The purpose is to present a condensed text of the law of contract: to give the general theory of the subject as taught in schools of law, while yet avoiding the reading of endless cases. Following the various rules in the order given, it is hoped that the student will get an understanding of the subject sufficient to guide him in meeting the legal phases of whatever branch of engineering may engage him. It is the author's belief that the case system of teaching law is not the best for the engineer. On the other hand, the text-book method taken alone does not enable the student to understand fully how the courts work out the rules of law in connection with the concrete facts. A combination of the two methods judiciously arranged by the instructor seems better adapted to provide the student with a knowledge of this important subject than is the present meager lecture system. To this end the rules of law in each chapter are followed by cases from practice, in many instances involving situations closely allied to engineering and intended to illustrate the application of the rules previously learned. Brief extracts from opinions in cases of a strictly engineering nature are given at the end of each section for the purpose of further illustration. The law of contract as presented to the majority of engineering schools at the present time consists of half a dozen lectures dcliv ered by an attorney, who, aside from these lectures, does no further lecturing or teaching. The result is what might be expected: the engineering student graduates with practically no knowledge of the subject. This text is intended for use as a recitation course, to be supplemented by an occasional lecture by the instructor, and to be given by an experienced professor of engineering. The author was admitted to the Bar of New Mexico, and practised law there, serving as local attorney for the A. T. & S. F. R. R. and as City Attorney of Socorro. He was later admitted to practice in Massachusetts. He also spent several years as a civil engineer in water works, sewerage, and railroad construction. The purpose of this book is not to make "every man his own lawyer," but rather to give the engineer a sufficient understanding of important fundamental features of law, so that he may have some idea of when or how to act himself and when to seek expert advice, as well as to enlarge his horizon and perhaps encourage him to further study of law. Many engineers will find that there is some chapter which covers ground concerning which they are better informed than the author or than most practising lawyers. They will, nevertheless, probably find other chapters with which they are less familiar, and which may prove interesting. Thus book can treat any of the subjects of Part I only briefly, and it is hoped that it may be judged by the good it contains rather than criticized for omissions. The entire ground of law cannot be covered in the space available. The preparation has extended over several years, partly in trying to avoid the plight of the business man who once apologized for a long letter; he had not time to write a short one. Some variation in the style will be noted in passing from Part I to Part II. In the latter, the words Contractor, Engineer, Owner, Company, City, and Board are capitalized, as these parties seem to be more clearly distinguished by this means. The important documents which constitute the subjects treated in Part II, as Advertisement, Proposal, Contract, Bond, Specifications, and Information for Bidders, are also capitalized for a similar reason. The system of paging is unusual, and was adopted to give flexibility in revision. The nature of the book is such that later revision will certainly be desirable and even necessary. Their uses in gaseous mixture separations are, however, far from achieving their full potential. Separation of air components, natural gas dehumidification and sweeting, separation and recovery of CO2 from biogas, and H2 from refinery gases are all examples of current industrial applications.
