic private sector in China which has emerged over the past twenty years. It is based on surveys and interviews carried out in four locations in China where private sector development is relatively advanced. These studies were supplemented by discussions with entrepreneurs, industry associations, and government officials. The report focuses on three main themes: the structure of private enterprises, the enabling environment for their development and, access to financing. For each of these areas, the report presents an analysis of constraints on private sector development and outlines an agenda for addressing these constraints. The report recommends that, in order to encourage continuing private sector growth, the government should create a level playing field for all enterprises by intervening less and focusing on improved commercial legislation and more open markets. Financial institutions must develop to serve the private sector, and private enterprises need to mature and improve their corporate governance, in order to derive the most benefit from improvements in the business environment.

As China becomes more powerful on the world stage, the global community has dedicated more resources and attention to understanding the country's evolving democratization, and policymakers have identified the development of civil liberties and long-term legal reforms as crucial for the nation's acceptance as a global partner. Modern Chinese Legal Reform is designed as a legal and political research tool to help English-speaking scholars interpret the many recent changes to China's legal system. Investigating subjects such as constitutional history, the intersection of politics and law, democratization, civil legal practices, and judicial mechanisms, the essays in this volume situate current constitutional debates in the context of both the country's ideology and traditions and the wider global community. Editors Xiaobing Li and Qiang Fang bring together scholars from multiple disciplines to provide a comprehensive and balanced look at a difficult subject. Featuring newly available official sources and interviews with Chinese administrators, judges, law-enforcement officers, and legal experts, this essential resource enables readers to view key events through the eyes of individuals who are intimately acquainted with the challenges and successes of the past twenty years.

Book China s Struggle for the Rule of Law

Download or read book China s Struggle for the Rule of Law written by Ronald C. Keith and published by Springer. This book was released on 2016-07-27 with total page 300 pages. Available in PDF, EPUB and Kindle. Book excerpt: The 'rule of law' is more than the mere existence and application of law within the sphere of state activity. Contemporary Chinese debate on the 'rule of law' underlines the limiting of arbitrary government, the materialisation of 'human rights', legal protection of 'rights and interests' and the principle of equality in the impartial legal mediation of conflicts within society's 'structure of interests'. Based upon China interviews and a comprehensive survey of the domestic press and Chinese-language legal journal materials, this book places pre- and post-Tiananmen Square legal reform in political context. The evolving contents of specific laws across the departments of constitutional, administrative, criminal, civil and economic law are assessed in light of the politics and intellectual dynamic of China's legal circles in their struggle to create a 'rule of law'.
