History of tenure in Ireland entirely different from its history in England--The Roman system of tenure never implanted in the island--The original barbarian occupation at will continued until the conquest by the Normans--English law not then established, nor English tenures generally introduced--Permanent or inheritable tenure never generally given to the tenants, the actual cultivators of the soil--The pervading custom of the country tenancy at will--Effects of this long-continued uncertainty of tenure--Attempted settlements of the country--Plantations in Ulster, and introduction of English usages--Wide-spread confiscations in other parts of the country--The penal laws and their effects in producing a concentration of the land in the hands of a small class, and precluding the general body of the people from other than short tenures--Result of this state of things a pernicious system of speculative leases, and ruinous underletting, tenancy at will, and rack rents--The actual tenants and cultivators of the soil mere serfs, without any certain tenure, entirely in the power of their lords--Disastrous effects of this derangement in the distribution of land remaining deeply rooted in the country long after the repeal of the penal laws--The rise of the Land Question in the early part of this century, and repeated efforts of statesmen to settle it--The Report of the Devon Commission in 1845--Principle affirmed that the tenant was entitled to compensation--Abortive attempts to carry it out--The Encumbered Estates Act and its effects--The Indian Land Settlement of 1859--The Act of 1860 for Ireland--Its effect, in making the relation of landlord and tenant depend entirely on contract--Subsequent Bill to require...

Book Irish Land and British Politics

Download or read book Irish Land and British Politics written by E. D. Steele and published by CUP Archive. This book was released on 1974-09-12 with total page 388 pages. Available in PDF, EPUB and Kindle. Book excerpt: The story of the British political system's reaction to the Irish unrest is told, and an important episode in Mr Gladstone's career fully revealed. The agrarian reform of 1870 was not only `the beginning of the undoing of the conquest', it was also a point of departure for British legislation generally. A great deal of evidence is marshalled in the book to support its argument that the Act undermined the conception of property-rights which was central to the self-confidence of the rulers of mid-Victorian Britain. Dr Steele draws on the relatively neglected mass of evidence about the Irish peasantry, their customs and aspirations, collected and printed by British Parliamentary and official investigations during the nineteenth century. He has been able to exploit a wealth of material in the private pipers of Mr Gladstone, his cabinet colleagues and other leading political figures. Selective use has been made of the British and Irish press, to illustrate and emphasize all that was at stake.
