Book Routledge Handbook of Global Health Rights

Download or read book Routledge Handbook of Global Health Rights written by Clayton Ó Néill and published by Routledge. This book was released on 2021-05-30 with total page 315 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines the idea of a fundamental entitlement to health and healthcare from a human rights perspective. The volume is based on a particular conceptual reasoning that balances critical thinking and pragmatism in the context of a universal right to health. Thus, the primary focus of the book is the relationship or contrast between rights-based discourse/jurisprudential arguments and real-life healthcare contexts. The work sets out the constraints that are imposed on a universal right to health by practical realities such as economic hardship in countries, lack of appropriate governance, and lack of support for the implementation of this right through appropriate resource allocation. It queries the degree to which the existence of this legally enshrined right and its application in instruments such as the International Covenant on Economic, Social and Cultural Rights (ICESCR) and the Universal Declaration of Human Rights (UDHR) can be more than an ephemeral aspiration but can, actually, sustain, promote, and instil good practice. It further asks if social reality and the inequalities that present themselves therein impede the implementation of laudable human rights, particularly within marginalised communities and cadres of people. It deliberates on what states and global bodies do, or could do, in practical terms to ensure that such rights are moved beyond the aspirational and become attainable and implementable. Divided into three parts, the first analyses the notion of a universal inalienable right to health(care) from jurisprudential, anthropological, legal, and ethical perspectives. The second part considers the translation of international human rights norms into specific jurisdictional healthcare contexts. With a global perspective it includes countries with very different legal, economic, and social contexts. Finally, the third part summarises the lessons learnt and provides a pathway for future action. The book will be an invaluable resource for students, academics, and policymakers working in the areas of health law and policy, and international human rights law.

Download or read book Regulating the End of Life written by Sue Westwood and published by Routledge. This book was released on 2021-09-09 with total page 245 pages. Available in PDF, EPUB and Kindle. Book excerpt: Regulating the End of Life: Death Rights is a collection of cutting-edge chapters on assisted dying and euthanasia, written by leading authors in the field. Providing an overview of current regulation on assisted dying and euthanasia, both in the UK and internationally, this book also addresses the associated debates on ethical, moral, and rights issues. It considers whether, just as there is a right to life, there should also be a right to death, especially in the context of unbearable human suffering. The unintended consequences of prohibitions on assisted dying and euthanasia are explored, and the argument put forward that knowing one can choose when and how one dies can be life-extending, rather than life-limiting. Key critiques from feminist and disability studies are addressed. The overarching theme of the collection is that death is an embodied right which we should be entitled to exercise, with appropriate safeguards, as and when we choose. Making a novel contribution to the debate on assisted dying, this interdisciplinary book will appeal to those with relevant interests in law, socio-legal studies, applied ethics, medical ethics, politics, philosophy, and sociology.

This book was released on 2021-09-28 with total page 252 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book presents a model for reforming and developing Indigenous related legislation and policy, not only in Australia, but also in other jurisdictions. The model provides guidance about how to seek, listen to and respond to the voices of Indigenous children and young people. The participation of Indigenous children and young people, when carried out in a culturally and age-appropriate way and based on free, prior and informed consent, is an invaluable resource capable of empowering children and young people and informing Indigenous related legislation and policy. This project contributes to the emerging field of robust, ethically sound, participatory research with Indigenous children and young people and proposes ways in which Australian and international legislators and policymakers can implement the principle of children’s participation by involving Aboriginal children and young people in the development of law and policy pertaining to their lives. This book provides accounts from Aboriginal children and young people detailing their views on how they can be involved in law and policy development in the future. Book Disputes and Dilemmas in Health Law

Download or read book Disputes and Dilemmas in Health Law written by Ian R. Freckelton and published by Federation Press. This book was released on 2006 with total page 740 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book replaces the successful Controversies in Health Law. Under the same editorship and much the same authorship, it is substantially larger (30 chapters instead of 18) and correspondingly more comprehensive. It retains the lively analysis and the focus on controversial and cutting-edge problems. The chapters are broken up into parts covering Litigation and Liabilty; Reproductive Technologies; The Sequelae of the End of Life; Public Health; Ethical Frameworks and Dilemmas; Regulation; Human Rights and Therapeutic Jurisprudence; Research and Vulnerability and Information, Privacy and Confidentiality . They consider issues raised by new technologies, changing legislation and altering community expectations; by new regulatory processes for medicine and all of the health professions; by the fundamental changes to civil liability for medical negligence; by the fierce debate over the role of coroners. Disputes and Dilemmas in Health Law covers questions on property in human tissue and on the ethical and legal aspects of the genetics revolution; provides a modern take on "old" issues such as reproductive law; takes account of changes relating to expert evidence; and discusses how difficult cases in relation to psychiatric injury and wrongful life are pushing compensability to its edges.

  • Pages : 270 pages

Download or read book Buraadja written by Andrew Bragg and published by . This book was released on 2021-05 with total page 270 pages. Available in PDF, EPUB and Kindle. Book excerpt: YESTERDAY Buraadja provides a powerful account of the Liberal Party's approach to Indigenous affairs. The party's record of successes and failures is frankly evaluated as an important basis for developing effective approaches to persistent problems. TODAY The problems faced by Aboriginal and Torres Strait Islander people today are considered through two contrasting lenses: the extremist lens of the Black Lives Matter movement, and the moderate lens of the Uluru Statement from the Heart. The Uluru Statement is shown to offer a modest approach to addressing problems by recognising Indigenous peoples in the Constitution, making agreements, and coming to terms with Australia's history. TOMORROW Andrew Bragg draws on liberal values to make a compelling case for national reconciliation in Australia. He offers some practical suggestions for remembering our history, listening to Indigenous people, and planning for the future.
